Problem with a Trade

Hello all Okay here is how this went down. First of all I agreed to trade some guy from Arizona I meet on theknifeauction an 11" Buffalo Horn Frank Beltrame with a Kris Blade for a Rainbow Centofante/ Ken Onion Kershaw. Well we was to both ship the same day with delivery confirmation and so I did as an honest person would I sent him the knife and tracking #. Well I emailed him for a tracking number and I got the reply I have no money I'll ship when I get the cash. I was like okay I guess that will have to work. Well to make a long story short he recieved the knife last week and emailed me to go blank myself. So, I'm out my FB that I had for sale. He did sign for the knife is there anything I can do about this situation. If so please email me at qualityknives@shoppalstores.com.

If this is the only lesson it takes to make you realize to never trust anyone, ever, than you'll have got off pretty inexpensively.

I haven't been in a problem like this but have read other threads with similar circumstances. I don't know exactly what the USPS can do for you, but I'd call the US Postal inspectors to see what recourse that you may have through them. Then... I'd call the local police who have jurisdiction where HE lives and talk to them. Try and file a complaint for theft by deception or fraud. If asked, state that you are willing to press charges if he doesn't turn over either your knife or his knife plus any funds due to you.

Save your correspondence from him, the emails sent back & forth. Also hold on to the receipt & Delivery Confirmation stub from your package.

Hopefully, others here will chime in with better advice. Sorry to hear of your troubles, and I hope that you get what's yours.

The big problem though is I think you might not be allowed to send autos with USPS. I was told that. Is that true?
 
As I understand it a U.S. federal statute prohibits the interstate commerce of autos by individuals and companies unless they are being sent to active duty L.E.O.'s and military or to someone supplying them.

The Switchblade Act, (Pub.L. 85-623, 72 Stat. 562, enacted on August 12, 1958, and codified in 15 U.S.C. § 1241&#8211;1245), prohibits possession on Federal lands, Indian reservations, military bases, District of Columbia, Puerto Rico and other protectorates. It prohibits manufacture and sale of switchblades in interstate commerce.[6] The act was amended in 1986 to also restrict ballistic knives. Federal law controls Federal aspects only, and does not mandate prohibition within an individual state. It does say specified knives can not be mailed through the U.S.Postal Service, and provides penalty exceptions for other common carriers/shipping companies doing normal business.[6]

18 U.S.C. § 1716(g)(2) provides this summary:

Federal law prohibits shipment of automatic knives across state lines, with the following exceptions: Switchblade knives can be shipped: (1) to civilian or Armed Forces supply or procurement officers and employees of the Federal Government ordering, procuring, or purchasing such knives in connection with the activities of the Federal Government; (2) to supply or procurement officers of the National Guard, the Air National guard, or militia of a state, territory or the District of Columbia ordering, procuring, or purchasing such knives in the connection with the activities of such organization; (3) to supply or procurement officers or employees of the municipal government of the District of Columbia or the government of any State or Territory, or any county, city or other political subdivision of a State or Territory; procuring or purchasing such knives in connection with the activities of such government. (4) to manufacturers of such knives or bona fide dealers therein in connection with any shipment made pursuant of an order from any person designated in paragraphs (1), (2), and (3).

15 U.S.C. § 1244 provides, in summary: Knives can be shipped by common carrier, that sale, transportation or distribution, possession or introduction into interstate commerce of switchblade knives is authorized if it is pursuant to a contract with the armed forces or any member or employee thereof acting in the performance of his or her duty may possess switchblade knives and may have them shipped to him and sold to him or her. The possession and transportation upon his or her person of a switchblade knife or a blade 3 inches or less is authorized to any handicap individual who has the use of only one arm.
 
The sticky wickett is that it's an Auto. I'd be worried that you'd get doublely stuck on that:(.

It still bums me that you got ripped off.
 
I'd post his name and address and e-mail here for all to see. He probably is a member and we don't need anymore thieves. Maybe when he sees his name he'll make it right.

esav is the expert in this area, but iirc it is a regulation that is impossible to enforce and generally ignored.

sounds like mail fraud to me (but again, lets ask esav). save all your communications and print copies of the original exchange agreement.
 
I just talked to the postal people tha only thing that can be done is to file a police report of stolen goods. So, I don't know if it's worth the fight or not.

you have his info, and filing a report costs you nothing other than a few minutes of time.

if it goes further, there is a possibility of court time, but at this point it seems unlikely.

call his local police department and ask to speak to a property crimes detective.
 
I know this guy Ashley says is ripping her off, this is a lie! This Kershaw she obsessed over and harassed him over was a 1 of a 1000 made with pearl inlay. He didn't really want to part with it but she harassed him about it for over a month. He offered to sell it to her but she insisted on a trade for this FB stiletto, she told him she paid $65.00 for it. He finally gave in to shut her up but he wanted a picture of it, she sent one. I read all the e-mails! He told her the stainless looked scrathed and un-polished, she said it was her camera. She sent it to him. I saw the knife, it didn't look good. He mailed her back and told her about it and he would be sending it back. Her reply was absolutly crazy. "I knew you would rip me off, you're a thief, I was told you would rip me off". Again I read the e-mails. He mailed her back asking how sending the stilletto back was ripping her off? She didn't answer, she flipped out with insults about his disabilities insisting he's a thief. He told her he wasn't sending it back until she answered the question and apoligized. Her reply really ticked my friend off, she said she had not paid Beltrame for the silletto and now how is she gonna come up with the $45.00 to pay him. His reply was "I thought you paid $65.00, you're the thief and a liar. She said she meant $65.00. He told her now he understood why she insisted on only a trade for this knife. He then told her that he would send her $45.00 for the stiletto and she accepted. He told her he would send a money order, she said fine. Again I read all the emails. Then a couple hours later she e-mailed and said she was kicked out of her mothers house and lost her paper route over this situation. I was sitting right there when my friend called directory assistance, got her mothers # and called her. I listened on the speaker to her mother say she wasn't kicked out, that she doesn't care what her daughter does anymore, she 21 yrs old, has given her all kinds or problems and wishes she would move out. She said she's bi-polar and should take meds. Ashleys the rip-off and she's a con and a lair. I also know there are a growing # of sellers and buyers that don't want anything to do with her because of her irrational behavior. My friend is a great person and does'nt rip anyone off. He doesn't take any crap from anyone either. His military background and history is to be respected. Ashley will get her $45.00. NOW YOU KNOW THE TRUTH!
