Sent the man a money order for three knives.When I went to the Post Office to pick up the package there was an envelope with nothing in it.Needless to say I would not sign for it.
Now he tells me it was as much my responsability because I didn't tell him to insure the package.Offered to split the loss with me in his last e/mail.
What kind of ------- ships knives in an envelope????????
I had a bad feeling about this transaction.He has only 10 posts.What do I do now?

You already know how I feel about it. It's HIS responsibility, not yours. He owes you a full refund and an apology. Is that his forum name?

I believe the knives are his until you receive them. Chai Cutlery does ship knives in the heavy envelopes which I've received in good shape. If he'd sent the knives before getting payment and then got an empty envelope would he be willing to split the loss because your payment wasn't insured? Me thinks not. DaveAZ
 
Common sense says one should insure a package being shipped without having to be asked,just like I shouldn't have to ask if the person is going to properly package the merchandise.If the seller wants to pass along the additional expense of the insurance then that needs to be discussed before shipping.I personally would refuse to ship anything without insurance.If the person shipping doesn't insure the package,then if it gets lost,stolen or damaged,he/she is obligated to refund money out of pocket.In fact it should be mandatory that anyone selling,trading on these forums insure all packages.I shouldn't have to request someone insure a package.Its pretty stupid not to spend the extra few cents or dollars to safeguard the shipment.I guess you should ask Mr.Sylvester if he ordered a knife from a dealer and it got lost or stolen would he just accept the same line of BullS**T from the dealer that he gave you.Something tells me that he would not be satisfied with that conclusion or accept half the responsability. Just my two cents!Ralph
 
Well, this is most unfortunate. There were a few posts in the past concerning shipping preferences among partys involved in transactions. If there isn' t a mention about insurance, don' t take it for granted! It must be specified and agreed prior to closing any deal. This is by no means to take any sides here but is rather meant as a simple step to take to minimize any possible headaches. If the other party with whom I am negotiating with feels it unnecessary to get into too many details, I simply pass. Period.

Nifrand, I hope you can find a satisfactory conclusion to this mess. Are you saying it was a plain letter type envelope? Incredible!

The price of insuring a package is simply the cost of doing business...a necessary evil if you will. I NEVER, EVER, send out a package without the proper amount of insurance...and if I do, I have no one to blame but myself.

I've alway felt as though that was the unwritten rule but I guess it's not in all cases. Good luck.

Nifrand, I think if I understand the facts here correctly, you are on solid ground.I presume you have the receipt from the money order? The good part is that you refused to sign for it in the presence of a federal employee. As long as you didnt take possession of the envelope I believe he is legally obligated to return your money. I suggest that you go to your postmaster and ask if you may speak with him and ask him for advice on how to proceed. Most people dont realize how serious a crime postal fraud is and how vigorously it is prsecuted.

Please keep us posted on this.

Kind of makes me wonder WHAT was in the envelope? I, for one, would not consider shipping anything (much less one or more of my babies!) of any value without insurance. How some people live with themselves is beyond my capacity. Guess it must just be that no one else will. He should do the right thing and give you your money back and consider it a learning experience, although an expensive one. If he needs help in understanding this, he should read my signature!

I have sold about ten knives onthe forums and NEVER ship without insuring. One forumite expressly told me that it was unessesary to insure a package to him .. I insured it anyway. Come on its only $3.00 or so extra. Well worth the piece of mind. Split the cost my ass.

2. I would be the one responsible until the buyer receives the product in good condition.

3. Definitely followup with the Post Office regarding the stolen products from your mail. Their people don't play when it comes to stealing from the USPS.

Ensuring that the buyer receives the goods in the intended condition is definitely the responsiblity of the seller. This is somewhat similar to my problem with Holly Knives... see the advice forum members gave me there, as I believe it applies to your case as well. If this guy won't make you whole I'd contact the US Postal Inspectors and the Attorney General of whatever state he's from. If this doesn't get resolved I'll be glad to return the favor so many forumites did for me by sending this guy a letter requesting that he make good on his deal.

Are you saying it is the BUYERS responsibility in any way?
If so, I would not buy a knife from you.

It seems you are the only one with some doubt?

I wish Bob Sylvester would respond.

Maybe you should e-mail him and tell him about this thread?

Maybe you should post the name and address where you sent the money order?

Slightly related to this topic:

The USPS does not seem to care what happens to the mail-

I have had packages "disappear", broken into, mutilated and they don't seem to give a rodents' rear end about it.

One time I got a nice little plastic baggie in my mail box that had the smallest piece of paper in it.

Nowhere on that piece of paper was any kind of link to me - however I did recognize it as something I had mailed.

The punchline is that they "apologized" for the damage....how did they know it was my mail? Oh yeah- no refund on the postage lost due to their failure to deliver my mail as a result of their negligence.

My above reply to this thread seems quite clear. I did not state it was the buyers responsibity. I simply stated that BOTH partys involved in a transaction should have their conditions clear before agreeing to close a deal. It is also clear that I stated that I was NOT taking sides. I am simply offering some info that may help to prevent any possible headaches. Such as the one now! I don' t know where it is that I may be expressing any doubt on this matter. B. Sylvester has not yet replied, so how could anyone not involved in this matter have any doubts or otherwise. I think I just repeated my previous reply.

I always post items for sale that indicates shipping included or othwerwise. Some simply post their asking price. So that I may be sure, I would ask the selling party if shipping is included and work it out from there. That' s all.

BTW, my closing sentences that addressed Nifrand in my first reply meant if the knives were mailed in a plain letter envelope then it wasn' t too bright on B. Sylvesters part. Hope this clears it up a bit if it anyone read it differently.
