IMO PayPal missed the boat on this one since the item was tracked to the recipient. You might seriously look into action against them. Good luck.

This is exactly what you should do. Sue Paypal in small claims court.

When Paypal set up this dispute thing, they essentially established themselves as a private court system with their low-wage employees as unappealable judge, jury, and jailer.

In fact, given Paypal's size, you're probably not the only person with such an obvious case. A class-action suit might even be possible.

My guess is that somewhere in the fine print of the Paypal user agreement that you click a box saying you'd read and agreed to is some clause that says that you agree to be bound by the paypal dispute process yada yada yada. But, it is well-established in the US that you can not sign away, much less click away, your right to sue someone in a court of law. The authority of the legal court system can not be taken away by a private contract nor can a private contract restrict the courts.
 
Someone claiming to be this person has sent us emails stating that they will sue BladeForums.com over this thread. Make no mistake, we make no claims to the accuracy of the matter in question, nor do we bear any responsibility for it being published in the first case. I've requested proof that they are, in fact, Stephen Harbuck. We'll see what happens.

In principle, waivers of right to sue are perfectly valid and enforceable in court, as with any contract. The devil is in the details.

I have used signiture confirmation for a long time. I've always been able to track those via the internet by entering the number on the form in 'Tracking' from the USPS web site. You cannot however track an insured package on the net. Sending it insured with signiture confirmation is not going to cover your behind in this. You will have pay pal turn their back on you every time.

If the OP got the little pink signiture confirmation form they give you with a number on it when he paid to ship them it can certainly be tracked on the net. I've done it many times and the reason I do that is because with just delivery confirmation all you get is them saying it was delivered and not necessarily to the right house. As an example I bought a BM Ares folder a few years ago the shipper said he shipped with delivery confirm and the tracking said it was delivered, yet I never saw it. A month later my mail woman shows up with it in hand opened because it was actually delivered to the same number address on the next street over from me to one of my neighbors who took it out and played with it after opening it and then never quite remembered to tape it shut and put it back in the box saying it was the wrong address. As it turned out that same neighbor also had a knife collector value book I had ordered from Amazon.com and never got that to me until then also.

Needless to say I paid a visit to this neighbor and put a stop to that nonsense right quick! Delivery confirm only proves it was delivered to someone but if you want to know who you need a signiture.

I never thought this would happen but Stephen decided to do the right thing and returned all the knives which arrived and are in my possession again. Nevertheless, he has already been reported for mail fraud and his name should be exposed for what he has done not only to me but another forumite/e-bay seller he scammed out of $250 using similar tactics. This crook is in no position to threat with lawsuits:jerkit:. He's lucky I haven't taken him to court sueing him for everything he's worth (which probably isn't much :rolleyes:)
