Sorry to hear you have to go through this and dealing with it on top of helping out your parents is just adding more stress. Not sure what decision you make but know that there are people here pulling for you.
 
As a owner of kryptoglow ZT 0560 scales I would be sad to see you close up. Family is important though so I understand completely. I feel lucky to have mine and know they really enhance the beauty of my knife. Very reasonable price too. Good luck with whatever you decide!

As to the cease order, personally i would cordally invite them to go F___ themselves as you were issued a legal TM and they dont have the endorsement of a court order, just a request. Make them spend the $$ to file for the order to prove they are serious. just my .02

Also the address they list at "200 N Dale Mabry Hwy #222" does not appear to be a real address.


Edit: Yep, this address does not exist according to Hillsborough County property appraiser's website and USPS. Don't send any correspondence to that address.
Also, Manta shows the president of the company as Michael Forte, which is also the name of a lawyer in the same town. That might explain why he's acting all litigious. Although there's also a Real Estate agent in the area with the same name as well.


Edit #2: This page shows Gary Mayo as president of the company and Michael Forte as "data processing exec". Here is some more info on Gary Mayo in Tampa FL.

Seems like any recourse would be feasible from a defense perspective. It's just a matter of wanting to fight the fight for your livelihood. I think the other guy might be hurting financially and is going after you simply because of the name, coincidentally a one letter difference. This is no different than hundreds of companies that have gone through a similar thing.
Sounds like you are ready to pack up shop though. If I were successful in this endeavor, I would not be throwing in the towel so easily. If you don't fight for your livelihood, no one else will.
 
First let me say I have purchased your products from ebay and love them.
I am sorry to hear of your troubles, I hope you can come to a decision that you can feel good about. Perhaps if you decide to let the company go maybe another person might want to take it over that doesn't mind the hassle of starting with a fight.

I would tell him to pound salt! You received the name from the Trademark office, not your problem he let it lapse! Until you get a order from a judge to stop using the name!
 
What would happen if you just ignored the letter? You do have a valid trademark issued by the appropriate Governmental agency and I would think you could walk into any Court after the other guy files and present your documents along with a motion to dismiss the suit.

I am no Lawyer, I just hate it when people (who should lose) win in Court because they have more money available to them for Court costs............
 
Fight to keep it. You might need it as extra income in the future. As hard as it is to say our parents will not be around forever. Also you might want to leave an established business for your kids.
 
One other observation, taking care of people with dementia is a hard thing to do. Emotionally, physically, and financially it can leave a single person completely drained and open the doors to severe depression and other emotional problems. I would hope you aren't trying to do it yourself.
 
I'm not a lawyer and I'm not even going to guess what a lawyer might advise. But as a Postal Service manager, I saw a number of customers come in and put on a fire and brimstone performance, they wanted this and they wanted that, and they weren't even asking politely.

I pointed out to our window clerks that people like that were always demanding something they weren't entitled to, and were trying to bully us into doing it just to get rid of them. I told them to call me, and when I walked out into the lobby, and stood right in front of them and identified myself by name and title, they decided not to scream at me, and apologized and left.

I hate scammers. :p
 
Really sorry to hear this. I like the att. Advice here to make him spend his money while holding out on spending yours. You have the documents to prove you are in the right and he isn't. You don't really need an att. To show your proof to the judge. But as alway it's better safe than sorry and seek a professional opinion.
I have a few of your scales and I love them. You are great at what you do. I'm sorry to hear about your parents. Some things just can't be fixed at the moment and the taking care of them is a full time job. I know there is not much anyone can really do to help but I hope it all works out for the best for you.

A letter from his lawyer telling you to stop, has no weight behind it at all. Until you get an order from a judge telling you to stop, he's bluffing.

Quoted for truth.

Just tell the guy to GFH and have your lawyer send a similarly threatening letter in response. Then file a complaint against them with the trademark office. If you do, in fact, have a trademark on the name then simply sue them to stop using it.

Seems to me if you do in fact own what he wants........he should have to pay you for it. I would not give it up as it seems he wants you to do.

There are quite a few lawyers in florida especially tampa who own other businesses and use their legal nonsense to play the business game. I seen my share of these types. Myself, I wouldn't give in so easily, but I also don't have the home pressures you do and so what I think doesn't really matter.

I noticed yours is for kryptoglow

I also don't see a previous (dead) registration of kryptoglow by that guy like I do for kryptaglow.
 
I have to say I really don't know much if anything about these thing's so I won't attempt to offer any legal advise but if it's just a matter of the name, as I understand from your post, is simply changing your name an option?

Could you still continue to sell your products but just call it something else? Your customers would still know it's you and you can send out e-mails informing your previous customers that you've changed your name.

I don't know, just seems a bit extreme not to mention crappy for you to have to close up shop completely because of this challenge to the name. I completely understand that fighting it might be cost prohibitive so instead of going that route maybe just change your name and stay in business? If that's an option.

Sorry if I overlooked something and this isn't an option for you. I just hate to see you close down if there are other options that would allow you to continue your business without a potentially very expensive legal battle. I know I'm looking at this from an overly simplistic point of view but that's the first thing that came to mind when I read your post.

I sincerely hope there is a solution for you other then shutting down or having to try and decide if spending all your money to try and fight this "stupidity" to stay in business would be worth it, especially with all the other challenges going on in your life right now.
