In regards to the possible copyright infringement, unfortunately, that's why we have sharks. AG seems to have the upper hand, and maybe the new kid on the block didn't know about him, but a judge is going to have to decide this one.

A.G. has the right to protect a name that he has spent countless hours and hundreds of thousands of dollars to build.

Hopefully that trademark just covers websites. There are plenty of brick-and-mortar stores using that name.

These stores tend to fly under the radar, and unless they decide to start selling nationally they will probably continue to do so.
