What should I do?

The advice here is sound.

1] post pics here to determine if the knife is a benchmade.
2] If it isn't, send to the seller for a refund.
3] If it is, send to benchmade for evaluation.

I wouldn't expect any benchmade to fail from sticking/stabbing it into a tree, they're made to handle a lot worse than that.
 
Yeah, totally not Benchmade's fault that you cut yourself when you stabbed the knife into a tree. That's funny to me that you think they are responsible. Seems like nobody these days wants to take responsibility for their own actions. I realize that people think it shouldn't have folded but come on. You use every knife as if it had no lock. If you cannot do that, you need a fixed blade for the task.
 
Benchmade tested the knife and told me that the lock did fail their testing, they have sent me a new contego and it is rock solid so far although this knife won't be used for any tasks I wouldn't use a slipjoint for. And they will be covering the bill because the knife was defective. All in all I'm pretty happy but the contego will have to earn my trust again. I must say they have excellent customer service. And no they don't have my family, I'm pretty happy with the outcome (minus the small canyon in my finger).

I understand what you're saying, but when you market a knife as a "hard use tactical folder" and sell it for $180 bucks it should handle being stuck in green wood Imho.

Sorry, but I'm calling BS...You started this thread 5 days ago, on the 16th. Since they "sent me a new contego", I'm led to believe you shipped your faulty knife. The timing doesn't add; you shipped, Benchmade tested, and Benchmade shipped all within 5 days, not counting the weekend. Possible with expedited shipping, but highly unlikely.
 
I am suspicious of this entire story as well. And where are the pictures of the defective 810 that the OP promised to show?

Ha! Thought I was the only one with Windows phone :D. Just get the Photobucket App, it's the easiest. Copy & paste the URL or just follow the instruction on photobucket. I hope your fingers are ok. Sounds like no major injury that required recon. take care.

You stated that you used a reverse grip to stab the knife into the tree. But then you stated that your finger was cut to the bone. I'm holding a folder right now in that manner and I cannot figure out how your finger was injured when your palm should have been. If.....you don't like the lock-up of your knife just send it in. No need for hyperbole.

There are two ways to hold a knife in a reverse grip: edge out, or spine out. If you hold it edge out, the edge will slice your fingers if it folds.

Why not? It's a natural movement to flip to a reverse grip and have the edge facing out. If you're not thinking when you do it, it could be very easy to stab it into a tree that way (not smart, but easy to do).
 
Out of curiosity, by what legal means does Benchmade have the right to confiscate a counterfeit knife?

They have explicitly cited that any counterfits sent to them will be tested for authentication and then destroyed if found to be fake. The info is on the Benchmade website under thier explanation of warranty and clearly stated multiple times.
