Question on blade length measuring.

If you think you know the answer why are you asking ? If you are "caught" with the knife in question and the officer measures from the handle and arrested you , you will spend at very least a few hours in custody and you will have to fight the charges at a later court date. At that time you will definitely want a lawyer and not a court appointed one unless you plan on losing. Also if you are arrested for some other crime (wilfully or mistakenly committed) your knife can be then considered a weapon and those charges added to the others and at that point the dimensions of the "weapon" in question don't matter anymore. Just take the advice of others and measure from the front of the handle, or spend a indeterminate portion of your life trying to argue knife terminology in court.
Not sure why you typed this. If I thought I knew the answer I wouldn't be asking for case law examples and literature written by legal professionals who have experience in the subject.

It's yourself and others to keep bringing up what a random cop will do. Also your example of if you are arrested for some other crime or the crime of using the knife the dimensions won't matter is also not true. The case that I posted above is an example where different blade lengths affect the sentence given.

So the plan is to carry something longer than the legal limit and if stopped and searched to cite case law. Brilliant!

I cannot see any scenario where that could go badly wrong.
Nothing you post is helpful or salient.

dont expect case law to keep you from getting arrested or out of jail. doesnt work that way. if you think it does you really have no idear how it all works.

showing police case law won't make a bit of difference. they are allowed to arrest you and let the prosecutor sort out the details with your lawyer. this is how it works in every single state. good luck though.

Not expecting it too. Not sure why you think that based off what you have read here.

Who said anything about showing police case law? I swear a few of you are either not reading prior posts or just making things up while also being condescending as can be. Keep that in your regular whine and cheese sub forum posting.

This thread was about opinions you have based off of specific case law as stated in OP. If you don't want to participate in doing that you are not required to be here.

Please stick to whine and cheese bud. Looking for serious replies only. This is not helpful, just like your previous post.

Noone is "showing case law to police", and your rude reply saying "you have no idea how it works" wasn't needed. Perhaps your long time here on the forum has made you a bit too comfortable and led you to believe post count = post quality.

If Freddie Gray had lived long enough, his case would have most likely been thrown out of court.

Nope. My thread is about actual case law with relevant examples, and how the courts/judges have interpreted this law.

What a random cop who is not a lawyer and and doesn't make any type of ruling on the law is not of my concern here.
Well, if you insist on worrying to excess, raise your blood pressure to catastrophic levels and risk soiling your undies and trousers over a hypothetical scenario that has a slim-to-none chance of happening, your answer will be found at your nearest Home Depot. Milwaukee Tools offers three styles of folding knives with blade lengths between 2.5 inches and 3 inches, well within most legal limits. They are press-and-flip lockblade models that are lightweight and hold a good edge. They have pocket clips if that is important to you and are priced around $17 or so. Good quality bargain. Quit worrying before you take a heart attack and completely ruin your health. Not worth it!

Undies already soiled. And thanks for the rec.

K killgar gave you the best answer you are going to get here. Most LEOs wouldn't know the difference between "to the plunge line" and "to the handle" and are going to make their decision, (in the field), based upon their best estimate of the length, what they remember about the law, whether they saw a pocket clip, whether the individual is acting like a dick and whether said individual tries to browbeat them with their notion and interpretation of the law.

In the end, with the wrong attitude you might be lucky to only have the knife confiscated if you are not pushing their buttons too hard...or, alternatively, if you are, sitting in a lockup for a while waiting for counsel to arrive.

Choose your battles wisely. Even active and former LEOs are reluctant to poke the bear when out of their own jurisdiction.

Jurisprudence.

Try to be prudent. Err on the side of safety.
