here is what happened. i used a buy it now option for a spyderco violet salsa. a few days go buy and i ask for the carrier and when i should expect it. this is the response i get.

It appears that this package was returned to us. The shipping label was torn off. Thank God not completely. We where not sure who's it was. Now that I know I will reship by U.S Mail with tracking number. That should go out this after noon and I will get you the tracking # as soon as I have it. now i don't care how big of a knife site that you are, i dont think this is something that is flying off the shelves every day. the logical thing to do is open up the box and look at what knife it is, even if it didnt have a paypal invoice inside the box i think you could figure out who you had sold this particular knife to and put a new label on it. regardless of all of that, i replied ok fine or something along those lines. so a few days go by and then i get this in en email.

now i am a little pissed but i got a full refund so i really cant complain too much. it sounds very suspicious that the box that was returned had just my name torn off the label, thankfully the return address wasnt:jerkit:, but now all of a sudden she decided to open the box up and low and behold the knife is damaged....sounds like BS but whatever. well the reason i am writing this is the same damn knife ( i am guessing it is the same one, i know i am going out on a limb for a Violet salsa, but i think the branch is strong enough to support me on this one) is up for auction on ebay with the starting bid price the same as the buy it now option that i had bought it for. it just pisses me off and i wanted to vent. thanks for listening/reading.
 
Sounds like BS to me too. How convenient. Now they're selling a "good" one on eBay? Trying to get some extra buckwheats, it looks like.

This is not the same knife. We canceled the listing, we did not sell 6 pieces(I wish Ebay is not that good). I know this seems crazy to you. Trust me we did not do anything to deceive anyone. We got this piece in late yesturday. If you would like I will charge you my price $41.95 with free Shipping & Handling to make this right for you, package it up this evening and send you the tracking number. I should have contacted you when it came in. I refunded you your money because at the time they where back ordered and I did not know when I was going to receive them. JFC, I know jumping to conclusions is the favorite pastime here but this is almost too friggin absurd for words. eBayer respsonds to your communications, gives you a full refund, and still you slam them here before giving them a chance to sort things out when something arouses your suspicions. :rolleyes:

hey paul...thats why...i thought i wrote it pretty clearly. as far as half cocked...you are going to tell me if you bought a kiwi with a BIN option...then they gave you the story of the label tearing off and they had no idea where it was supposed to go...so they were just waiting for the customer to contact them to complain...then they tell you..oh you are the customer...ok we will ship it out to you ...but then a few days later they say umm no we finally opened up the box and its damaged so you will get a refund (which is were i said fine, and i cant complain) but then a few days later the knife, or a duplicate is back on ebay but now the buy it now price is the starting bid price...you tell me you would be happy with that situation? seriously you see no problem at all with that? only after contacting ebay did i get an answer from them.
 
I think it's a fair caution/warning, I want to avoid monkey business just as much as out right wrongdoing.
 
The thing is, it probably would have been better to send them that last email before you posted here. If you had, everything would have worked out and you wouldn't have felt compelled to post negative feedback here.

Anyway, people will get to see how the whole thing was dealt with and will be able to make up their own minds about how it was handled by both sides.

i had emailed them in the morning about the situation, then i contacted ebay, then i got their reply. i guess i could have waited a day but i was pissed at the situation and stated the facts here.

After reading this thread, I wouldn't do business with you. You don't even give the seller a chance to reply before slamming them on a public forum and filing a complaint with Ebay. The worst though was posting their private emails to you. They're obviously trying to make it right, and you thank them by posting their price of the knife. Nice.

Nope, that's just your read on what they said - I'd have assumed that the knife had JUST been returned to them by the carrier and they had not had the opportunity to sort things out before your email arrived.

Well, in your original post you said you did get the refund, so again, by eBay standards, no blood, no foul here. I learned quite early in my "eBay experience" that eBay's standards allow seller's a much greater timeframe for completing transactions than what those on the forums expect when dealing with other "knifenuts" and that while there is virtually no acceptable reason for a buyer failing to pay, all that really is expected of the seller is that they either ship within 30 days or provide a refund. Different venues, different rules.

