What should I do?

I have had two benchmade contegos now and both have had lock failures, the most recent was on Friday and it resulted in a pretty bad cut (to the bone on my finger). I have contacted benchmade and they want me to send the knife back, they said that IF the injury was at the fault of the knife they would cover the medical costs. The knife has some strange characteristics though it says M4 on the blade instead of CPM M4 like my other one. The blade tang also has several imperfections and a part of the lock face is scratched. How do I keep myself from getting screwed here?
 
I'm not sure, I doubt it because it came from blade HQ. I'm just worried that benchmade will deny responsibility.
 
Best thing to do is send them to Benchmade and they'll confirm if they're fake with them not paying your medical bill or

If you don't send them in then you don't have the chance of them paying the bill and them potentially taking the knives because they're fake.

I say send them in.
 
It's a valid concern that they may tell you it's not their product's fault. Cutting yourself due to lock failure generally involves applying pressure to something other than the cutting edge. This is commonly referred to as "misuse" since the producer isn't going to want to accept liability for something outside of a product's range of use.

As opposed to, lets say, folding it an putting it in your pocket?

So instead you stabbed a tree and the folder folded, correct?

And now you want BM to pay for the injuries sustained.
 
I have never owned a folder that could not handle sticking in wood, even my griptilian does it fine. The thing I noticed is that the lock on the contego disengages much earlier than my griptilian lock.
 
First thing is get that finger closed up.
Second, yeah, send it to BM.

I can't understand why you need to ask. They said to send it in so they can see it. If you're being truthful with us, there is no question that they'll fix it and return it as well as cover you're medical bills. Of Course if you're holding something back and you did something to abuse that knife , then if you send it in hoping to pull a fast one, their voodoo dept. will cast a spell and zombies will rise out of your yard and eat your dog. If you don't like your dog, send it in.

I don't have a dog.... But thanks for the reply I was just concerned that I'd send it in and they'd refuse to do anything about the knife.
 
Benchmade is a knife company that actually honors it's warranty. Their offer with regards to medical expenses was above and beyond. I think the M4 vs CPM M4 markings might mean a scamster got a fake one into the return food chain. Not cool. My real benchmade has never failed me and I've done that and worse. Benchmade has a strict policy concerning fakes. They WILL keep it as per their disclaimer on the warrany form. Good luck and do let us know how it turns out. I hope your injury is not serious and you get back in the saddle asap.
 
From the benchmades I have owned, I am extremely surprised that stabbing a tree made the lock fail. Depending how hard you stabbed, majority of locks could handle that. The blade markings do sound suspicious. If it turns to be a fake, I would contact BladeHQ, because if they somehow sold a clone IMO that is on them. Hope your hand is okay.
 
i have beat the shit out of my contego, no failures of any sort other than some edge rolling. i think we are missing something here, please post pics of said knife and detail description of the acts that caused the failure and detailed pics of knife damage.


edit: i just proceeded to spine whack the hell out mine all cold steel style with no failure, it induced some vertical play... that said you have either abused this knife way beyond what it should be subjected to, or its faulty...
 
OP - I see it this way. If the knife is NOT defective, it should not fold if you properly stabbed it into a tree. By "properly" I mean the axis was not accidentally pulled back (by you or some other object) and you were not using the maximum force and speed that you can possibly produce with your arm. If you did stab properly but it still folded, then likely it is a defective knife. I don't think stabbing properly with a folding knife is a misuse of it.

In either case, you have little to lose by sending it to Benchmade (well, maybe some shipping fee). If Benchmade deems the fault was on you, they'll probably just return the knife to you. I don't think they can/will sue you for using the knife improperly. If the contego is found defective, Benchmade will cover your medical bill as promised and replace it with a new contego (or maybe two).

Edit: forgot to mention the third possibility, i.e., it is a fake contego. In that case, you will lose it if sending to Benchmade. So please take that possibility into consideration.
