I tried to hold off as long as possible, giving this seller a chance to respond...well, no response in 11 days...

Purchased a knife from him on December 2nd via PP gift (the classic, 'gift or add %' but my fault to save few bucks).

I get a tracking number from him on the 3rd and tells me he'll put it in the mailbox on the way to work. The tracking online indicates USPS priority 2 day. So far so good. I thank him and let him know I'll get in touch once the package is delivered.

Tracking remains at "pre-shipment" two days later so I email him. No response. Contacted USPS, they tell me the package was never received, and 'highly' unlikely it would be delivered without having been scanned.

So far, I sent him 2 PM's and 9 emails...no response...I've not accused him of anything, but only asked him to give me an update as I would think it would be to his interest to get a receipt from the post office for a shipped package...

If the package is lost during shipment, I can deal with this. I would think, as a seller, you should at least be responsible to make sure the package gets to the post office!!! My general practice is to send tracking information and keep receipt of post office transaction for my own reference. If no tracking, then at least pic of the receipt...

Very disappointed...no response bothers me more than anything else since I can only think the worst of the seller (as a fraud or intended to cheat...)...All in honesty, hope he is not ill or something bad has happened in his life...

Regardless, no response is just a bad way to deal in forums like this...and still no package...
 
According to paypal's policy, you essentially gave him the money as a gift, so you definately won't be able to get your money back through them. However the seller may come through and issue you a refund if the knife doesn't show up . Hope it works out for you.

Another current thread where a guy is out money because he tried to save a few bucks for paypal's excellent buyers protection.

Mail Fraud or Postal Fraud is SERIOUS . Mail him again and indicate that you are going to the Postal Service to initiate a Claim . This should work and if not , initiate a claim .

I'm not trying to argue the practice of PP policy (as I admit) or whine about loss of money here. Just trying to point out the standard practice of forum members. If they are indeed fraudulent by nature or intended from beginning to cheat me out of my money, I'm simply being naive. I still believe 'most' people want to practice good.

It is often stated here that "I can't be responsible for lost or damaged items once dropped off at the post office." I get this, but at the moment, I haven't received any proof that the item has ever made it to the post office.

I'm hoping that the seller will still come through...

I did not think about the mail fraud aspect of it. That is defiantly the way to go about being made whole. I really hope this works out for ya man. I feel bad that you got taken (it looks like). It has happened to me and it was a terrible feeling. Best of luck

In regards to money lost, lesson learned...I will never PP gift, and will never ask for PP gift.

Purchasing shipping (which gives you a tracking number you can then send to your buyer) and then not putting the actual item in the mail is a pretty classic scammer move because at least for a while it gives them a plausible deniability - "Something must be up with USPS, I can prove I shipped it - look at this tracking number!". Barring some kind of drastic emergency, 11 days is way too long for someone to take to ship something out. It's also highly unlikely it will never be scanned once on its journey from him to you.

EDIT: Looked the seller up, seems like a strange time to start flaking out when you've already established a positive reputation. Hopefully this thread will get a response.

I think he is pretty new to the fourms...since May this year?

I've been trying to give him the benefit of the doubt that something bad has happened in his life...who knows...

That is what I was thinking in regards to 'pre-shipment' indication on the tracking number...If it is this easy, think of ALL the criminals trying to sell online!!! Absolutely terrible...

I'm still hoping that he'll get in touch with me. I just shot him an email letting him know that I'll be filing a complaint through US Postal Inspection Service...Let's see if he responds...

The forum has few rules, but reading them saves a lot of heartache. Op you chose to do business, with a member with < 5 itrades. 4 as seller as I can tell. I would have to ask was the 3.0% worth it ? You Also broke Paypal rules by lying on their transaction. Often Paypal will ask for first and last name of person you are gifting, what name did you put if you were asked ? Also it is VERY possible that if the seller did not go inside the Post Office, (dropped in outside box, or some off site box) that the package would not be scanned until the knife got to the Main Dist. Ctr for HIS area.Many ( 6-10) Local Post Offices often feed into a main Dist. Ctr 25-100 miles away. I had this exact thing happen about a year ago on this very site. I shipped a knife from drop box, and a Zaan got lost for 17 days before showing up at the Dist. Ctr in Denver Co. I called everyday to My Dist. Ctr ( Charlotte NC ), And the Buyers Dist. Ctr. ( Denver Co.) So This DOES not make the seller a crook. BF says that no deal is over till both sides are happy. You are not. I would suggest you contact the USPS Dist. Ctr in your area . When a package is shipped, even though someone at home created a LABEL and pays fee, only when the label is scanned does it become a package, activated. THIS IS WHY IF YOU SHIP YOU SHOULD ALWAYS TAKE PACKAGE AND GET SCAN RECEIPT FROM POST OFFICE. All you got is a NON -Activated Label. I am sorry if this rambles, it is just complicated. 99.99 % of the time things go well, but every time without the actual scan receipt deals are at risk. It just shows how lucky or good the USPS is. In the future always seek the scan report, via phone photo, email etc. it is very simple. Seller has at least 4 positive sells, ( BF archives cut me off at 11/14/2014 ) . I hope you get made whole and am very sorry. It happens to the best of them as they say, and it will get settled for sure. This is the best site anywhere. Following guidelines just makes it easier and would have solved your situation. Hope this helps, as I do not want to see anyone unhappy in the exchange.
 
Why do people keep gifting to folks they don't know? Not to mention, it not the right thing to do when using PP services.
How many times has this been discussed here?

So you send this guy money as a gift and plan to report a fraudulent sale to who? What sale, you gifted him money and he was to gift you a knife. If he decided not to gift said knife it is not a crime.

So much for the Paypal gift saga, the cheap comes out expensive.

But the seller is a POS for not delivering..............

Send the seller a link to this thread. In all fairness, this issue is always preventable by doing things the right way. I've lost much sympathy for people that insist on saving $3-$6 as well as for sellers that insist on offering the buyer to cover fees that do not apply to them. The ability to protect yourself from exactly this being thrown out is by definition carelessness. For me, my trust in other people doing things right begins with me doing the right thing on my end.

Let's see what the Exchange rules state on this:
Warning: You as a buyer are responsible for using Paypal as it was intended, according to their Terms of Service. Using the "Gift" option revokes any buyer protection you may have if something goes wrong and makes it easier to get scammed. Be smart and protect yourself, if you use gift and get scammed don't come crying to us about it as you've already been advised.
 
If the seller does not want to pay the PayPal fees that apply to them....then they should not use PayPal...period

I am at this same point.
I think there must be some ideal out there that being a member of BF and doing deals on here means that gifting money, to someone that is a name on a forum, is OK cause the GBU 'pressure' and the moderators will save your ass....
(I am just speaking in general about a lot of these threads in here, not necessarily this one)

It's not this Forums job to protect members from themselves. If you leave yourself open to fraud, it will happen to you.
There is no way to stop or control fraud, mis-described items, or anything on the exchange. All we have is feedback, trust, and PayPal.
And out of those three, PayPal is your best protection. Use it.

If you want to 'gift' someone a bunch of cash, then realize that you have also surrendered any options you have should that item be mis-represented or just not show up at all.
 
If you used your credit card to pay thru Paypal you can get your money back thru the credit card company. In certain circumstances some banks will refund a withdrawal if you can prove fraud.
