Rick Hinderer sent Cease and Desist to Youtuber for saying the steel was soft in his knife?

Actually, it has everything to do with it. Preposterous claims that aren't believable deserve a little hyperbole in response, wouldn't to you agree?

I get it and I have done it myself. I agree with you on a lot of stuff, even in this thread. I just don't agree here. The truth is the truth. I don't believe we get closer to the truth by responding to distortions/exaggerations of truth with distortions in the other direction.

I mean, "truth" hasn't been in this thread this entire time, so it is what it is. That said, we can agree to disagree, I think.

Would the youtuber have been able to detect a slightly low heat treat just by using the knife and without scientific testing? Pretty unlikely. That being said, Hinderer has done themselves no favors with the lawsuit. I'd never heard of this guy or any of this and now because of this the dude and the entire mess get free publicity. Just send the man a knife you know is within stated specs and consider that as "100% warranty fulfillment", drop the case and hopefully it goes away before you've drawn any more attention to it. Just my opinion.

Rick, if you're listening just drop the legal end and send the guy one you know is in spec and say you cheerfully fulfilled the company warranty against any defects. Then ignore him from here on. You're a well respected maker, he's..on You Tube.

$15,000? I’ll bet he takes a nice little vacation and then comes back with some sob story about falling on hard times. Surprisingly, he’s raised $2,400 already. So the plane tickets are paid for.
 
Technically, not true.

Even if Kim retracts the disputed statements and promises never to make them again, Hinderer could still sue for any monetary damages arising prior to Kim's agreement to do so.

Hinderer is unlikely to take such an action if Kim will agree to "cease & desist" since what Hinderer mainly wants is to get Kim to stop "talking trash" about him & his knives; notwithstanding the fact that such damages are difficult to prove.

However, if KIm agrees to do as Hinderer asks AND if a bar and/or waiver from suit is included in a settlement agreement (as his lawyer should insist upon) THEN there would be "no room for Hinderer to demand money" based on Kim's disputed actions, as long as Kim abides by the agreement.
Not sure whether you read the letter in the first post of this thread but I was poking fun at the fact that the letter says RHK would be made whole if Kim consented to three specific items of purely injunctive relief with no money damages.

Cease and desist letters get sent out all the time. It’s part and parcel for running a business. Singers send them out all the time when they don’t like someone playing their song.. and McDonald’s sends them out if anyone names a burger remotely close to something on their menu. The fact that TK is acting like the sky is falling as he digs in for some huge legal battle is hilarious.

I don't have a dog in this fight, but if the flipper tab was ground off the blade, why wouldn't Hinderer be under the assumption that the HT wasn't effected?

I mean, didn't he just say he wants an apology? Listen, if I'm being threatened with a lawsuit, and they send me a multi-page letter spelling out all the things I'd said (with provided links to where I'd said them), and then it said "Just apologize and stop saying this stuff", I'm going to post up an apology, and move on. Simple as that. It's not like I'd actually mean it. Everyone knows that when I said "I'm sorry", I was saying "I'm sorry that I don't care enough about this to get sued into oblivion because I made a big deal over nothing".

I think at this point, it's about TK not wanting to lose face with his social media fanbase.

Hinderer sent him a cease and desist letter that TK made public… so it’s a little hard to sue someone for defamation of character for a cease and desist letter HE made public. That’s like me sending a PM to someone calling them a low-rent nincompoop that can’t make a knife to save their life, them posting it on social media, and screaming about how I slandered their good name.

I think a lot of people are getting taken for a ride on GoFundMe. You’ll see.

He wants an apology and he wants TK to remove all posts and videos referring to the *allegedly* soft blade, but as someone mentioned earlier, that doesn't preclude Hinderer from suing. Also, I'm pretty sure that TK believes he is in the right and he's apparently not interested in apologizing for something he had every right to say.

Okay, then he can dig in and prepare to go to court over it and we will see how it goes.

You can sue anyone for anything. You know this. I guess you gotta do what your bank account can handle, but if he loses this, I don’t think $15K is going to cover it.
