The clerk has a swedge to make room for the pen to close. The main blade is ground from thicker stock, because the spring is thicker to add extra room for the pen.
Interesting, I was a bit surprised by it simply because I have never had a GEC make contact with the backspring. I'm hoping that over time as it gets sharpened it will just go away since it is such a small nick.

You can see the dink in the whips edge in this photo too. It doesn't really bother me it just needs to be closed easily.

taught me that if you’re getting blade rapp you can just sharpen it out. It has worked for me with a couple of Albers jacks that had the issue. 
That's the plan, I've sharpened it once already and will probably only take one or two more times for it to be no longer an issue.
No, not on the whip. I don’t have a clerk so can’t speak to that one.
