Issue regarding Paypal dispute

I recently purchased a knife from a user here that I feel was misrepresented. His email communication was great up until I received the knife and at that point he went dark. I emailed several times over a week before I filed a dispute and 24 more hours I escalated it to a claim. It's now been a month since I received the knife and about 2 weeks since the claim was closed in my favor due to the individual not responding to paypal about the claim. All middle steps were skipped such as shipping the item back and it went straight to closed. I received 1 email from this person after the claim was started that ignored my claim, my issues, requesting a return shipping address, as well as pretty much any questions I had. He refused to respond to paypal asking for his side or really anything at all.

I'm not looking for a free knife since my money was refunded. I've been given advice to just send it back and be done with it, Not send it back til I hear back from him on a return address, or call local authorities in his area to see if the knife was stolen. At some point the abandonment law here in SC will come into affect and the knife will legally become mine at which point I would just sell and donate all proceeds.

How should I proceed?

So just to be clear, he has requested you to send the knife back or you have emailed him asking for the return address? The sentence above is unclear or perhaps I am not reading it correctly.

If he asked for it back, you feel so inclined to do so, and you already have his return address, I would send it back (in the same condition that it was received) with insurance and tracking just avoid a vindictive claim upon delivery (or lack there of). Otherwise, I would send it back under the same arrangements once he responds with a return address. The type of way the claim was resolved through paypal is what determines whether you are REQUIRED to send it back. Usually, if it was closed with no opposing response from the other party, then you are not required to. Those details should be in the closure report from paypal. Good luck

At this point, you've done all you can in my opinion. If he's screwed around like this, to date, and he's refused to answer your questions, it would seem he's out a knife. Busting your hump to work with someone whose totally uncooperative isn't worth your time or effort.

If there has been no request to send the knife back, I'd not worry about it? But then again, you should have a return address on the package the knife was originally sent to you in.

This is a bit unusual with the guy having no interest in getting his property back. Has he been active on the forum at all?
As we said before-if you send it back get tracking, insurance and request it be signed for, so he can't latter claim you never sent it or it was lost in mailing.

Well for starters put the guys user name/link to the sale in here. Maybe someone will be able to chime in with more info or alternate contact info.
 
Maybe it was stolen and he is scared of giving you his current address. Or had an accident or is spending his sabbatical somewhere in the mountains without Internet.
I'd hold it for 3 months or the legal limit, whatever is longer and then sell it. Donating sounds great :-)

I once got fake Gold Coins and eBay asked me to send them back. I got refunded but since the return address was fake too the coins came back to me. They are still in my house. If they weren't worthless fakes I would have sold them too.
 
Why would you not send it back to the original address that he sent to from in the first place? I may be missing something here. If myself, the knife no longer belongs to me as I have been refunded. Have you contacted Paypal and asked them for the proper procedure? Seems like that would be an easy step... TD
 
As for the return addy, my wife threw the box away cleaning on day. Otherwise i wouldn't need the addy lol....
 
I would think the address could be retrieved from the PP invoice.

It's possible he was in some kind of accident and couldn't respond.

I'd give it some time......can't really hurt at this point, but I know you'd feel terrible if something did happen to him and he couldn't respond.
Hold onto it for a month, won't cost you anything thankfully. I wouldn't send it back till he responds one way or another.

Figure out how to send it back with signature conformation and video sealing it up and mailing it back routine. Keeping it is stealing regardless of what the law says. Law doesnt always back the right and decent/just/moral/ethical thing to do. That's cause its written by lobbyists and politicians/lawyers.

As I've made clear... I don't want to keep it regardless of what the situation is. I've already received a refund and I'm unable to reach the seller. Your absolutely incorrect on the stealing part.... I think that was a bit much as I'm attempting to do the decent/just/moral/ethical thing. If I was unethical I would have never made this thread or the other thread I made on another forum with the same inquiry. I do agree with the lobbyists politician and lawyers part though lol..... That all being said, thanks for the advice on video taping / signature confirm. I'll use it if I'm able to send it back.

that is the plan at the moment. I have no idea if something has happened to the seller whether it be to him or family/friends/personal life. I fully plan to hold it until I hear back from him with a return address. My last email after the claim was simply asking for a return address as I felt the emails from paypal were already self explanatory. My next email that will be sent will address the claim directly and in more detail again asking for an address. The only step I have whether before or after the above is to call paypal and see if they would be able to give me an authorized paypal addy... at which point I would send signature confirmed and if it's refused/sent back then I'll have to take it from there. This is a super weird one for sure.....
