Try telling that to the folks you need help from, Paypal. They will say it's a gift and gifts are not actionable for refunds. When you send money as a gift there is very little recourse if the receiver is a POS

Lol im not going to try I know there will be no help, it didn't even cross my mind to do that given the situation.

Y'all can call your credit card company or bank and get a charge back. Or summon him in Small Claims Court
 
No, it is a violation of PayPal's terms. If you're buying Goods, pay with the Goods option and then you have recourse in a situation like this. The Gift option is for just that. A Gift. Saving $3 for every $100 spent is not worth this kind of headache.

Time and time and time again. Maybe folks just get their rocks of screwing paypal? I actually appreciate the service they offer to buyers and sellers.
 
Like bigboy I checked his feedback and it looked good so I paid "as gift" (I know it is my lookout). It has been three days and there could be a reasonable explanation. Thought I would ask if anyone has been able to contact him.

No need to wait for you and not just your "lookout." You cooperated in his efforts to cheat PayPal and violated your contract with PayPal. As you sew . . .

Why? It was a gift. He is not entitled to anything in return.

"Tom" is entitled to jail time.
 
Gift option = your fault. Nothing you can do about it and paypal won't help you. This sucks for sure but you should have made a goods payment
 
Whilst I get that people should not use the gift option for commercial transactions (my Aussie mate will have paid fees on it as well I suspect so he is not robbing paypal as insinuated) so many of these threads see the people doing so (out of nativity generally) berated for this over and over whilst ignoring the fact that it looks like someone has sold the same item several times and gone awol. And it continues even after the affected member here acknowledges the mistake....sheesh

It is worth emphasis that using "Gift" to buy is dishonest in the hope that buyers will stop.

Paypal won't see it that way.

When you use the gift option. Nothing expected in return. It's a gift. They won't do anything. Even if you have emails from the seller offering an item in exchange for using it. It's against PP rules which gives the option to not do anything.

You can try, but doubt they will do anything.

Obviously, we don't know all there is to know. You may have some factual basis for your judgment.

Seems like, given the cooperation in cheating Paypal, the buyer's statement that is was a "gift," and PayPal's TOS, such an outcome, while it would be heartwarming, is unlikely. A more likely outcome would appear to be closing the Buyer's access to PayPal for violation of TOS.

But I await your explanation of why you believe PayPal will come to the buyer's aid. Always good to know more.

..... simply you read any number of threads here where buyers have paid via gift and explained their case with supporting documents and received assistance from Paypal. I am sure that Paypal also understand the confusion that exists for folks surrounding the issues and see it as good business to be proactive in helping and educating at the same time. I don't espouse breaching their TOS and there should be no expectation of help, however history has shown that they do sometimes choose to do so. I also point out that if *I* here use the gift option and a CC I pay the usual % on top, it is NOT free and Paypal is not denied they fee. I do that when I am in fact sending funds to friends in the US, not for shopping on the EX.

I have plenty of people on my ignore list that request payment via "gift". Anybody that does that is not a trust worthy person in my opinion and I will not do business with them. Unfortunately there are quite a few long time members with a lot of feedback on my list. :mad:
 
If some one requests Gift, I leave the thread.

If the item is something I really want, at a deal I can't pass up, and the buyer has excellent feedback, and high post count, I will buy it, but pay using goods and service, and include enough to cover the fees.


I use paypal because I often deal with people I know absolutely nothing about, but Paypal helps make buying more secure (certainly more than any insurance I purchase on knives I send.......I have seen horrible feedback about anyone ever getting the insurance collected when knife goes missing. I still buy it, but I don't trust it).



Hopefully this seller will show up, and announce he is not a thief, and not a liar, and refund monies collected twice or more for the same item.
 
I'm the third buyer--the guy who bought the sheath. I added in a couple bucks and sent regular PayPal goods. I've sent the guy PMs. Never heard back. Never got a tracking number. So he sold the same hawk and sheath twice on 11 August and has yet to ship or refund or communicate with any of us. As soon as lesshype pointed out he got paid twice he locked his thread down. If I don't hear something by tomorrow, I will be disputing the charge. Hope there's a simple mistake here, but he's been on the forum as recently as the 15th and not responded.

Unfortunately I have to say that you are wrong on certain people. When I sell goods I will give the option of add fees or gift. If the person wants to save a few bucks I give them the option. I personally still treat it like any other sale and follow through accordingly. Saying that anyone who has gift option in their sale thread isn't trust worthy is a bit much don't you think? Now if someone asks for gift and refuses to take a standard payment then I would be absolutely worried about doing business with someone like that. By no means am I condoning what the seller has done here...... Bad business for sure!!!!!