Happy no, but I'd have communicated with the seller, and given them a reasonable opportunity to respond before slamming them here. Which is exactly what I did when a somewhat similar situation occured with a Kiwi I bought on eBay a year or so back.

Based on your other statements, I suspect that the timeframe between your email to them, and your complaint to eBay was short. I also suspect, given eBay's generally lackluster performance when it comes to dealing with complaints against power seller's, that your assumption that the complaint, rather than your email to them, was the reason they offered you the knife at the BIN price, may very well be incorrect.

On eBay, perhaps more than most places, never attribute to malice what can readily be attibuted to coincidence, a room temperature IQ, laziness, or the seller being someone who's holding down three minimum wage jobs and doing eBay in their "spare" time to make ends meet.

Sometimes these things happen. I saw a site that had a knife I really wanted (they only had one) about 1 week ago and emailed them to say I would take it (they have no shopping cart). No answer after one day. Knife still for sale. Sent a second email, no answer after one day. On the third day, knife is now sold. No reply to either email after one week. This is just after I had spent $800 US on something else from them. I won't be mentioning their name in public though.

I think they were either waiting for you to put in a bid or hit the buy it now button. They have rules where if they have something up for auction, you have to through the process of bidding. If they have a buy it now option and if you want it for that price, that's your option. Merchants on ebay cannot sell anything listed privately but have to sell it through ebay.

I don't think Irezumi was referring to Ebay in that case.
 
for the record the first time i used the BIN option the knife was not listed up for auction, it was in their ebay store. i just got a no payment notice from ebay and paypal for the money he returned to me, i am guessing because i left him bad feedback. i could have handled this differently but what is done is done and i guess i need to be more patient in the future. :foot:
 
My recommendation would be to wait to post until you have gotten over being angry. When we are angry, we tend to do things we wouldn't normally do.

We do need a cooling off period. We have a tendency to want what we want and to want it now. Some of the e businesses are so quick and so dependable that we get spoiled by the high level of service.

It took one knife dealer 10 days just to acknowledge that I won the knife. He replied on 7/28/07 but I have yet to see anything else. I got over it although I would obviously never recommend this outfit. During this time, I have bought three more knives online from another place without problems. So, it probably cost them three sales.

Eventually, shoddy business practices will catch up, and hopefully, they kept their day jobs.

Yep you are correct mate. The first time I bought something off them I got something very nice and rare at a great price. Only 20 people had viewed the auction so I grabbed. Unfortunately, the second item wasnt on ebay, only on their site, and they dont have a shopping cart so could only email them.

Sometimes, to avoid paying the sellers fee, a merchant will send a no payment notice to the buyer when he makes a refund. I got one when a merchant refunded my payment because the item's discription did not match the item they were selling. It did not go against me as a no payment in feedback score. Ask the seller if this is what he did although I got an email explaining the situation before I got the no payment notice and he should have given you the same coutesy.
I have always been treated well by merchants on ebay. A package got stuck in customs once and a couple of times they sent the wrong item but the problems were always solved quickly and in my favor. I got a some free stuff that way:D
I'm not an expert but I found out a few things about buying from ebay. 1. Ask questions such as how the item will be shipped especially if they only discribe it as standard shipping or if you don't live on the conus. Clarify if the items discription does not match the picture of the item they are selling. Always inquire about stock availability if they ask you to inquire before you order. 2. Promptly inform the merchant if the there is a problem with your shipment such as damage, wrong item, or missing parts. 3. Be couteous with initial communications. There is a saying you can catch more flies with honey than with vinegar. 4. Be patient. Many merchants sell on ebay as a part time business. Give them at least 24-48 hours to answer your emails.
 
sorry tonydahose; I should have added do not buy from merchants with feedback scores less than 99%, especially if they have more than 100 feedbacks. 98.9% is way too low for a merchant with over 500 feedbacks. I avoid those with feedback scores less than 99.5% unless they have less than 100 feedbacks and the buyer was unreasonable.
