I've had similar events happen before. I was cut (very minor) by a guy - which prompted the fight or flight...and I fought. Luckily I won, but that's mostly because he was either drunk or high.
It was a sloppy fight.
Happened another time since I started training in various martial arts. The officer yelled at me for breaking the guys wrist and some other stuff because it made more paperwork for him (NYC)
In my state using a knife in your situation would be a double edged sword (no pun) intended. If it were me in your shoes and I did the same thing legally speaking he could technically sue me and depending on the lawyer/jury he could win due to him not having a weapon and you using deadly force.
It sucks that here you have to wait for the attacker to raise the level of force beyond empty hand, but at least you're allowed to go for the gusto once he does, you don't have to match it.
