Wait...what trademark nonsense? I need to back through this thread did I miss something?

"Beer Scout Knife" is supposedly no more due to Boy Scouts of America claiming it's trademark infringement... that's what I've read. True or not I have no idea. Several people were posting this. If I recall correctly some of the people posting were folks that would know.

Wow I need to dig into that! I dont see how they are infringing on their trademark by calling it a Beer Scout (do they own the word "scout"?). If true, I consider that a BS move by the BSA.

Totally agree - I guess the first to trademark it wins.. or the company with more money and lawyers wins? NFL trade marked the words "Super Bowl". If you want to say "Super Bowl" on a broadcast you have to pay. I couldn't sell hats that had "Blade Forums" on them. I'm sure there's all sorts of legal reasons that make it okay, but personally think it's a BS move too... mainly because the knife doesn't have "Boy Scouts Knife" on it. It has Beer Scouts Knife on the shield. It's like the NFL or Blade Forums telling me I can't sell hats or shirts that said Super Forums or Blade Bowl.
 
Scout is also a verb, that cannot be trademarked:D Perhaps the answer would be to set up a Beer Scout Association to protect the rights of those looking for drinks?;)

I can't begin to understand the intricacies of your US laws which at times, appear to offer huge opportunities for legal firms ....but I'm rather sceptical about this trademarking claim a lot of people like to repeat. Why not ask this multi gender scout association if they have done this?;) I rather suspect some prissy anti drinking types took offence at seeing Beer and Scout and started to foam at the mouth accordingly...:D

Nevertheless, it's a great Banner type shield is it not m'lud?:cool::thumbsup:

I doubt there is another organization out there that has introduced the usefulness of the pocket knife to so many boys. It is sad to me that in this day of instatweets and twitterchats that a great institution like the Boy Scouts is dwindling and fading into history, and being forced to change to survive.

I’m not sure they were forced to. I think most of their clientele would have preferred that they stuck it out against the PC police. I don’t have anything against the BSA, other than taking on GEC. That was lame.

A two sided coin really. I say, lets not defend them too much. Their actions speak for themselves. Are they being "forced" to change to survive because they are dwindling and fading into history, or are they dwindling and fading into history because of some of their changes? Hard to say really.
What is obvious is that they used their clout to bully a small company into submission on a supposed trademark issue. imo
 
Regardless of opinions regarding BSA itself, one of the legal requirements to maintain a trademark is to actively defend it.

It’s a lawyer thing. Both sides made their positions known, and the arbitrating organization made a decision. No harm no foul in my book.
 
ok, i have the solution to the beer scout knife trademark nonsense.

it is now the Beer Chief knife, with only minor letter changes on shield. an homage to the most senior knife maker at GEC. and obviously a Chief is way better than a Scout so everyone will think its an upgrade and dump the lowly Beer Scout knives.

or if possible the shield could be a noble pre-European American continent indigenous persons visage done in an honorable way to emphasize the majestic martial heritage of the continent. i hear Savage Arms has a nice logo they are not using.

I'm still standing firm with Beer Hunter Knife...

This is a real thing, GEC abandoned pursuing the trademark a year ago. The Beer Scout Knife is dead, Long Live the Beer Scout Knife!!!

The British have a word they use, Lout, it means an aggressive anti-socialtype... Maybe I'll turn mine into Beer Lout Knife :D The British also use the term Lager Lout for a thuggish beer swilling skinhead to be found at football(soccer..:rolleyes:) matches:D:cool:
 
...and while on the subject of Beer Scouts and because Beer Scouts Knives always look best in their natural environment, I'm re-posting this shot, three knives, three popped caps, and three empty bottles (and only one pint glass): Golden Ale Jigged-Bone and Kona Brewing Big Wave Golden Ale; Chestnut Brown Sawcut Bone and Newcastle Brown Ale; and a Blood Red Sawcut Bone (spearpoint) with a Nikasi Dawn of the Red Ale. That was a good afternoon!

In any case the word "scout" doesnt belong to any one organisation.
We could circumvent the entire messy legal wrangle by registering our own new organisation and simply renaming it the
"Beer Checkers Outer Of The Ground Ahead"
"B'COOTGAs"...and lets face it ..No One...will want to drag the B'COOTGA's into court .
Lets trademark it,patent it, as a new word all legal and above board. Nobody can use the word with out permission and anybody who is not a member doing so will incur a small charge say 5bux.
