I was on both ends in a similar situation both as the seller and the buyer, and the bottom line is insure all packages even if they say they don't want it, because at least if you have to pay up, you will have the insurance money (providing the mail company accept your claim). The negative of all this is that both parties lose out in the end because the deal went sour and usually the two buyer and seller usually don't do another knife deal ever again. and regardless what happened to the item, someone gets burned.

The knives didn't reach the buyer.

With it being only 55$ I'd take it on the chin, and offer a refund for the two knives that did not arrive.

That's the fastest way to put this behind you and move on.

You win some you loose some. That's the way I looked at it when I lost a 100$ on a recent deal.

do you believe the buyer?

on one hand, he chose not to purchase insurance, and gave up any protections provided, including reimbursement for lost and/or damaged contents.

on the other, most here will conclude that the deal is not complete until both parties are satisfied.

i always purchase insurance, regardless of what a buyer or seller wants. when selling, i offer no alternative, and when buying make the request.

more details may be needed until we can make a fair assessment.

in the first post, i was trying to fully understand the situation and transaction details.
ive always felt insurance protects both parties. but in the event of a lost/damaged package, which has happened to me as a seller, i reimburse pending the insurance claim and payout.
 
if the buyer had expressly denied insurance, and you expressly stated that in doing he accepted all risk during shipping, i would say no reimbursement is in order. this is basically what i explain to international buyers, since insurance does not typically cover property once it leaves u.s. soil.
i would speculate the buyer simply did not see your insurance clause, which is a bit hasty on his part, but he should also not be faulted, necessarily. at least as it pertains to being made whole.
 
this should not be viewed as an issue of blame, but of responsibility.

If he did not see the part about insurance how did he manage to see the payment info?
 
im not here to argue with you, its your sale and you asked for advice/opinion.

you may do as you please. if you think a partial refund is sufficient, and the buyer is in agreement, that's fine.
 
Since the buyer received 1 of the 3 knives then as long as you both agree on a fair value of the two missing knives then a partial refund sounds acceptable to me.

If the buyer instead wanted a full refund and agreed to send the 1 knife back that he received then that would also be reasonable and fair to both.

I don't think the buyer is entitled to a full refund and also to keep the knife he received.
 
Folks, situations like this are why the insurance is so important and ultimately affordable. I don't send anything out uninsured unless the buyer fully understands their assumtion of any loss incurred and I have proof positive they understand there end of the risk. It simply is not worth the turmoil of who pays for what when things go bad. Whenever I see adds saying insurance is extra, I pass on the deal. To me it says this is a seller who doesn't care about the sale. I may be wrong but why set myself up with a situation like this? I realise insurance doesn't come free but a couple bucks vs suffering the loss of goods/cash? Come on! Man up and secure your transactions!
 
Default mode, is it's the seller's responsibility to get the knife to the buyer.

Should a seller be able to avoid that responsibility by a clause in a FS ad?

No.

Does your disclaimer regarding insurance shift that burden?

No.

Insurance protects the seller if the knife doesn't get there.

The risk of in-transit theft is not assessed to the buyer, who has no ability to prevent same.
