Missouri knife law, automatics and concealed carry

Are you confusing auto openers? Assisted openers were deemed not automatics under the ATF designation several years ago.

Perhaps ... I'm aware of the distinction at the federal level, but am not aware of whether
it has been adopted at state or municipal levels.

The specific knife I'm looking at is the Benchmade Adamas Auto 2750BKSN , not sure how it's spring is classified.
 
During my CCW class I asked the question about carrying an automatic knife in Missouri with my CCW permit, the instructor, an ex-police officer said "absolutely not. It will allow you to conceal a sword down your pant leg if you want but still no automatic knives." In MO my understanding is 4" without a CCW permit, no length restriction with. Autos can be collected in MO but to carry an auto you have to be a police officer.

This is not correct. The passage of the law removing the requirement for a C&R license banned the possession of all automatic knives in Missouri unless you are LE on duty. You cannot posses them for any reason as a civilian at this time. Read the earlier post's in this thread.

"Just to throw a kink into the Missouri issue, as of August 28th no one in Missouri outside of active law enforcement can own an automatic knife. Legislators removed the curio and relic clause so as to make possession of SBR's, and suppressors available to purchase without an additional FFL requirement. It was the curio and relic clause that allowed Missouri citizens to own an automatic knife as long as you did not carry it. I sent the legislators who crafted the law a request to clarify if they were going to correct this as they admitted it was an unintended consequence. I have not received a reply. "
 
Jeez! As often as they change laws they should give us like a ten year grace period to finally hear about it and comply. Not that it would help with the confusion.
 
So the current session has closed with no progress on reinstating the ownership of automatic knives in Missouri. Anyone else have any new info?
 
Unless I'm missing something, the bill is already on his desk. The Congressional session is no longer part of the equation. They've already voted on, and passed, the bill. :confused:

So, the governor signed the bills today. Can someone clarify "SS/SCS/SBs 489 & 637 - Under current law, a person commits a Class A misdemeanor if he or she possesses, manufactures, transports, repairs, or sells a switchblade knife. This act limits the prohibition to the possession, manufacture, transport, repair or sale of a switchblade knife when such uses violate federal law, and makes the crime a Class C felony."?

Two years ago I could only own an automatic knife. Is this the Interpretation of the new law? Or can I now carry one if I do not use it in violation of federal law? Note, this law takes effect immediately.
 
Yes under the new law you may carry an automatic knife as long as it is not in violation of any federal laws. For instance if you carry an automatic into a federal building where it is restricted then you would be in violation of federal law AS WELL AS the new STATE law.

It is important to note that a city or town could potentially prohibit certain knives and this is why Knife Rights stresses that we must have knife preemption laws in all 50 states to prevent cities from passing such laws, but we have to do it one step at a time. This is a huge first step in Missouri.

So, I guess it's time to confess how ignorant I am...I would like to own an automatic knife, but I'm not sure about purchasing one. Can one be shipped to me or would I have to purchase one at a dealer in state or would it be in violation of any laws. I can honestly say I would never carry it. I'm just a collector looking at broadening my horizons as far as knives go. Sorry guys...I'm easily confused. Any clarification would be greatly appreciated.

Oops...sorry. Missouri...it's kinda like a legal mine field around here when it comes to knives.

You can also purchase one online and have it mailed to you here in Missouri. Or buy one locally, but note that not all dealers know the laws.
