Help with a trade

Close, it's the "perfect tender rule" found in the Uniform Commercial Code, Sec.2-601. To wit: "nless otherwise agreed . . . if the goods or the tender of delivery fail in any respect to conform to the contract, the buyer may (a) reject the whole; or (b) accept the whole; or (c) accept any commercial unit or units and reject the rest."

To "conform to the contract" means to meet the expectations of the buyer. To that end, Sec. 2-513 affords every buyer the right to inspect the goods in a reasonable manner before accepting or rejecting the goods. If the buyer rejects the goods, Sec. 2-602 states that the rejection must be within a reasonable time after delivery, and that the buyer must seasonably notify the seller.

Further, Sec. 2-508 affords the seller the right to "cure" the nonconforming tender by retendering conforming goods with a reasonable time, and notifying the buyer of the seller's intent to do so.

Bottom line, if the buyer/receiver of goods is dissatisfied for any reason, and notifies the seller/provider of those goods, and the seller is unable to provide a substitute that meets the buyer's expectations, then the deal has been breached. Then there are three options:
(1) Reverse the transaction;
(2) Don't reverse the transaction, and count it as a lesson learned; or
(2) Don't reverse the transaction, hire an attorney to sue the breacher, and argue in court about what's "reasonable" or not.

We have moved beyond that. Benya apparently believes these rules only apply to newbies and that because he has good feedback on this forum he is kind of exempt from them. So the stones were used and he did not want them, fine.
Then he sells a used knife as new and he refuses to undo the deal (including refunding Intl. shipping), not so fine.
 
Just as a casual observer on the sidelines, I see nothing wrong with those diamond stones.
 
Hey guys,

These recent threads have shed some light on Igor's ethics regarding trading that I was previously unaware of especially considering his immaculate record. I thought it was very odd that he so quickly rejected the aligner and that the forum was so aggressive towards me. Needless to say, I've moved past this and will certainly not trade with Igor again.

My suspicions that Igor could not correctly sharpen a blade were realized after receiving the bm 710 which was so poorly sharpened that I needed to send it to BM. In fact, I believe that Igor waited for my items to get there before he sent the BM which arrived in a USPS small flat rate priority box (the same kind I shipped mine in) covered in duct tape.

I plan to put the aligner back up for trade after I receive it.
 
I think Benya needed your aligner just for one job, sharpen that S90V Millie so that he could sell it as new. Maybe he overestimated his sharpening skills or he believed that because nirvanero was new on this forum he would not notice. I think you are owed an apology.

That is certainly a possibility because that edge looks strikingly similar to edges I've created with the aligner especially the rounded tip, but I'm not going to speculate about that. :p
