That is strange. Chargebacks are specifically in place for exactly that purpose. They are there to cover the buyer in cases where payment has been made and product has not been received by the purchaser, or the product is not as described and the seller won't do anything about it.

Contact your CC company again and ask about initiating a chargeback. There is no way that they should be telling you that there is nothing you can do, because the seller took the money.

It was VISA btw...I think it's pretty strange also.:confused:

Cripes, they TOOK my money out VERY fast...but the "refund" process takes what...YEARS? (If at all?)...

I'm still having a hard time understanding what the heck your credit card company is doing. There is no way that you are restricted from doing a chargeback because the seller has been already paid by Visa. 100% of chargebacks are done after the money has been paid out.
 
Daywalker, is your card a Visa debit? Debit cards are the only case I know of where you can't get your money back. If you used a credit card Visa should be able to process a reversal of funds (heaven knows that's what they do to us). Charge backs are allowable up to 6 months after a purchase is made by most major credit cards.

I dunno what's going on either, but the CC folks keep emphasizing that the money is in the hands of this seller, so nothing can be done. Cripes, I would NOT be surprised if I am talking to Customer Service person with a Microtech in their pocket!!!:eek:

No, not the fraud section...I got transferred all over the place...Dispute section, reverse charge, chargeback, etc...:mad:

GA BBB sitrep...get THIS one, now I know why this shitmen keeps doing what he does and gets away with it. The GA BBB told me today that:

" This business has never responded to the almost 500 complaints we have sent to them. "

F*ck, I realize the BBB is a NPO, and not law enforcement, but after this many complaints, isn't there a time where they say, "Okay...we gotta hand this off to the local LEO section." And I told the GA BBB that the shitmen would NOT respond to their complaints before I got this reply...

500 friggin' complaints...WTF...

Basically all the BBB does is keep records of complaints and share them with anyone who asks -- so if a potential customer asks them whether King of Swords is a reputable business they will let him know how many unresolved complaints they have on file. That doesn't scare the scammers because they get plenty of customers who don't ask about them at the BBB before they buy.

Did you get your Visa card at a local bank? I think if you go to the bank at a time when they're not too busy and talk to someone responsible (not the window teller) she's likely to get fired up and get you your chargeback. I can't imagine why the chargeback is getting held up....

"Date Ordered: Tuesday 16 December, 2008

The comments for your order are:
Your refund in the amount of $102.06 has been processed. You should see it in your account within 3-5 business days."


SO...we'll see what happens, and I will add some info that could have led to this suddenly "speedy refund"...IF it's true that is.:mad:

Few credit card issuers enforce these rules on purchases, as most credit card companies are eager to hold onto your business. But, there's always a chance that your claim could be denied, based on the above.

The limitation noted applies only to disputes about the "quality" of goods delivered, not total failure to deliver. See: http://www.ftc.gov/bcp/edu/pubs/consumer/credit/cre16.shtm

I would always take the position that the goods were never "accepted" = no limitation.

Note that the time limit is 60 days and notice must be to the CC company's designated address for such complaints.

Individual CC companies may give you more rights. Discover tries to give you less. (Discover's position is that whatever "their customer" -- the seller -- says is fact. End of discussion. No investigtion neded. That's clearly against the law, but the feds would not do anything about it under that last administration. )

I actually got my refund a few days ago!!! I am not sure if Detective Scott of the Cobb County Sheriff's Dept. had anything to do with it, but I got it awfully quick after we spoke on the phone!

Here is some helpful info for those who got ripped off by these @$$hats...it helped me, and I gotta thank some good brothers from another forum who provided me with said info:

If you are having trouble receiving a refund from King of Swords, contact Investigator Ronald Scott at the Cobb County Sheriff's Office in Marietta, GA (770-499-4652). They have been very successful at securing refunds after they go to the establishment. I was also able to contact a King of Swords Manager at eswordshipping@aol.com. (The guy's name is "AL") He was able to speed up the refund process. Best of luck to anyone else who has been ripped off by this company. You should find success using one of the above ideas. Take care.

SO...give Mr. Ronald Scott a call and get your money back if you can!!!

i need to know how i can get my money back because i order to airsoft guns on december 27 2008 i waited about 14 business days for shipping but it never came. i sent numerous email and left several calls but none were replied to. finally i got a reply stating that the money would be refunded to my moms account in 48 to 72 hours but nothing was deposited into the account. so we sent another email they said it would be sent to their accounting department but yet again nothing. it is now may 3 i keep sending email but nothing. and the bank cant do anything. so King of Swords or what ever if you dont want emails from me can you please deposit the money in to the account. my order number is 123331. if you dont fallow threw then i will send even more emails and phone calls until i get the money back that YOU STOLE!!!
