Ive seen quite a few websites shutdown last year by injunctions that took only 24 hours to get in the US because the website was involved in copyright/Trademark infringement.(torrent sites for copyright, Chinese websites selling poduct knockoffs for trademark but hosted in the US)
Assuming you can use this in your current situation you have an Ace.
I think the possibility of having his website shutdown and business closed in 24 hours seeing as you hold the trademark and he let his lapse and the loss of income that would bring to his business would ruin him.

Sell him the trademark and he pays all legal fees to boot...

No lawyer, just techie and not sure how much it helps you but its some law the big music and movie labels got passed that allows injunctions in 24 hours or maybe its 48 to shutdown a website untill the matter is resolved in the courts.

Sorry to hear about your situation. Your products are top notch and I have enjoyed on multiple occasions owning some of your scales. My prayers for you and your family. It so happens I have taken a few civil law classes at the university and if I were you I would fight him based on the information you have provided. Chances are as many have pointed out, he is bluffing or in some sort of scheme to try and profit from putting you through the ringer. Much luck to you and your efforts. Id be interested in donating to a fund to help you if it makes it that far.
