greged: Very Disappointing!

My concerns about PayPal's "having my back" are what prompted me to pay for the purchase through Visa rather than another method.

I don't do PayPal. Simple.

If it causes me lost sales or lost buys because someone insists on PayPal, some other dude/dudette can have it.

Not big into Ebay either. Great deals can be had, but between Paypal and Ebay, you can have enough aggravation to make up for the rest of the GOOD stuff that you do.

I'm suprised at the canned response; I'm going to check and see if the user agreement was changed recently.

I sure wish there was a good alternative to Paypal. I have heard of BidPay, but I haven't heard any feedback on them.

Im sorry youre having these problems Blues. Thanks for posting this for all of us to see. I'll remember the way he has treated you and think that getting a knife from him is not in my best interest. I hope you can get some resolution from this.
 
Thanks, again guys. Just in from the Blade Show so this latest info was news to me.

I'll keep you posted on developments so you can see what can/will happen in instances like these. At the very least it's informative of how things can and do go wrong and hopefully get resolved.
 
Got the following text from PayPal today regarding this ongoing drama.
It will be a learning experience for me to see how this is finally adjudicated between the two entities (visa and paypal).


We have received the merchandise you returned for the following
transaction:

Tran amount: $xxx.xx
Tran date: 05/xx/2007
Item #: xxxx

We've received your information stating you've filed a dispute with your
credit card company. PayPal does not provide refunds for returned
merchandise however will await the incoming chargeback. Thank you for
your cooperation.

So, now we'll see what happens from here when they receive the chargeback from visa. What a waste of time and effort. Had the seller only done the right thing this all could've been avoided. :(
 
They can not refuse a chargeback from Visa. Once Visa makes the determination that they are doing a chargeback, they do it. Paypal doesn't like it, but there is nothing they can do about it.

You obviously know more than I do about this process.

So, then does PayPal recover the funds from the seller? Do they just blow it off as the cost of doing business? What do they do with the returned item?

I can't imagine they just drop the matter after Visa recovers the funds on my behalf.
 
Thanks for that link, Keith. They seem to speak quite a bit out of both sides of their mouth (what a shock) but at least it's somewhat informative of the process and what results from it.

What I didn't see there was what the disposition would be of the goods in question. I imagine they'll probably send the knife back to greged.

I shouldn't think he'd have much hope of having the chargeback reversed if simply based upon his first email stating "send it back by Priority Mail, no problem." (The fact that he then capriciously changed his mind within hours and saddled me with his damaged goods speaks volumes about his intent and unethical business practice.)
 
Visa contacted me this morning to advise that they are crediting my account, processing the charge-back and sending the supporting documentation to the merchant bank today (PayPal).

Barring any attempt to refute by the bank, this credit will be permanent.
I don't really see how they can as they now have the knife in their possession plus evidence of the seller advising me to ship it back in his initial email correspondence.
 
Thanks, Keith. I'll be happier still when it's permanent and I know for certain that I have the taint of having dealt with this particular "POS" erased.
 
Excellent news, I'm glad it worked out. Another example why if you are going to use paypal, pay by credit card rather than bank account transfer or account balance. Nice to see Visa stepping up.

Let us know if you suffer any negative consequences from Paypal as a result of this chargeback. I've heard where they have gone back on the person initiating the chargeback because it violates their user agreement or something. Sorry if this has been covered already.
 
The only time Paypal will go after the person that has had their credit card company do a chargeback is when they determine that the chargeback should not have been given. It doubt very much that they will come to that conclusion in this matter. Paypal doesn't have a policy that disallows its members from doing credit card chargebacks.

I looked into doing a Mastercard charge-back on a paypal purchase about 3-4 years ago. At the time, the Paypal lady told me that if I was successful, that Paypal would close my account. I dropped the matter to keep my Paypal account active. Hopefully Paypal has improved their policy.
