Issue regarding Paypal dispute

I am super happy you got a refund.

Personally I'd return it if there is pp info or info on package. I'd feel weird holding onto it unless I had no where to ship.

Maybe try sending a letter to him at that address...

I appreciate that... im glad too. Believe me, i do feel weird having it still in my possession.

I unfortunately don't have the addy, its not on the paypal transaction either. The wife threw away the box. The addy is literally the only thing holding me up from sending it without returned communication.

Keeping it is stealing regardless of what the law says.

While I agree that the right thing to do is sending it back, if you are unable to do so and he has not returned any communication, you are not stealing it. He, by his own actions or lack thereof, has forfeited the property. If I were in your situation, I would hold on to it for another thirty days just in case he has been in an accident or otherwise unable to respond. Then either offer it up in GAW or sell it and donate the funds to a worthy charity of your choice. Either way, you are not a thief regardless of what others may insinuate.

As I've made clear... I don't want to keep it regardless of what the situation is. I've already received a refund and I'm unable to reach the seller. Your absolutely incorrect on the stealing part.... I think that was a bit much as I'm attempting to do the decent/just/moral/ethical thing. If I was unethical I would have never made this thread or the other thread I made on another forum with the same inquiry. I do agree with the lobbyists politician and lawyers part though lol..... That all being said, thanks for the advice on video taping / signature confirm. I'll use it if I'm able to send it back.

that is the plan at the moment. I have no idea if something has happened to the seller whether it be to him or family/friends/personal life. I fully plan to hold it until I hear back from him with a return address. My last email after the claim was simply asking for a return address as I felt the emails from paypal were already self explanatory. My next email that will be sent will address the claim directly and in more detail again asking for an address. The only step I have whether before or after the above is to call paypal and see if they would be able to give me an authorized paypal addy... at which point I would send signature confirmed and if it's refused/sent back then I'll have to take it from there. This is a super weird one for sure.....

I agree you have done what ya could about it just wait it out a bit but you haven't done anything shady that's for sure

I disagree on it being stealing. So be it. Even thinking of keeping it is just wrong. Sorry my high morals hit a nerve in you. Wasnt my intent but you posted so i gave you what i thought.

So what am i to do if the seller decides not to respond being that i don't have a return address? Will doing anything other than throwing it away after say 90 days make me a thief? High morals are understandable but ignorance is not..... your commenting as if at this moment i have a choice. Your post would be 100% justified if and only if the seller had sent a response and I took advantage of the fact that paypal closed and will not reopen the claim. I'm actively seeking to return the blade to him but so far either something has happened or he clearly has washed his hands of this, or just doesn't care. Unfortunately due to the little bit of comms ive had with the seller im still unable to gauge how he feels.

your taking my generic comments the wrong way, and it's likely my fault as you don't know me and how i type and talk. so i apologize. i'm talking theories based on your experience, not attacking your character. how could i? i don't even know you and have never done business with you. back on topic now i'm gonna try to focus on the actuals rather than just theories....and i'll warn ya i'm not so bright or good at this.:)......

can you get the address, phone or anything from paypal? you may have already answered this and i skipped over it.

is this a big dollar item or like 30 bucks? i realize big dollars is a relative term, but wondering if this seller just doesn't care cause it's such a small amount of money....i hadn't really considered that prior to.

regardless i guess a constant stream of emails assuming no other way to contact and waiting and holding the item until you hear back would be the best option for me anyways, if i was in your situation. i might also request paypal to make a decision of what to do to at least cover all the bases.

I also apologize for taking things the wrong way.

Just got off the phone with paypal and the young lady explained to me that due to the seller not responding to the claim and it being automatically closed in my favor that I would have to wait for email contact with a return address from him. They won't give me a paypal verified address as everything is finished on their end. In short, Paypal has already made their decision to close the case and WILL NOT re-open it.... totally different story would have taken place if he would have contacted them or me.

The value of the knife is $200+ which is what makes this so weird to me. I would be all over trying to get my knife back if something like this happened lol..... then again I would have never let this get so far as a seller. I would have already have offered a refund with a proper return shipping address well before a dispute was a thought.

thanks for the insight :)

Do you at least remember the town and state?

On the off chance the seller was seriously injured/killed in a car wreck, google the guy's name, along with town/state/any other info you have.

Local TV stations and newspapers sometimes have online sites as well mimicing their news reports.

$200
yikes.

I'd keep it for at least a year before giving up on establishing communication. And by keeping I mean holding it for the guy.
I think when you said "keeping" somebody thought it's the other kind of keeping :-D
Even then after a year it still wouldn't feel right to sell or donate it.
I might just hold it much longer. It's not that while staying at your place it eats any bread so to speak.
Remembering the guys name and location could help you to find him in LinkedIn or even Facebook and while they might not give you his home address they might be linked to an email address he's checking more frequently or accessible by one of his relatives in case he had an accident.

^ Absolutely! Every effort should be made to return this person back his rightful property...EVERY EFFORT!!! I have no doubt, that Popsickle will do the right thing!

Hopefully this will work out, & have a positive resolution.

There has been no request to send the knife back. Its me requesting a return address with no response. Sorry for the confusion.

The lack of any communication through the paypal process or after is just weird.

Man, you took care of yourself, and got your refund. You emailed him asking where to send it back, no response.

Don't stress your life over it. Certainly don't put in too much more effort than he did to fix the issues. Put the knife on the back shelf somewhere, and if he hasn't responded in a year I'd call it yours.

Best of luck, and good on you for trying to do the right thing, but I wouldn't lose any sleep over him.

Thank you for the vote of confidence. Every effort will be made. It already had a positive resolution..... that's why im not dragging his name through the mud, but someone was a bit quick to post his profile. Now to continuously try to get a hold of him and see....

I wouldn't stress to bad Pop......you have done just about all you could. Can the seller have a LITTLE responsibility here??
I wouldn't wait a year. A month is more than enough. I like the charity idea or a GAW.
I, along with everyone else here, would look forward to dealing with a gentleman like you.
Don't lose sleep over this BS you were in no way responsible for.

I just sent a long email explaining even further in depth the situation.... that im trying to return what is rightfully his and that I'm still waiting for his address. I further explained that I've already talked to paypal and that they wont give me his address or re open the case under any circumstances and if he decides to be non responsive that there will be no recourse through paypal.

I really feel ive exausted all options at this point. If this email doesn't get a response then i may have to shelve it until further notice.

Thanks you to everyone who answered my original post with advice!

At this point I would say you have, the seller MUST ALSO take some amount of responsibility and participate in the return process.

I'm sure he would if he could. Nobody would just give up on a $200 knife unless there's some emergency or it was stolen and he's hiding.
That's the reason to hold it for a while. If he'd be some super rich guy who somehow vaguely indicated "whatever" I'd also say it's the buyers after a few months. If the seller however is a normal knifenut in distress which seems more likely I'd hold on to it for him a good while longer.

None of us can speak for the seller, who to this point has not spoken for himself either. I for one hope that there is no serious issue involved. My point is simply that now Popsickle has pretty much done all HE can to rectify this situation. I see no intent on his part to do anything but the right thing (as he has ALL the way along). He should certainly not be beating himself up further over it. It is time to put the knife up on the shelf for the time being and see what, if anything, comes back from the seller. If that person is in dire straits then the resolution of the knife issue is quite possibly the least important thing to them at this point.

Thanks. I get it and agree completely.
