Sounds to me like Neill made a sound business decision based on the expectations of the OP. The saying " Go with your gut feeling" is very rarely wrong.
It is no different for a dealer,than for those of us that sell knives here. If a person has a bad feeling from communication, or past feedback, they are not obligated to sell.

As you stated in the beginning, this is a contracts case.

So as an Attorney you should well understand that the "customer is always right" in a contracts case is bullshiit.....................................

Oh and you would collect what in court, you suffered no damage beyond feeling Neil did not kiss your butt. Whats that worth, a nickle?
 
I've done a handful of deals with Neil & I'll tell ya.The man did everything he could to assure I had a good ,knife buying experience.Each & every time I bought from him it was like this.One time I said "Oh I don't think I have enough on me for shipping." Neil jumps in & says No problems,Ill send you a free shipping coupon.I tell ya,I wish he was closer to me,cause I'd like to shake his hand & buy him a grog or two.Even the last DDR I bought from him,he slipped in a bag of skittles.Any of your dealers ever do that!:D

Fast/Reasonable Shipping,outstanding service & communications

The OP's got a lot to learn about life in general IMHO.

I've never dealt with TNK so I have no dog in this fight. You laid out your requirements and TNK didn't accept them - how does that constitute a contract?

It did not, just a Law School student with a little knowledge and ALOT to learn.

You know what they say about those who pretend to be experts, who in reality are rookies?

After reading the thread my verdict is:

True North Knives and Mr. Ostroff: +1
Artfully Martial: 0

Hopefully future customers will turn this post up on a search and learn from my experience.
My take is- It reflects poorly on you Artfully Martial. As stated “Op sounds like the customer from hell.”.

And in closing I would not enter into any transaction with you but would gladly buy a knife from True North Knives and Mr. Ostroff.

Neil is one of the most honorable knife agents in the biz.
I hear feedback from customers every day about dealers.
Honesty, good product, cookies, lollipops, and good will are all part of the reason people go to one dealer or another.
Top Shelf takes work. Neil is part of that elite class.

Flawless has many facets. Neil was simply protecting his rep as a knife dealer. He just didn’t want you to be disappointed with a knife that you hold to a standard that is not available anywhere.

+1, I also know Neil personally He is a very smart man. He nipped a problem in the bud. I can totally understand why he declined to do business with the OP.
 
I've never received lollipops, choco chip cookies etc...but I have received the bandaids from NGK :D

I too am proud to call Neil a friend and it was after a dozen or so deals too.

Each time he exceeded my expectations and all the transactions were flawless.

Darrell is exactly right on this one.

The OP attempted to tie Neil's hands behind his back with this weird legal entanglement of a contractual obligation. Hell I would never allow that with anyone because you will never be able to make it right in the OP's mind.

I am amazed at the Huge Wall of Words this OP has put up in defence of his justification. If you are in fact a lawyer and you have a billable rate of say $300 per hour; you could have bought this same low cost knife four times over now.

It is a knife, move on find another dealer.
 
I'm with Neil on this one. From the first communications it sounded like it would have been extremely hard to please the customer. The customer subsequently says that wasn't necessarily the case, but it is easy to see where the dealer could have gotten that impression from the first e-mail or two. Neil does work hard to please his customers and it looks to me like he was just trying to avoid a situation where he was concerned that he was not going to be able to meet the customer's expectations.
 
I can't believe that I wasted 15 minutes of my life reading this thread! I did learn something though. It seems that the OP tried to call out TNK for what appears to be the OP's own troubles. Based on the many responses that set the record straight, I think I will now start shopping for my knife needs at TNK.
