I think the "Coca -Cola", in the stylized text is the trademark.

And the bottle thing was never a trademark as far as I recall. You used to be able to get other sodas in that shape. But then again, they weren't clearish-green. Ribs were different, too.
 
Well, at least you used Coke. Examiine the Cokes. They all have a tiny circled R above the final "a." Been all over my two Spydies and can't detect any circled R or TM anywhere near or in the thumbhole.

Argument has been lost already though. Coke's bottle imparts only consumer info, the hole is a functional device from an expired utility patent.

Besides, I never asked "Where's the hole?" Some readers assumed the trademark was the missing hole, but there is "Spyderco" and the bug all over the fixed blades.

What there is not is a "spyderhole." Pretty undesireable "feature" on a FB, but pretty desireable on a folder.

Well in Spyderco's defense take a look at the spyderfly...there was no need for a hole to open the blade so they incorperated the hole in the handle design instead keeping with the theme of things...but...its also funtional in the balisong for the modified latch drop...As far as fixed blades it would be purely cosmetic to put a hole on the blade, but if they truly used it as a trademark they probably would have used it some how on the fixed blades as well, I see the true tademark to be there spider...ALL of the spyderco products have the spider on it even sheaths...
 
dear god. I got 2 pages into this discussion and had to post. This is just like the MAC/ PC thing but with sharp objects. Somebody puts an X on top of their window and the next person is going to get 10 million fanboys screaming THIEF! It's a damn circle. Both companies have a lot of products and it's IMPOSSIBLE for both companies to continue for any great period of time without coming up with similar products. This is the nature of business and it will always be so. Hey folks, I own the patent on 4 software interfaces. I know of 25+ companies that are infringing on my PATENTS. Patents not trademarks. I know you folks all have your favorite companies and I know that these companies all make great products. Just leave the legal stuff to them and decide if you think their products are worth buying on their own merits rather than who stole what from who.

If a Japanese company stole Ford Freestar's tailgate seats and put them in a car that was worth driving I'd buy it and let THEM argue over the design.

if i was harsh i apologize,,,i by no means was implying the moderators were doing anything improper,,and I am not try to cause trouble..typing sometimes comes out different than what was intended...

but i truly believe that the thread should be long gone...i am in agreement with free speech,,and you can say anything you want...but if you can't back up your free speech, then it's slander...

after 14 pages all we have proven is there is an agreement in place,,and nothing has been stolen..

to me that means the topic headline " benchmade steals" is a lie and untrue,,

its unfair to keep it up there knowing it is false...

is someone posted a topic timjmayer is a thief I would say prove it or take it down...why doesn't benchmade get the same respect?

hiding behind free speech as an excuse to post inaccurate and false statements is a stretch for me,

The hole was not stolen by Benchmade and the heading should be removed or modified.

Well there you go. It would appear that the hole is being licenced to other companies, not just custom makers.
 
I dont believe benchmade would make this mistake a second time around.at least not without some kind of agreement being in place. I believe the "Spyder Hole" as it is called was a pattened at one time and became a defacto trademark as a consequnce of no one else producing this knife.

I wonder if they Trademarked the newer "Birdseye" holes on their newer pieces.

If you are refering to the comet shaped hole on the byrd line of knives, then yes, the comet shaped hole is Trademarked.
 
Mr. Glesser gave the usual slick reply and basically said nothing, other than benchmade and them have an agreement. Is the agreement to disagree but not sue? Nobody knows but them. One thing is sure, Coke won't let Pepsi use their trademarked bottle...so where does that leave the hole? Remember if the hole is in the open market, benchmade didn't steal it either.
