Emerson wave patten?

Hello, I am wondering when the Emerson wave feature patten expires? I am just wondering, because when that happens will other knife companies be able to use that feature? Just wondering, because imagine like a Benchmade Griptilian or something that would be amazing.

Trademarks are shorter than pattens, they last 10 years. Pattens generally last around 20 years. But, I am unsure of the exact details about renewal etc. This must have happened for knife companies in the past, so I was wondering what happened between the knife companies?
 
He'll license the wave to the right company.

He probably won't forget to renew it either when the day comes.
 
IIRC, generally, a patent is in force for 17 yrs. Obviously, the wave pattern has been used by other folks, such as the Spyderco Endura Wave model....

They got permission, same with Zero tolerance. I was just hoping to see it more wide spread, or a variant of the wave on more knives :P Me, personally I like for training reasons, the same type of deployment options (etc.) but the wave feature in my opinion isn't wide spread enough to commit to it lol.

The Endura is carried and enjoyed by quite a few serious SWAT officers. I know one of them very well....he uses left rear pocket carry and is an 18 year Sergeant on the force, as well as weapons training officer...

Are they left handed? That is interesting way to carry the knife (that is where I carry my wallet lol)

Trademarks can be renewed over and over. You'll only see legal wave features on brands Mr. Emerson chooses to do business with.

Would you recommend the Sypyderco Endura wave as an intro to wave features? I know Endura's are very strong? I know they are very lightweight.

Once the patent expires you'll see pocket openers appear on all manner of knives. As long as they look a bit different they won't violate the trademark. You cannot protect the utility with a trademark, only the appearance.

Agreed. I don't see how a trademark can prevent someone from putting a little hook thingy on the spine, as long as it isn't identical in shape. Just like anyone can put some sort of hole in a blade to open it, even if Spyderco can defend a perfectly round hole as their trademark and put it even on fixed blades.


As far as the patent goes, design patents are 14 years, utility is 20. The Wave patent is a utility, so it dies in 2017.

Yup! And I actually think it's fitting that Emerson knives will retain that signature look. I am, however, very much looking forward to seeing knives with a variety of handle materials, blade steels and lock mechanisms get their own variation.

That's like saying it isn't a jet ski if it isn't made by Kawasaki. It might not a be a "Wave™", but everyone will know that it is a wave thingy.

"Liner Lock" also has a trademark, btw.

Yes im well aware of that. How harsh emerson will enforce legal on similar designs is what will determine this in the end on variations of his design.
