Hi people! I just made a mistake buying a sword. I paid with Skrill and my account is restricted now. They wait that me to explain the transaction. I paid $1,850.00 I tried to make a chargeback, and now I must wait until Skrill contact the receiver of funds, and to see what he will say. Skrill don`t agree with any kind of weapon transaction. I can recover the money ? Please help !

I have never heard of Skrill. You would get better information from them, perhaps go to their website and read their rules.

Skrill ( Moneybookers ) . Is like Paypal. Both are accepted on eBay like payment processor.
About weapons : It is strictly forbidden to send or receive payments as consideration for the sale or supply of: Weapons (including without limitation, knives, guns, firearms or ammunition).
What chances are to get my money back ?? And how to do that ?? Please help !

Another stupid problem on their TOS ( I dont know if I can put the original link on the Skrill webpage, so I will copy - paste ) : If Customer violates the Acceptable Use Policy, then in addition to the above actions Customer will be liable to Skrill for the amount of Skrill’s damages caused by such violation of the Acceptable Use Policy. Customer hereby acknowledges and agrees that Two Thousand Five Hundred Dollars ($2,500.00) per violation of the Acceptable Use Policy is presently a reasonable minimum estimate of Skrill’s actual damages considering all currently existing circumstances, including the relationship of the sum to the range of harm to Skrill that reasonably could be anticipated because, due to the nature of the violations of the Acceptable Use Policy, actual damages would be impractical or extremely difficult to calculate. Skrill may deduct such damages directly from any existing Stored Value Balance in the offending Skrill Account or any other Account controlled by Customer.

Unlike PayPal which is a tool for business and commercial, Skrill appears to be commerce oriented. The buyer has to buy from a Skrill accepted business.

I am not clear what your mistake was? Did you not intend to buy the sword? They are clear in their TOS that certain items don't qualify for their Acceptable Use Policy.

If that's the case I think the seller has the obligation to sell according to the rules.

PayPal does have similar rules regarding disputes and may hold funds till there is a resolution.

EyeDog , thank you for the answer. My mistake ? I don`t read the TOS before to proced with the payment. And there ( they are very smart ) , is wrote : It is strictly forbidden to send or receive payments as consideration for the sale or supply of: Weapons (including without limitation, knives, guns, firearms or ammunition).

In this condition, the sender`s broke the rules , the receiver`s broke the rules. No ?

Also , another smart move : Customer hereby acknowledges and agrees that Two Thousand Five Hundred Dollars ($2,500.00) per violation of the Acceptable Use Policy.

Esav Benyamin , you told me that I no chance to get the money back ? Also, by their rules, chances to pay damages of $ 2,500 are real? From what I understand, if break their rules, you lose the money located in the account and you have to pay damages no? Or in my complaint, to say that I tried to buy something else and not what I wanted to actually buy?

Well. Ed, thanks to you I read all the rules and terms of Skrill and I wouldn't touch them with a 20 foot pole much less a 10 foot version. They are obviously a profit oriented group who takes care of themselves first, last and always.

Again thanks!

Paul

Thank you sheathmaker , Esav Benyamin because of your response. I made a complaint to Skrill I paid for a product that my account has been blocked. The response I received from Skrill?

" Please give us a detailed explanation for the purpose of your Send Money transactions and your relationship with the private account holders you are exchanging money with"

Now if I say that I intended to buy a sword, they'll send me directly : "It is strictly forbidden to send payments as consideration for the sale or supply of: Weapons (including without limitation, knives, guns, firearms or ammunition). "

So permanently blocked account! And goodbye to $ 1,850
I think will not to see the following phrase "will retain the $ 1850 and must still send us $ 2,500 as damages":eek::eek:

Has anyone gone through a similar experience?

is the sword a decorative art piece, historical display, or a functional sword? That may make the difference. If it's a wall hanger for looks and would break at the first use, then you could try (probably unsuccessfully) to argue that you thought you were buying art. If it's a functional sword... you're probably screwed. If you had another payment method available, you would have a hard time explaining how you "accidentally" put the money into the wrong account and paid with the wrong account.

Good luck. You're going to need it.

What exactly does this have to do with bladeforums.com or its members?

I ask this because it has to do with what I wanted to buy (swords, knives, etc.). If I go and ask on a forum where someone said they wanted to buy a pencil and not received, what helped me? I did not want to upset anyone, but I thought that people with such experience in selling / buying these types of products can give an answer and realistic advice.

It is a functional sword. Katana custom made , in 2014. But dont metter that, because at Skrill , is not like on Paypal ( to accept one of them and reject anothers) . Skrill just say : Weapons (including without limitation, knives, guns, firearms or ammunition).

Money and law, tightly intertwined, got to read all the rules, all the Terms of Service. Can't blame even the greediest business if we don't take the time to read the rules and protect our own interests. They sure protect theirs.

Initiate a chargeback.
