Appeals Court Panel Upholds NYC's Unconstitutional Gravity Knife Arrests – KR to Seek Review

I have the same right you do to express my opinion and that’s what makes this country wonderful.

Wrong on several counts.

You do not have the right here to insult members who don't come from your town by calling them "inbreeds" or by taking potshots at their faith.

You can do it on a street corner...not here. This is not "this country". This is Spark's forum and we are guests.

Oh, I must of hit close to home.

My sincerest apologies.

I’m not trying to insult or attack anyone. But just because I was raised in a big city doesn’t make my voice unreasonable. I have the same right you do to express my opinion and that’s what makes this country wonderful.

Yes, you have every right to express your opinion free from government censorship, but everybody else has every right to tell you that your opinion was clearly meant to insult and attack and that it does not belong in the general discussion area (or any area on the forum for that matter). This forum is privately owned, though, so don't expect to have no consequences from your openly-shared opinion.

Agreed on the use of the word constitutional. That said, folks can choose where they want to live in this great country.

Exactly. We don't get to do whatever we want. If we are bent out of shape about it, we can move to a state where we can.

I want to be able to buy fireworks. I'm my state, I cannot. If I was really bent outta shape about it, I could move.

No. It seems I was the one to hit close to your home, one where you are legally restricted in carrying basic tools, not to mention self defense items.

I apologize. You might do the same about the unnecessary insults on religion and family. You're not doing attitudes about people from your city any favors acting the way many would stereotypically expect.

I'm sorry to be so harsh, ...(NO, I AM NOT) ...but I belong to a retirement community's gun club down here in Florida... Many of the retiree members are from the East Coast and lots from NYC. They have no love for the terrible laws in NYC that are precisely designed to put everyone in jail and collect lots of unwarranted money for the city. The police method of removing supposed weapons from righteous local residents (and NYC visitors) is plain and simple harrassment and gross intimidation of the populace,...not so far removed from past and present dictatorial regimes in other leftist countries.
To what end? Are the police really reducing crime by arresting anyone with a clipped pocket-knife? Is it not possible to look at the statistical significance of these rabid laws? Is the mayor just a righteous "no-name" who is in bed with other local leftists...some of whom are Congressional bigshots?
Bring back Rudy Guiliani (or a clone) to straighten things out... Don't dignify this stuff. Get rid of the swamp-creatures.

Look, at the end of the day I come on here to buy knives and indulge on the abundance of good information. Today is a day off for me and I probably spent too much time minding other people’s opinions, which I typically avoid. I certainly won’t start posting case studies and statistics strengthening my argument, as Im fully aware that it’s not the appropriate response.

Thanks for sharing your thoughts.

No, no, and yes.

It's nice for you that you have case studies that help you justify insulting members families and religions.

All the attempts at partisan politics and insults aside I do applaud KR's efforts and I do hope they get a higher court to reconsider the Constitutionality of this law.

Now back to blaming the political party of your choice.

Mods...if I am breaking the rules, please let me know...

If you think you are, start a new post in political forum and you’ll be ite. I assume you’ve been reported but that such action was ignored. start new one, and carry on, as you choose. Don’t bother the mods if someone already told you that you are breaking them. You didn’t do anything that bad, and you apologized, so

It is not an opinion that your city's knife and gun laws suck. It is a fact. Sorry. It is also not just my "thought". The owner of BFC allows Doug to post these knife rights updates here. Care to guess what that means? You got butthurt because of the facts about where you live. You took it upon yourself to insult those who don't live where you do, out of ignorance I might add. Care to guess how many inbred heathens live in nyc? What about your organized crime problem? Or the human sex trafficking? Want to compare those issues with other cities? Don't look down your nose especially when your bed is as dirty as can be.

And with this I am done here. This thread is about a city continually showing us it is crap for this hobby. If you want to post political bull snot take it to the political arena. Just a warning though, they will be far less kind to you in there than I have been here. Maybe show them your "studies".

It's all about perception...most politicians are not dumb...they're just...politicians.

They (especially liberals) have no desire to address the real problems (gangs, drugs, violent crime, etc.). That's too hard and much of their voting base won't like the results since many of their friends and family would wind up in jail.

Instead, they pass ridiculous/do nothing laws that only law abiding citizens adhere to...that's much easier and it creates the illusion of action.

...and the mindless sheep just smile, clap, and re-elect them... :(

Right on cray.

Doug, thank you for what you do. Please don't be deterred. I trust diligence and perseverance will get us through.

And we are back to insulting members' families. Classy.

Like craytab craytab , I am outta this dumpster fire.

I find it ironic that people like you preach "tolerance" and acceptance right up until someone has an opinion that differs. Then it's time to shut them down by any means possible.

I flawed and clearly biased test isn't unconstitutional, but it is a perversion of the law. Laws and constitutional rights are different, and calling something that's a violation of law unconstitutional when it isn't is muddying already muddied waters.

I haven't read the legal submissions and the court's opinion, but this could arguably be a violation of the Equal Protection Clause. If a determination of a violation of the law is based on the arresting officer's ability (or lack thereof) to flick a knife open, then whether you're breaking the law is based largely on which officer does the flick test. That inherently denies equal protection to people charged with a violation. I know that's not the intent of the Equal Protection Clause, but it's been used in creative arguments before.

Since "a three judge panel of The United States Court of Appeals for the Second Circuit ruled in favor" it is, by definition, Constitutional.

Except that's not at all how constitutionality works. This ruling says that the panel's majority opinion is that the New York law does not violate the constitution. That can, at any time, be overruled by a higher court, up to and including the Supreme Court. Even the Supreme Court's ruling is ultimately their legal and professional opinion, as the Court can overrule itself and past decisions, without the Constitution itself having been changed. Anything that subject to the opinion of a group of people (and their biases thereof) cannot be called the "definition" of something.

Many legal scholars still argue that the Court's decision in Citizens United is unconstitutional, despite it being the binding precedent for the entire country, for the time being.

Not defending this guy but saying something sucks is most definitely an opinion. You would think facts would be an easy concept for full grown adults to wrap their head around.

I do love the tribal BS in these threads. The boogeyman’s got some real haters out there. LOL.
