I did. He didn't say how he paid. If it's with a credit card there are protections in place that might apply. This issue has nothing to do with this forum anyway. He needs to deal with the merchant site.

Nope. Member joined today about this problem that has nothing to with BFC.

I ask this because it has to do with what I wanted to buy (swords, knives, etc.). If I go and ask on a forum where someone said they wanted to buy a pencil and not received, what helped me? I did not want to upset anyone, but I thought that people with such experience in selling / buying these types of products can give an answer and realistic advice.

Your question was answered by Esav above. Why this is the clearing house for all knife deals gone bad I don't understand. No members or dealers were involved and it looks to be the fault of the private parties involved for not knowing the rules of their payment method. Sorry, there is not a lot that can be done here.

Fanglekai , you're right. The bank will contact Skrill for explanations. The reason for why I ask "chargeback", the bank will have to say "I wanted to buy a sword." And then a possible loss of $ 1,850, I wake with $ 2500 loss. What was the deal? That leads me directly to the bank and ask a refund. I do not want to lose another $ 650
For sure, if I ask for refund, Skrill will not leave easily, especially as we have violated terms of use.

craytab , you're mad at me. You're wrong. We are all humans and we make mistakes. At least once in life, each of us wrong, and learn from mistakes, right? Maybe if you were in my situation, to see that $ 1,850 are stuck, and compensation of $ 2,500 knocking on the door, you could understand me.
 
Not to be misunderstandings, and without anyone be mad at me, I'll rephrase:
I found on Craigslist, a sword Satsuma Koshirae, replica of Katana used by Satsuma army During the 1870s ( He is model of Katsumoto in movie "LAST SAMURAI".)
I talked to the seller by email to do this transaction. He said that the price is $ 1,850.
He wanted to put it up for sale on Ebay and I will add $ 185 for eBay, $ 60 for Paypal. Total $ 2,095
I saw that eBay recommends payment by Paypal and Skrill. Skrill not charge transfer. I created the account with them.
How are accustomed to Paypal, I wrote in message more about the sword. I transferred the money and 2 days after the transfer, I received email from Skrill they are announced must explain this transfer.
As long as I wrote in the original message when I transferred the money (Satsuma Koshirae sword, real sword etc), now I think I can`t deny that I wanted to buy a set of glasses. Until explain this deal, I can not use the account to deposit or transfer money. When I realized that I did not read the terms of use of the site Skrill, I was go to read them . Then I realized that Skrill do not accept weapons (no guns, knives, swords, axes, bullets). In addition, I read completely stupid rule: If Customer violates the Acceptable Use Policy, then in addition to the above actions Customer will be liable to Skrill for the amount of Skrill’s damages caused by such violation of the Acceptable Use Policy. Customer hereby acknowledges and agrees that Two Thousand Five Hundred Dollars ($2,500.00) per violation of the Acceptable Use Policy is presently a reasonable minimum estimate of Skrill’s actual damages considering all currently existing circumstances.

My questions are: Can I recover $ 1,850 already transferred? If "yes", how? What can I do to not risk to lose another $ 2,500 penalty because I have broken their rules?
If you were in my position, you would settle for a loss of $ 1,850 given that I was so stupid to not read some rules before to break them, or you riskier another $ 2,500 to struggle with bank and Skrill?

You purchased it STRICTLY as a piece of cinematic history, and if need be you can get the lawyers involved". It's a lie, but it may help.

Wow..totally bogus if you ask me. I bitch over $300, If I lost-or was threatened with losing- $2k i'd likely go through the roof. Ok, Try telling them to just cancel the stupid thing and refund your money, or else you'll get the lawyers in it. nothing was actually shipped yet, so therefore, "no violation" has really occurred. What's ridiculous is paypal won't cover weapons, yet Ebay is FULL of weapons, lol, they're just finding a liability loophole to Cover Their Asses.

It was or not delivered , intent matters. And do not think that will be so easily intimidated by lawyers.

I am in no way mad at you. That would make no sense. I really don't care about the particulars of your situation. First, it looks like you screwed yourself and are now asking us to help you. My advice to you would be to not get yourself in such a strange circumstance in the first place. It is only after someone gets screwed because of their own fault that they Join up and post here. Makes no sense.

Second, this deal didn't occur here. It is difficult to tell where this transaction took place and how payment was made. Craiglist? Skrill? Ebay? What does this have to do with BFC or any of its members?

All of your questions were answered earlier. Deal with ebay, skrill, craigslist, your bank, or even the seller you bought from. Not munch else can be said.

That cannot be read to exclude the purchase of all knives and swords, only those that are, for some reason, illegal. I would simply request that your money be returned because the transaction has been mutually canceled. If they attempt to keep your money, I'd pursue it through your credit card company (if that's what you used), or through the government agency in your state that regulates their business.

I don't want to pile on here but your question kind of goes beyond knife advice.
There's lots of experts here but most of us had never heard of Skrill before you joined so we're not going to be much help there.

Now, how to care for or sharpen it, what kind of steel it may be etc., that's what we're good at.
The only real advice you can get here has already been given and beyond that would be suggesting that you lie which is never a good thing.

Unless you can convince Skrill that you didn't realize all of the implications and would like to cancel the transaction now that you do know. Sometimes speaking directly to another human being can fix problems much better than a whole bucket full of lies and excuses.

We don't know whose law applies. I suspect it is the law of the State of New York where Skrill is located. I also suspect nbumwa is not even in the US.
 
Skrill ( Moneybookers ) . Is like Paypal. Both are accepted on eBay like payment processor.
About weapons : It is strictly forbidden to send or receive payments as consideration for the sale or supply of: Weapons (including without limitation, knives, guns, firearms or ammunition).
What chances are to get my money back ?? And how to do that ?? Please help !

Contact them and get yourself a lawyer. Not reading or understanding the ToS of any financial institution is crazy these days, it essentially absolves them of anything you don't understand.
 
Skrill appears to be a company from London, England. Not surprising they view knives as illicit. Having never heard of them, I would have looked into it ahead of time.

I don't know how some foreign company could compel you to pay $2500 when they are out nothing, and have provided no service. Same goes for stealing your money. If you used a bank transfer, I would have my bank retrieve the money.

Talk to your bank OP, we are not really going to be able to help you here with this. The entire thing is a big mess and it's difficult to follow who did what, when, with what, how and for what purpose. Talk about finding a needle in a haystack the size of Texas. TO think, some people believe Paypal sucks..well guess what?

The TOS does not exclude "any" weapon purchase. The exact language is in my post above. At the absolute worst, it could be ambiguous, and ambiguities are construed against the drafter (Skrill). The TOS says the agreement is governed by the laws of NY. However, any state in which they do business has the ability to enforce its laws against Skrill (unfair trade practices, fraud, etc) where appropriate.

To the OP: I sent a link from this thread, to a fellow BF member, who is an attorney. Maybe he can view some of the facts, & TOS conditions listed by Skrill, and offer some advice.

I agree with the other poster, who stated making an argument, that this sword is a motion picture, memorabilia collectable piece...I just can't fathom that they can basically steal your $1850, simply because you made a mistake. Damn- that's a lot of money!

I for one appreciate the op for telling us his situation and educating us on this "Skrill." Might save some of us a lot of heartache when we decide we've had enough of paypal and start looking at other
alternatives. I can't really comprehend a company being able to just take over a grand of your money. How is that not stealing. I dont care what rule or violation the op broke.
My advice is just stay on them. Get your money back one way or another. This kind of crap can't stand.
