I just though of some other things:

The three swoosh symbol is a font style of Japanese characters. It is just a fancy three. So, in fact neither the term san-mai or the symbol are Cold Steel's property.

This makes the situation worse, as it is used by kindergarten students in China and Japan as they learn their numbers. They will all have to write "I'm Sorry" in perfect calligraphy and send it to Lynn.

In Chinese, a sandwich is san ming zhi - roughly "famous person stack of three". Don't you think that China is infringing on CS's trademark? What about the Earl of Sandwich?


From now on, we should call 三 "The number that used to be called three".

I know you are just messing around but your post got me to thinking ... which btw, hurts. Some folks might not understand why we are so passionate about this issue.

What is the difference between Cold Steel trademarking "San Mai" versus Cold Steel trademarking "Cold Steel"? I'm sure folks were using the words "cold" and "steel" together long before Lynn started his company. Some have argued that he just took advantage of a great business opportunity. "San Mai" aren't just two words anybody has the right to own. It is the same reason why Burger King can trademark "Whopper" or "Quarter Pounder" but not "French Fries" or "Cheeseburger". There has to be something that makes your trademark standout from the generic statement or term... hence the three little bars/wavey lines in CS's mark. MacDonalds does not have a trademark for "I'm loving it."... but instead, "I'm lovin' it".

I can't trademark Cord Wrap or probably even Cordwrap... but "Kordrap"(and the pseudo "Cord Rap") is registered.

I think Lynn is aware of that and is hoping that enough folks comply to solidify his claim.

Interesting. A company that big (who sell knives, not guns), not even sending a couple of reps to the largest knife show in the word, but instead going to the NRA show? Doesn't quite make sense, other than perhaps they ARE actually worried about the amount of backlash they've received over this SAN MAI issue.

If it was misunderstanding then they should post official responce and explain situation. So far i havent seen anything.

The letters were a bluff. Trying to protect/keep something that they didn't own in the first place.
 
Yep, it backfired. Instead of people backing away and strengthening the CS claim, the huge outpouring like this thread has made it even more obvious that there is no claim to protect.
 
I think he was imitating Cold Steels actions, ands saying they ran away from Blade.

Then again, we have a presidential candidate who tried to trademark the phrase "You're fired" (the part that may be even dumber is that he was saying it to people who had never been hired to begin with)...
 
No violation there. He is referring to the peson's attempt to copy write the phrase .. not on any other aspect of him. That is germane to the thread discussion.
 
I'm not really a knife maker so I don't have much to say, but hasn't Lynn "borrowed" some designs in the past? How can he do that and then get so bent out of shape when someone says San Mai?
