I encountered an armed burglar & held him at gunpoint!!! – NOT A JOKE!!!

hey andy, just wanted to follow up real quick, i have worked in a prison now for 30 years with the coolness of this dude, he has done time before, i will be willing to bet on that, you done everything that you could do, and done everybit of it correctly, if you would have shot or killed the guy with him not offering resistance. you could have been charged with a crime.
i have trouble with people saying that they would have killed him, because if we go around saying that we would kill people for this and that, then we would be in prison instead of being at home with our families.
unless you have actually killed someone and know the art well, then you cannot say, i would kill that person, because until you are faced with the situation, you do not acutally know what you would do.

and locks, safes, burglar alarms only makes it interesting and keeps an honest man out.

the dog loose in the house has become a known deterrent and the will go somewhere that does not have the dog, sometimes the little ankle biters are the best, unless you have an attack trained belgian malanois or something similar.

and we do live in a world that has gone to hell in a handbasket.

kudos to you, your dad and mom for calling 911, keep your head up and live everyday to the fullest...


I am not saying that i am a trained killer or anything... but at least where i live (in AZ) Andy could have shot that guy with no worries of criminal charges. The man stepping towards him after being told to "freeze" is a life threatening gesture in my book. What if Andy tripped taking backwards steps? What if the dude charged him? Andy may not have had his Glock chambered... there are a lot of things that could have gone bad... i am certainly glad that everything turned out o.k. and i am definitely not criticizing Andy for remaining cool and calm. I am just saying that i would have shot the guy...i never said that i would have been proud of myself for doing so. If i lived somewhere that i could face criminal charges for protecting my home and family then that would be different. But as i said, in AZ, that isn't a factor. I don't carry a gun to be a tough guy, i carry one so that i can protect myself.
 
as was stated by the fbi years ago, only one reason for carrying a gun and that is to kill a person with it.

and i believe in the fact that i would rather be tried by than carried by six.

the statement that i made was not directed at no one in particular at all.

just a true statement and you know yourself that you cannot second guess a jury, they will jack you every time, if it comes to that.

and if the prosecutor has any sense at all, you only have to say that you feared for your life...
 
Things are somewhat simpler in Texas.

Yeah, Up here in Canada he'd be out before the end of trial with a 3 for 1 credit for time served in The Remand Centre. and you'd be charged with some B.S. 'frangible glass' since he cut his hand trying to break in on your glass!

Check out the various types of gun locks.
Could you, or someone you know, build a really sturdy locked box of some sort? Might be far cheaper than any safe, and combined with gun locks(and camoflauging the box's location), would give pretty good security.:thumbup:

Probably. My Dad has a metal shop, welders, and all that kind of stuff.

Yes, I overheard him tell the cop he’d been in prison. I didn’t want to shoot him if I didn’t have to, and I know unless there’s a disparate about of force, I could go to jail if he didn’t have an equally deadly weapon and was an immediate threat. I might have been cleared because of his advancement on me & the distance between us, but I probably would have had to fight it in court. I didn’t want the risk of my freedom, & even though I was mad our house was ravaged, it’s not worth taking someone’s life, unless they threaten or attempt immediate physical harm.
 
Upbringing+drink+drugs+wrong crowd = fukced up brain and values. Familiar story - see it all the time and it's a worry he lives just down the road - sorry your place got messed up but glad you all came out OK if a bit shaken

Get a safe.
I have 2 for my knives, 6 for guns and ammo (at different houses) and another one for cash and jewellery

+1 what others have said. Get a safe. If you have even one nice knife, or one nice flashlight, or gun, you can afford a cheap stack on safe. They won't be fire proof, or withstand a determined person. But they will keep an intruder from getting them. I don't ever leave a gun loaded in the house when I am not there. I put them back in the safe ever day.

you can pick one up for 75 bucks or so.
 
I got some more info on him today. His name is Toby Carroll. Here's his record & sentence info. He lives close enough I’ve walked to the area. He has multiple charges for drugs, theft, & burglary. His most recent burglary charge he was sentenced to 20 years in 2003, yet he got out in 2007. Had he served his full sentence, we wouldn’t have had this little problem. So, it appears he’s a career criminal. Perhaps he should seek a new profession. It appears he’s not very good at it…
 
I'm glad everyone is ok and I know that you aren't happy about the incident taking place, but your post made me want to high five or chest bump somebody. A criminal captured at gunpoint by a citizen with a legal firearm. You don't see that in the news enough. It sounds like you handled the situation right. One of the countries biggest problems is too many Toby Carrolls and not enough Andy Nayors.

This story made my day. It's always good to read about an armed citizen exercising their right to protect themselves and their domain. Andy, sorry, but I couldn't help but laugh when I read about the perp's moped being towed away. I imagined it being dragged on the road behind a tow truck with a chain attached to it. :D
 
I wanted to give you guys an update. Today my Dad & I went to court to testify. It was for the guy’s probation hearing. We both testified, as did the deputies. The fact that he was drinking alone was against his probation terms, let alone breaking in. He claimed he’d “blacked out” and didn’t remember it. But one of the deputy’s testified that during questioning, he stated “I came out the back door, and a guy had a gun in my face.” Which isn’t what happened, but the dumb@$$ admitted being in the house with that statement. The detectives also testified that he had been drinking.

The judge found him guilty of violating the terms of his probation, and sent him back to lockup for 600 days. I guess his criminal trial will come sometime after that, so it might be a couple years. When it was over, we rode down the elevator with the detectives, and asked them if they ever traced the cell call that kept ringing while we were holding him. We thought it might possibly be an accomplice calling. They said they checked it out, and it was his mother calling him, as he’d said, telling him a storm was coming & to get out of the rain. :rolleyes:

So, that might be all the news about the situation for a while. I wanted to fill you guys in. :D

The best quality safe in this area is Johnson Safe Company in Whiteland. Jeff Johnson has a booth at every 1500. Nothing compares to his quality for the money. You get about twice the size and quality for what you would pay for a manufactured brand at Gander, etc.

I like nothing better than to read a story like this where an individual is prepared and exercises their rights to protect their family and property. However, I have to say that you are extremely fortunate to be alive and lucky that this perp was an idiot of the first rank. I know it is hard to think logically in these type situations, but knowing what you knew about the firepower laying in that house you should have NEVER approached or tried to enter the home, and especially with your Dad. You know there are loaded shotguns in the house and you go in to clear it with your pistol- are you crazy? You're extraordinarily lucky he didn't blow you back out the door with your own shotgun. You should have taken the keys from the moped and backed to the end of the driveway and called 911. Maybe he would have escaped on foot and certainly the story wouldn't be as interesting, but that would have been the right decision in this situation-no doubt .

hey andy good show man, make sure and follow up for the main trial and if you guys have a habitual felon law, make sure that the district attorney pursues that. if you guys do not stay behind the matter, phone calls, visits to the da's office etc, they will not pursue the matter and he will not get any time at all.

at least now the scumbag is in prison, where he belongs, it sucks that out justice system is as weak as it is, if he had been in saudi arabia, they would have excecuted him. remember the guy that spray painted the car in another country and they beat the $h!+ out of him with a fishing rod, bet everytime he walks by the paint isle in home depot he has flashbacks, huh.

but we have to stay behind matter if we don't, then no one will care...
