Copyright registration is required to pursue action in federal court. Copyright infringement actions are a matter of exclusive federal pre-emption. Expecting to succeed in a small claims action is not realistic. Had you had a contract and were not paid, that's a different scenario.
Under the laws, including the DMCA, if you can show copyright ownership, you can ask for a "take-down." Because of this, and the potential for negative publicity, the general hassle of dealing with "problems," you should be able to succeed with direct contacts. They might issue a "correction." The chance of getting paid is limited.
You can't take up a claim for copyright infringement in federal court if the image is not registered. You can take up a claim in small claims court, though.
Signed off a 500 piece sprint run on Friday. We have some of the new ELMAX steel we can utilize. There are still some design changes we need to go over with Rick, and a few details need to be ironed out, but I'd imagine those will be taken care of in short order. Lets say late Sept/early Oct. on these. I don't have a price yet, but it will be in the $225-$250 range.
