Letter from Ontario's attorneys

Both companies lost sales and royalties by me purchasing another product due to unavailability. I have no doubt others have gone elsewhere also.

I'm glad to see they're finally going to pay up for using your name's, logo's, etc.., maybe they've actually turned around and decided to do business honestly and fairly!

either way, keep up the good work guys! Your products speak for themselves and the fact that you stand behind them the way that you do just goes to show what a quality knife you guys are turning out! Maybe that's what they meant by "unfair competition"!! :D

Thank you for the translation;)

While Ontario may have seen a minute loss of sales over this whole deboggle, I doubt that it's really "hurt" them all that much. If it has hurt their sales, it hurt sales that their profiting from unethiclly if not illegally, so I don't really feel that bad for them.

While I agree that from '02-'07, this agreement was great for RAT in that it gave them profits and market exposure, I have a strange feeling that their a little better off having their OWN knife operation instead of just recieving royalties from someone elses.

All Mike and I want is what is fair and just. We don't want to take anything from anyone and don't want anyone taking anything from us. We don't have to resort to dirty tricks, subsidies or any unfair advantages to be successful. Again, we truly wish Ontario the best of success as long as they're not taking something that's not theirs to achieve it.

You are spot on when it comes to whether it has hurt them. According to the royalty statements I got today their sales have not lagged one bit. In fact, they have increased substantially. Amazing.

That surprises me a bit. I've seen much less positive press around the RAT line in the past year.

If they're playing games then it doesn't work with people like us that refuse to play. Again, all we can do is be fair and honest, and if being honest means that we win or lose, then so be it. To Ontario's credit, they did pay all the back royalties that have been due for some time now, but this does NOT resolve all the issues by any stretch of the imagination. They did attempt to take our common law marks when they knew we had them in commerce before Ontario, plus the other issues. So this thing is a long way from being resolved.

That may be true now, but sometimes it takes a while for things to catch up and show up on paper. For example , the increase in sales of knives may be setting on stock shelves or in distributors stock and the slow up is held in check till the current stock is depleted. I don't know for sure, it's just a thought as I have looked at quite a few sites and haven't had a problem finding Ontario rats for sale, yet I chose to not buy them. I guess it comes down to how much inventory is out there . Time will tell the true story of sales.

One other thing which I forgot to add is the same source distributors carrying both lines at the moment , some distributors even listing them together . That needs clarified because I have been to sites that show Ontario rats and listed with them is theRC line for $20.00 more. That's confusing and an individual would naturally buy the one that appears to be the same yet for less money.A clear distinction must be drawn or no longer have same distributors marketing both lines, especially together.

Whats ironic is the fact that those royalty checks arrived just before the Blade show where Ontario would not be posturing behind lawyers or reading about their reputation on the internet. Next week they have too look their current customers, potential customers, and colleagues in the industry in the EYE!!!

In all fairness to Ontario, about an hour ago UPS delivered a letter than had all of our back royalty statements and checks enclosed. (With that said, I am assuming that the checks and statements are accurate). So, this appears to me to be the start of doing things correctly when it comes to the differences between RAT Cutlery and Ontario. I truly hope so. As we have said all along, we wish Ontario the best of success but we want things to be done correctly whether it's grinding a knife with our name on it or paying us royalties that are due. Maybe the attorneys can now settle the differences we have with the trademarks and other issues. Hopefully.

Onward!

Jeff

onward indeed.

our prayers are with you, that this mess gets sorted and you cool cats can get on with doing good stuff, unhindered.

No doubt. But they shouldn't blame us for just telling the truth in a public format, then call it defamation. They have as much access to the public as we do. There's an old saying: if you can't take the heat then get out of the kitchen. The truth is the truth and everyone should always be entitled to the truth...especially a customer base. We simply tell the truth and let anyone and everyone hear it and decide for themselves.

Truth is not defamation. You told it, and you backed up everything you said with irrefutable evidence. That's just lawyerly scare tactics. They obviously have underestimated your sophistication, Jeff, and Mike. They thought you were a couple of ignorant country bumpkins.

I could say a lot about Nick Trbovich, Jr. In short, he is a figurehead, a boy given a job by his daddy who owns the parent company. He cannot make any major decisions himself without first asking dad. First thing he should do is actually learn something about knives and cutlery.
