knife confiscated!

Here are some links to info on NY small claims court. You can sue for up to $3,000. I did not read this stuff carefully, but it looks like all it costs is a $6 filing fee which is refunded to you if you win the case. It looks like you can also pick up free additional info on what to do at one of the courthouses. I dunno, but IMHO your worst case scenario is $6 and your time. Best case is you get the value of the knife, cause inconvenience to Cheetah, and score a victory for justice. If you don't have the receipt for the knife, make sure you have several price quotes of some sort for the same model to prove value.

So glad you posted this, Alonzo, after the erroneous info on the money involved in filing Small Claims. The whole idea is so the average Joe can go to court without a second mortgage.

Perhaps the local police are being paid to look the other way when it comes to the club? A big charge, to be sure, but an allegation of theft of property and a bouncer impersonating a police officer are serious offenses that should have been taken seriously. I wonder if I went to the same police station with my black wife and reported that she had been assulted would the officers also consider it not serious enough to investigate? My point here is to highlight the fact that any time police start determing which crimes are worthy of their time it opens the door to speculation about their motives. I know that there are many fine police officers in this world. I have met a number of them on a personal level and they are great and conscientious.

Isn't that what district attorneys do for a living ?

ichor retorts, with a snort:

Hah!! You want to talk about motives in question, let's talk about the motives of District Attorneys. I hope no one has the naive notion that they have any direct relationship to justice (the best you can hope for is an indirect relationship).

I'm sorry about your knife... I hate those stupid authoritarity abusers that really hurt one's pride...
I hope that "Santa's" will compensate you for your loss. I'm quite sure of that since that even I got touched for your effort in recovering that knive... I almost got myself sending you one knife... Well, It's Chirstmas after all...

Merry Christmas for every body!

I just want to continue to thank you all for your concern. I am at least glad that I have found a community that can identify with my frustration. However, I have decided not to pursue this matter any further, for reasons listed previously, as well as the mere fact that chances are I would be setting myself up for further disappointment and stress if I were to present the case in front of a judge. (I always had points taken off for run-ons) I am fed up enough as it is by the non-action of the authorities that I have encountered, and I am not about to waste more time and effort just to put myself at the mercy of another! I am usually not a pessimist, otherwise I would have never went back to the club, but I am able to see past my frustrations and visualize the inevitable. I would have liked for nothing alse than to win a victory for us all, and to prove a point, but I am starting a new job, and time is money. To those that have offered me replacement knives, and reimbursement for court fees, I thank you immensely, but your support in this matter has already been enough. Just don't frequent Cheetah!

Pro, you mentioned your concern about going before a judge. In one of the documents for small claims court I came across, it looked like there was an agreement to abide by an arbitrator's decision, which may mean that the case would go to arbitration and may not even ever be seen by a real judge.

Professional,

Firstly, I really admire you for your courage, conviction and patience. But....now that you've come so far, why don't you reconsider doing the following before coming to terms with the fact that you've done everything reasonably possible:
(1) make that claim in the small claims court/tribunal
(2) write to the press

You don't have to stress yourself out and rush to do this...I'm not in the US, but I think most jurisdictions have a limitation period of a couple of years. Secondly, making a legal claim against cheetah would really leave a tangible impact on them...I've carried out due diligence on companies whilst in the M&A line, and EVERYTHING's got to be disclosed....not a good thing for cheetah.

Good luck and Merry Christmas.

Agreed. People, you have to remember that we're talking about NYC. From the cops, to the DA, to the press, to the judges, they simply have bigger fish to fry than dealing with the loss of a pocketknife, OR - if you prefer this terminology - the theft of personal property amounting to roughly $40 or less. As galling as the whole situation is, in NYC it doesn't even warrant a blip on the radar screen.

Which is why I stand by my original suggestion: stink bombs. Hmm, New Year's Eve is coming up, right? And that's a huge money-maker for any club. UNLESS there's a fetid stench in the air so bad that their customers can't stand being there and have to leave. ;)

I would also suggest small claims court. There's a chance the other party may not even show up.In that case you would most probably win.I would also try to get as much as I could in your suit. You might be able to include lost wages caused in the course of trying to get the property back.Include car fare for trips to the library and police precent. You will probably need reciets-you could stop any cab driver in NYC and offer them a buck or two and you should some.I think you would win and rememmber make him pay.;)

A dead mouse in a film canister would also be delightfully stinky. ;) This nightclub is obviously totally unreasonable. Make them pay.
