CS- love 'em, hate 'em- time to address some issues

From what I have been seeing in the tech industry, patents are granted unless someone challenges them or you get a very sharp patent clerk that has seen something like it before. They are overworked, understaffed.

Not many years ago a lawyer helped his kid get a patent for a method of swinging side to side on a swingset. It was granted before it came to light that it was a kid swinging on a swing!

In my opinion, a patents only current purpose is for big companies to beat up the little guy. If you as an individual gets a patent, do you have the money to defend it if a big company infringes?

Obviously lawyers have much more lucrative things to do than surf an arcane forum. What you see is exactly what has been happening with patents for some time. It's been published in the local paper (I mean really local) so I consider it old news - slight improvements can get their own number.

So when somebody comes up with case law - decisions from the bench handed down - I'll pay attention. Otherwise, the imitations and copying of look alikes will continue as they have been since the Sheffield cutlers took over the Bowie market in the 1830's.

It's been going on for centuries. Take the time to read up on knife history; Levine's Guide is a good place to start.
