Cold Steel vs. CRKT Lawsuit

I saw this recently and I'm not going to buy another piece of Cold Steel, except MAYBE if they drop the lawsuit and cover CRKT's legal costs thus far.

I hope this ruins CS. For a long time they were my favorite knife company, but I can't stand by and act like this is normal behavior.

Also, I expect the lawsuit would be dropped. Doesn't CS have to prove that they were directly harmed by these so-called false statements? Otherwise they have no basis for a lawsuit.
 
To prevail on a false-advertising claim under the Lanham Act, a plaintiff must satisfy the following elements:

(1) a false or misleading statement of fact; that is

(2) used in a commercial advertisement or promotion; that

(3) deceives or is likely to deceive in a material way;

(4) in interstate commerce; and

(5) has caused or is likely to cause competitive or commercial injury to the plaintiff.

Even after reading through this thread and seeing the "VS" video; I still bought the Otanashi Noh Ken.

What do Cold Steel think your going to do with the knife? scale a mountain while hanging off the knife itself? and with the lock release on the top of the body it would fold.

Any stress on the blade will be in reverse with a slashing motion or the length with penetration. I find the whole thing laughable, what do they think people do with their knives?

So if you can hang a car off of a fixed blade of a certain size should not a "virtual fixed blade" be able to the same job or similar? I am sure that no matter the design a folding knife would fail before a fixed blade every time.

Anyway i'm off to dynamite me some fish for dinner...
 
Virtual = not real. Physical = real.

They're as far apart as the North and South Poles.

No. People should read the definition of a word before presuming their own meaning to it:

"Being such in power, force or effect, though not actually or expressly."

therefore:

"not actually or expressly a fixed blade"

It really is that simple. People need to stop overthinking things

The act of disappearing the thread that they had started because it didn't garner the support and acceptance they sought confirms my feelings about the company's owner and or management. Anyone who thinks enough of themselves to paste their pictures, quotes and articles on everything they can isn't the type to accept criticism or admit fault or wrong doing. If the thread was filled with flowery support and flattery it would still be going over there. I wonder if it really surprised them how we reacted here? It shouldn't have. Not if they knew their customer base and not just their geek-ed out admirers.

I had purchased one of their XHP lock back releases a week or two before their lawsuit and planned on buying at least two more of the new releases ( 3v and 52100). I'm going to have to put that off though as they found a way to alienate me as a consumer. I bought my first Cold steel in the early 90's and have over 25 CS knives currently but no more. Good knives but company sucks!

Actually, cold steel has no problem with proper discussion of the situation, for or against. Theres another thread going now. The problem was that far too many trolls showed up with fat jokes about the owner and the usual troll drivel that happens that closes threads on this site.

Karda, I agree it was getting out of hand. I've never seen one disappeared like that before. Only closed and locked.They never even explained they were closing it or locking it. It was just gone. :) That was a thread that was started by the Cold Steel mod too. The new thread over there is one started by a guest/member.

I don't see them wanting to start a new one themselves after what happened IMO, but that they haven't closed the new one yet gets respect from me. They could just ban that subject if they wanted. It is their forum to moderate.
