Another problem with Paypal and dishonesty

So is the only good way to sell through paypal to film yourself packaging up the knife at the post office, handing it to the postal worker, and making sure to capture the tracking number?

That is strange if you ask me. I'll never understand why paypal do not accept that weight difference...

You'd never want to do anything illegal, but I would want to have someone buy a very expensive item from the guy in France, then file a claim against him IF he sent out the actual item he advertised.
But I wouldn't, 'cuz that's illegal.

If paypal had some kind of feedback, or risk rating system, that could be checked for both buyers and sellers, it would be harder for the thieves to steal multiple times.

Paypal should ask buyer to send picture of the package cover in which he received the item. The weight stated on the package cover (200g) should be the weight of the package the buyer sent back to seller (if package was undamaged when buyer received it). If there is a difference in weight than Paypal should understand that the buyer is at fault.

I think so.... And I insured item at 500euros! But since buyer do not complain ( sure he planned to scam me from time when he bought it from me) it is not possible to fill it. Damn thief.

Is it possible that his refusal to provide a pic can be held against him?

I do not know what buyer sent to paypal, as he not communicate with me at all. He fill claim not contacted me prior that.

Paypal should have taken note that the seller did not contact you, first. That is supposed to happen prior to starting a claim.

Have you actually spoken to someone at paypal, yet? Or has it been only email thus far?

Rick do you mean speak over the phone? This is not an option for me from Slovakia, to sit 30 and more minutes on the phone - I've got only emails, and sent also emails..

So I've just got response from Paypal -

"When a buyer and seller are unable to agree on a resolution, we investigate the claim and decide the outcome. Once we have made a decision regarding whether this item is "significantly not as described," it will be considered final and cannot be appealed. ".

This is abolutely strange, how such big financial institution has such policy. First of all - I had no chance to contact with buyer because he put claim no contact from him - nothing.
Second - I've asked paypal to contact buyer to fill investigation with his post office, which is needed to fill insurance. Nothing. I've sent them tons of pics, video etc. - different weight, resoluction from my post office - nothing.

I really don't know what to do. I feel that I'm done with them - but I'd like to fight with them, don't know why. Because when this read another potential thief he can buy $1000 knife from ebay seller, fill claim not as described, send vinox back and he has money and knife....

Do I have any chance still?

Don't take this the wrong way, but if you can find a foolproof way to cover your butt without being paid in cash let me know.

Until then the risk of what this guy did will always be present, and it doesn't have to be PayPal. If he started the same dispute with his credit card issuer they would side with him as well, so even if PayPal reverses course (which will never happen without taking the time necessary to get them on the phone, more than once if necessary) I would expect the credit card challenge to follow. He would either claim not as described and returned to seller, or if the address you shipped to does not match the billing address of the card he used he can simply claim he never made the charge, which is a slam dunk chargeback.
I have been the victim of a few of those myself where PayPal/and or eBay has sided with me only to have the buyer do a chargeback through their card. When I had seller protection in place (eBay purchase) PayPal takes the loss. The guy in California who got me for about $2,000 last year was through my own website so no seller protection, and no help from police here in GA, or 2,500 miles away in California. OUCH!!

Any third party to your transaction doesn't care about you, or your buyer. They don't want anything to do with disputes like this and are only interested in a way to extricate themselves from messes like this. You have to give PayPal enough evidence to side with you, and my experience tells me you have to get a human on the phone to explain it to and answer his/her questions. They will be able to tell you are sincere and because they are speaking with you will personally develop an opinion of your honesty. Hopefully at that point your story will resonate and they will be interested in helping you by looking for inconsistencies in your buyers story.
If they find contradictions, or obvious lies in what he has said to them they may reverse the decision. I have done this myself, and I have failed so you never know, but I always had to talk to someone before getting anything reversed.

Good luck!

In the USA shipping weight is usable in a paypal claim. If there's proof from the courier that the package weighs 200 grams, and he's returning a package in the same packaging materials that weighs less... That is an obvious scam.

Exactly, that should be all the evidence you need Laurin. If you have documents showing the weight of your package that you shipped and the weight of the package that was sent back it should be all you need to show hes scamming. \

But I've sent them pictures, and video too. What else - how should I contact them?

Nope. It has to be the courier to give the weights not the seller. It's way easy to fake a video, or picture. How do you prove time stamps?
USPS in USA weighs the package throughout transit. This is to protect them of false insurance claims, like they claim something the item was stolen, they can see if the package changed weights drastically while in their hand.

Sorry Laurin, this is a seriously messed up case.

I'd get a letter written by an attorney (or someone who can seriously write like one) that outlines what happened and that threatens legal action against PayPal.
Their deep pockets will probably say "who gives a crap", but you might as well try SOMETHING since you seem SOL at this point.
