Moderation team losing touch.

Copyright, trademark, patent, fair use etc apparently are wholly irrelevant, as this is not referenced AT ALL in the forum rule about homage/knockoffs. What is determined on Bladeforums is what can be sold on Bladeforums. There are no fines, no jail time, and no restrictions to sell elsewhere. What is legal in a specific city, county, state, or country is not relevant, Spark can be as restrictive and exclusive as he wants to be in what can be sold on this site.

Now does this mean a Kabar combat knife, Schrade Golden Bear, Cold Steel GI Tanto, Microtech Matrix, etc are allowed to be sold? Looks like it. But the question most specific to this thread is what is the forum stance on selling knives marketed as inspired or replica pieces based on movies. A sword inspired by Lord of the Rings was also made and posted here. There are licensed LOTR swords sold. Maybe they aren't the best quality, but they are made with permission, so does BFC allow the marketing of one that is not?

Based on the thread title, is the bigger issue that the Mods have lost touch?

I think the Mods here overall have done a remarkable job. With a zillion threads and posts I think these guys show time and time again that they are truly dedicated to doing the best job possible and are in touch with the BFC community.
 
Yeah, it's a thankless job and the expectations are sometimes unreasonably high. People also take personal offense at some actions. It is tough because of the fact that livelihoods and intellectual property is sometimes at issue, but these are not commissioned law enforcement or court officers (at least not in this role on BFC) so available recourse, due diligence, and interpretation of rules is not set in stone or guaranteed to go the way of any single person other than the site owners/administrators. You can't go blabbing about civil rights or freedoms here any more than you could in someone's living room when demanding the remote or to sit in the la-z-boy. With civil discussion, persuasive arguments and reasonable views of moral and legal considerations will usually win over, so just don't get aggravated with the other side while things are still getting sorted.

I'm confused. Who would own the copyright? The Production company or another knifemaker? If it's the Production company, do they even offer this for sale somewhere?

My point being, if no one entity even cares because it's never been made, why the fuss?

And maybe I've missed something or need education.

How is it copyright infringement if it clearly and boldly states INFLUENCED BY? I am confused.

And correct me if I am wrong but you can not stomp on another persons sales thread, that being unless you are a MOD in which you clearly are not.

Anywho, did the OP get banned, he has not posted for a while. If so, thanks MODs, one less that we have to deal with.

No one is getting banned here. That isn't how we do things. We try and discuss matters first and see if there is a chance to come to an understanding, after all we are adults(most of us). ;)

United had the license back when the movie came out, I remember those awful things at gun shows. :p

Problem with the sales ad is the use of trademarked images to sell his product, The production company would not look highly on that. There is a strong possibility that the shape of the knife is trademarked, stranger things have been TM'd.
