Appeals Court Panel Upholds NYC's Unconstitutional Gravity Knife Arrests – KR to Seek Review

I grew up in New York and now live in New Jersey. I just make sure to not carry a knife with me if I go into NYC. For whatever reason, the liberal agenda seems to be to restrict the carry of knives. I don’t really see why as it has little to do with liberal goals and ideals. This just seems like an old law that has little to do with the current situation on the streets.

That said, I identify myself as a liberal and do not think that there should be unlimited rights to carry whatever weapon one chooses. As mentioned in the first post in this thread, there just needs to be more clarity as to what is legal and what is not.

Unfortunately, I think these kinds of lawsuits are often dismissed by the liberal judges as they are seen as coming from the same sorts that would argue of their rights to carry a machine gun on their hip through New York City. It seems that politics has become so divided and everyone thinks in absolutes. I truly wish more people would realize that all issues are not black and white, and more often than not the truth lies somewhere in the middle grey area.
 
I keep trying to explain this to people as it applies to much of what is going on in this country right now. Its doesn't matter what is "right" or "wrong" or what is Constitutional or not. They are not looking to have their minds changed nor do they seek to find the "truth " or "justice" They have an agenda and they will accomplish their goal regardless of the protests. They know exactly what the argument was . they aren't stupid . They DO NOT want people having knives. Period. It will not stop at flickable knives either.

Keep fighting the good fight, Doug. As I always suggest, how about letting people carry what they want and only prosecuting them for actually committing a crime against someone with said item? If someone is not threatening or harming another person with their knife, I don't see how it matters if it's a slip joint or an auto or whether it has a 2" blade or a 6" blade. :confused::(
 
people cant always just "move" . we have jobs and family and we cant just "cut and run" like you can Marcinek . we tend to get roots in the places we were born and raised.

and unfortunately the subject here does involve politics. as with many topics things are intertwined. and this "movement" against knives or guns or whatever is all related and being pushed down our throats by a certain political group and we all know it.

To look at New York and Kalifornia as well as England, is to see the future of the United States if these people get their way. Make no mistake, the liberal democrats are the socialists in sheeps clothing, disguising their lust for taking over in a benevolent cloak of carrying for the people and making it safe for the children.

Wow! Step away for a day or so.... Thanks to those expressing support for our efforts.

In any case, to address a few issues raised here, and bearing mind I am a wee bit busy and can't engage in a lengthy debate or discussion...

As some noted, these are posted in General to reach the widest audience. I appreciate Spark's support in this regard. We don't lock the thread because we encourage discussion. I don't have time to monitor the threads closely and can only hope that everyone treats all involved in such discussions respectfully. The Mods take a light hand, given the topics, but it is entirely possible to discuss the issues without being rude, insulting or getting too far into the political. If we focus on merits, there's still plenty to discuss.

The lawsuit is based on a constitutional Void for Vagueness claim which has enormous amounts of precedent in our favor. The key issue is that it is impossible for any knife owner or potential knife owner, as well as for retailers, to ascertain, using NYC's totally subjective "wrist flick" test, whether any knife is legal because it doesn't matter if you cannot "wrist flick" the knife open, that doesn't mean some police officer or prosecutor cannot. The court sidestepped the issue by applying an incorrect standard (past actions vs future determination) and ignoring, for all practical purposes, the key issue of vagueness.

For the gentleman who brought up legislation vs litigation, I will note that when we started down this path, the likelihood of gaining any legislative support for a solution was zero. We always prefer legidlative solutions because we are generally successful and they cost a whole lot less and usually take a lot less time. In any case, as time went on and as a result of our lawsuit and additional publicity the opportunity to try for a legislative solution emerged. We worked on that for 4 years, The last 2 years 2 different legislative solutions were passed with overwhelming majorities. The last bill passed with but a single nay vote in each house. The governor vetoed both bills. And, just to note, since it always comes up given these overwhelming passages, it's been decades since a non-budgetary veto was overridden in NY. Just the way it is.

I was reading an article in the July issue of blade magazine about a man in Scotland that was arrested last May for carrying a potato peeler and could possibly be sent to prison for four years. Beyond insane.:eek:

It’s only “unconstitutional” if the court says it is. I get that constitutionality is the argument on appeal, but who knows what the courts will ultimately decide. I wouldn’t bet much that the case gets overturned.

Meanwhile, I appreciate the update and will be sure to work around this when I travel to NYC.
