Recently I purchased a knife here in the knife exchange, from seller Pazazuzu, the sales thread is:

This knife was listed as a custom zt0620cf in m390 steel, and has a serial number of #0017, recently it was brought to my attention by another buyer and members of another fan page, that it looked off, then when I posted pictures on ZT knives fan page on facebook there was compelling evidence it was a fake. So I searched the topic fake zt0620cf in m390 steel #0017 and found this thread on this forum:

Look at the pictures of the clone, same knife/steel/serial number. I called and messaged Craig Green at ZT knives and sent pictures of the knife to him regarding this very knife and he sent me the following email.

I then confronted the seller, and had done so previously asking him to be willing to return and refund if it was shown to be a fake, not even asking him to return it yet without proof of it being fake. I have full documentation of our conversation. He stated he assumed it was fake originally, but didn't follow through on checking it out, stating he bought it as real and sold it to me as real so it must be real. Thats crazy talk, and he also stated to sell it on eBay if its fake to recoup my funds which is dishonest and cheating. He claims because he was ignorant of the fact it is a fake, selling this clone is ok without representing against the rules of this forum. His return address shows up as a strip mall across from a vacant lot, unless google maps is incorrect, which made me sketched out. Now his two latest messages to me are he's not returning anything if its fake, and I can do whatever I want with the knife because I paid already. I am sending the knife in to ZT via Craig Green for official documentation and I told him I'll go from there. Just seems real fishy with all the evidence? Now that I presented the info to him, he tells me it's now my problem. At this point, I just want a refund from this, am I in the wrong here?
 
Sounds like he was aware that it was a knock off .. And for the sake of fairness if he didn't know he still needs to refund you . As sucky as it is to pay for the return of a fake knife at the end of the day it must be done .
 
The thing that concerns me with the claim is that PayPal usually requires shipping the item in question back to the seller. Which I do not mind doing, I just don't want more dishonesty preventing me from a return, as the seller has given dishonest actions as alternatives on recouping my funds.
 
I do agree with that marko3, if it is in fact counterfeit, and I was the seller who was either in the know or not, I would refund as it is the right thing to do. Selling it in the first place knowing it was fake is thievery.

Contact paypal, they will advise you what to do. Follow their instructions exactly. Get signature confirmation for his name. Save all the postage documents including weight of package. If you do this right there is almost no risk.

This is what I will do, I have never been in this situation before, so I needed guidance on the whole process which our moderators have been so kind in helping me figure it out. I didn't want any bad blood, I just wanted my money back for a misrepresented item that is 99% fake. Thanks for weighing in!
 
Yes, I saw this post. He is welcome to file any claim until after he gets confirmation that it is fake. I purchased this off a fellow member on this forum, as I told him. Had the knife for awhile and then re-sold it here. In addition to selling a few others and buying quite a bit more than I have sold. I let him know that it was sold to me as an authentic and I sold it as I bought it. It was his discretion to investigate it further. I only said as much as pretty much anyone on these forums can.
His insistence and constant emails is what started to bother me as he was suggesting that I knew about it. Which I didn't, otherwise I would have just attempted to sell it on eBay, which could have easily been done. And as I mentioned, I buy on here more than I sell, as you can see from my positive transactions; including trading with other members. You are welcome to think what you want. It is your prerogative as a an individual. And he is also welcome to file a claim. But next time; hopefully this individual first gets definite proof by sending the knife to the manufacturer before he starts throwing out stupid claims.
 
OP, just bear in mind that if you ship the counterfeit item back to the seller who uses a bad return address and/or refuses to sign for the package, that package will be returned back to you which may cause you some issues with your PayPal claim. You must ask PP (hopefully you will get a native speaking customer service rep rather than an outsourced CS rep!) questions about their confirmation of the seller's return address but if he refuses to sign, the burden of delivery is still on you unless PP can step in for international refusal to take delivery of the said package. There are a couple of points in your post which are very, very troublesome:

1- your buyer is NOT satisfied with the purchase and no deal is a done deal till the buyer acknowledges his satisfaction with the purchase and your representation of the item's authenticity! Just because you may have been duped, it does not mean that you can plead innocence by ignorance!

2- what gives you the right or makes you think that you can knowingly sell fake items on eBay? I know that many fake, counterfeit and unauthorized items are sold on eBay but there is no such right or privilege on eBay!

My points exactly, I asked him to be open minded to return if this item is indeed a fake, asked if we could be reasonable with some sort of solution, and when he responded via private message he told me I was welcome to sell via eBay to recoup. All this has been shown to our moderator, and is he aware of everything that was said or what has transpired. Based on the evidence I have seen, heard, and have received, this item could be fake as the seller even stated via private message. When I presented the email to him, he basically told me its my problem now. I feel that this has transpired in bad taste and I have only asked from the beginning for cooperation, and the seller says I'm not entitled to any form of return, fake or not. That's not acceptable.

Nope. He should file a claim immediately and send it back to you. If he sends it to zt he will not get it back and will not be able to file a claim.

I think you will find that on this forum the seller is responsible to know the goods they are selling are legit. Paypal will see it the same way. Further, your willingness to pass on a fake elsewhere is more than troubling. You are going to make a bunch of do not deal with lists just based on that alone, justifiably so.

He clearly does not understand how these things work. Can you provide evidence that he said he thought it was a fake? Knowing this will help fellow members decide if he is worthy of doing business with in the future.
