Need opinions - Who gets the knife.

I do not sell many knives here, but have a few that I put up.

Yesterday a guy wrote me on one asking for a pic and I sent it.

This morning at around 8:20 I got this email.

About an hour later I got a definate "I'll take it" from another person.

I wrote the first guy asking if this was a deal so to speak and the second guy saying I would wait on the answer from the first.

Question:

Does the above email indicate an "I'll take it", or does the second guy have the rights since his response was quite clear?

I would give Guy 1 till the days end to clarify his position. Guy 2 should understand this and wait patiently. You should let guy 1 know that in future transactions that he needs to be more direct.
 
Gus, I tend to go with the definitive "I'll take it". Seal the deal with the "I'll take it guy", then reply to the ambiguous fellow that it's sold. You can only accommodate the folks that are clear with their communications. IMHO of course.

Guy #1's message isn't clear to me that he intends on "taking it"
He doesn't say how he is paying,when, or for your mailing info.It sounds to me like he is trying to get his finances in order, to be able to make the purchase as soon as possible before it is sold.Guy #2 is simple,he is ready to go and say's he wants it.If it were me, the Guy#2 would get it,you owe nothing to #1, and no need to hold it a day.
 
While I would normally sell to an "I'll take it" over an earlier "I'll think about it," I think it's reasonable to allow the first guy showing interest to confirm his intent. I can't tell from your description whether his intent was to mull it over or if he was communicating intent to buy. His e-mail can be interpreted to mean he wants the knife and perhaps he did not communicate this clearly. I'd ask him to verify his position...if he confirms he'll take the knife with timing/payment agreeable to you, it's his. If his intent was to think about it or try to gather some $, your call as to whether to allow him time to do so. Nothing lost if you give the first guy time to verify his intent...the second guy should understand you have someone ahead of him in the queue. If the first guy is wishy-washy or does not communicate in a reasonable amount of time (your call), I'd go to the second guy. My $0.02.
 
There is no doubt, if it were me, the knife would be on it's way to Guy 2

The problem is that the knife is obviously for a serious collector.

I wrote guy2 and he is more than understanding.
We are going to give guy1 one a chance until this evening or by tomorrow the knife will be on its way to guy2.
 
I'll settle this. Give it to me (notice the lack fundage that I would be required to give you?) ! :p :D

I don't sell on BF, but I buy fairly often, IMO the definitive "I'll take it" would get the nod. But with that said, if a seller e-mailed me with similar circumstances that you find yourself in, I would agree to wait or just leave it up to the seller.

This is now a moral question. In legal terms, Guy 1 has not even made an offer. Guy 2 has made an offer, and if you accept his offer and notify him, then it is considered a binding contract.

Your call, but personally I'd probably tend to favour Guy 2 since he has expressed his intention much more clearly.

It sounds to me like guy 1 is kind of a noob, and that's his way of saying I'll take it. If that's his intention, let him know that he should be more clear the next time he makes a statement like that.

NOT very funny. Well it is, kind of, but not really. I was one of those that Art sold to, while selling to another guy too. Sold the same thing to both of us. I even paid him for the item twice, cuz I beleived his crap and I'm a sucker for a brother in need.

Great ending, the other fellow who bought it and actually received it, sent the item to me. I still have it. Some other brother heard about it, sent me a brand new item, which I promptly sent to the other guy who bought it but sent it to me. Is that clear as mud?
 
I've learned that it's good to say something like "First definite 'I'll take it' gets priority over inquiries" as this removes any ambiguity on your end.

As for this situation, give it a day, no more than 2 for the first guy to get back to you. If he doesn't get back to you by then, give it to guy #2, because even if guy #1 still wants the knife, he should have been in contact, and you shouldn't make a deal without being in contact to arrange payment/shipping.

Sorry you are wrong.

I have been totally honest from day one here an on other forums and have never stated that I am a dealer nor am I. I have stated on several occastions that I used to deal at shows.

Have not dealt since 1996 and the knives I had in inventory when I quit were disposed of on ebay.

Thanks for all the input. Guy 2 can expect the knife on Wednesday :D.
 
Bastid, sorry I missed this little drama - I'd say the knife goes to guy number 2 - he's ready to pay immediately and has made that clear.

Guy number 1 has not communicated anything except "I like the knife." We all like knives, but since you've got it for sale, it's like the browser at the show - he may be screwing up his courage to make an offer and pull out his cash, but you've got another guy standing to his left waving dollar bills.

No offense to Guy number 1, here, but.....

We've all been the Browser, but the Buyer gets precedence when the knife is For Sale.
