Knife Laws in Ontario Canada

Just stay out of trouble and be a good boy and the cops won't bother you. Don't give them a reason to even ask of you have any knives.

I always stay out of trouble, after all you know what they say the nail that stick out is the one that gets hammered! thank you everyone for your input!

One thing to consider. Knife law is left vague intentionally in Canada, as it allows a considerable amount of officer discretion. I have been stopped by a police officer because he saw my tenacious clip on my pocket. He asked me about my concealed weapon. I played dumb, and said "What weapon?". He replied "The concealed knife in your pocket." I explained to him it was a tool, it wasn't concealed because he could see the clip and I like to cut my apples into wedges before I eat them. He tried to confiscate it, and I complied. I asked him where I could retrieve it, what his badge number was, what his supervisors name was, and if he could please give me a receipt for the confiscation. He gave the knife back to me, and told me not to do anything threatening with it.

*shrugs* Any knife could be a weapon, carrying a concealed weapon in Canada is generally illegal. If the officer thinks it is a weapon, he will ask questions about it. Convince the officer it is a tool, don't carry it concealed, be polite and courteous about it and don't open it aggressively. Most police officers are decent chaps, and if you treat them with the respect they want you generally won't run into issues.

I know you can carry a knife cop even said " there's no limit on knives in Ontario or Canada you can carry a sword if you want!" the big question is can you carry a assisted opening knife in Ontario with proof that they can't take it! I have my favorite ZT301 and there is no way in hell i will travel with it unless i know for sure i can carry it without some cop trying to take it I want proof so i can say " it says right here see you can't take it!"

Don't carry your ZT, it's illegal in Ontario, satisfied?

No its not.

To clarify;

FOLDING KNIVES AND FIXED BLADES INCLUDING ASSISTED OPENERS ARE PERFECTLY LEGAL AS *TOOLS* IN ONTARIO. PERIOD.

THE ONLY RESTRICTION ARE AUTOMATIC KNIVES (opens automaticaly through pushing a button or lever- the tab part of the tang on an assisted knife IS NOT an automatic knife) , GRAVITY KNIVES (Blade opens with inertia and nothing else), PUNCH DAGGERS AND BALISONGS.

END.

You need to breathe. He can take whatever he wants if in his judgement he feels it's illegal. Are you going to argue and somehow convince him with a printed piece of paper you found on the internet?

Should you it be mistakenly confiscated, politely ask for his name, badge, where he works and a receipt of confiscation (not sure what it would be called). When you've stopped crying, go to the division and follow the process to challenge it and get your knife back. End of story.

thanks guys even for the sarcasm lol i do understand! legal in Ontario and if they take it you can get it back most likely! I just thought someone would of had this happen and found a way to prove its not illegal so they don't have to go through all the work of going to the station and filling out papers or court to get it back. dam law it keeps good people from living their lives well the city's run-a-muck with criminals! Thanks guys for your help its greatly appreciated1;)

I just came across this thread. Realize it is a few years old. Buddha is under the impression that individual provinces legislate criminal laws like the USA. The Criminal code of Canada covers all the Provinces and is the law

across all of them. There are no differences in any of the Provinces.

Not entirely true. It is true that your basic level of weapon law comes from the federal level, there are also provincial and local laws that come into play which are more strict. For example, it is illegal in the city of Calgary to carry any knife openly. So that would leave a person in a bit of a pickle, as if you carry concealed, and it was determined that what you were carrying was a weapon, then you are breaking federal law....

So you may want to make sure that you know what your local bylaws are concerning carry.

If you cant justify it its a nono.
you cant carry a weapon.
a weapon is defined as anything with the intent to harm another individual. (carrying for self defense means you're carrying a weapon).

edited because i'm not sure what i was thinking 4 years ago.

If it looks scary its a nono.

Not true.
When a cop sees your 5 inch bladed Cold Steel Voyager, says "That's not a pocket-knife; that's a folding machete!" and just hands it back, it supports the actual law which makes NO MENTION of scariness quotient of knives.

Hi All
A peace officer is not "THE LAW". The law is written in the Criminal Code of Canada and bunch of othe legislation and controls. You go in front of a judge to get "THE LAW". Asking a police officer is one step up from asking your buddy at work. Interpretation is everything. You should see some of the inocent property seized by customs officers and police in the name of public saftey.
That said, a peace officer or customs officer in the performance of his duty could seize your blade and you now have to jump through hoops to get it back. Some police departments will not even return your property even when ordered to by a judge.
Don't show, don't ask and don't tell.
I'm not saying peaceofficers or customs afficers are stupid . Tehy have a ton of stuff to know and often make decisions based on emotion and YOUR attitude just like we do.

Be safe and be carefull.
