Axis lock patent

Exactly, the patent IS expired on the axis lock. Although, they still own the name "axis". So anyone who now uses the lock must call it something else, like say "G-lock".
No. Not "exactly". No where did I say that I think the axis lock patent is expired. It is a bit silly to agree with things I did not say.
 
OK - this is quite enough gentlemen. I had both a Ganzo and the real Benchmade HK 14205. I still use the Benchmade and dumped the copy. Not a big deal. The rule here should be Know Your Product. Copies of basically everything are everywhere out there. Whether marked Williams, or Ganzo, or Gotcha, :cool:!!!

I know this was replied to someone else but... this is really silly.

Really??. just because someone doesnt AGREE with you, it doesnt mean:
1) it is clear that they are trolling
2) they are supporters of Ganzo & China
3) they need to learn better or leave the community.

This mind set is just senseless to me.. same goes with “dont ask questions. You do research and find out”. So what if it was discussed before? Because you dont like the question, it can only be asked once?

I truely hope some people here can become mature some day.

I wish we could discuss the topic. I honestly did not know this was even a hostile or touchy subject. My question was very simple.

Im surprised at the replies of: You need to leave the community, you support Chinese clones, you need to ask somewhere else, etc..

Also.. the thread is like a day old.. weird to see “see all these non-answers? Now get out and dont ask”.

My question was simple:
I find many articles, posts and links talking about patent for Benchmade Axis lock has expired. Is this true?

If you do not know.. you do not need to post again saying “i told you already, you need to research”... i get the point.

Regardless of the day that Benchmade's license lapses or the original patent becomes open to any and all makers that will not legitimize Ganzo.

They built the foundation of their business on IP theft. That won't go away and they won't ever be anything but derided here.

It's easy to make a thread with a question and find the answer. Even for a charged topic that's been beaten like a rented mule a new poster can legitimately not know and not be able to search the info in past threads. But when multiple threads about the same question are created and when they all get the same accurate response and the OPs response doubles down into a view that's is contrary to facts it crosses over into suspicious.

This is really getting near to quacks like a duck time.

My apologies for creating two threads.. it was an honest & foolish mistake.

I created one thread that was about axis lock.. and it turned into discussion about China and Ganzo. So i said “im out, i wish I can close it”.

Then created another thread that asked axis lock question, but with an addition that said “lets keep China and Ganzo stuff out... only talk about axis lock patent”....

Both threads are mostly about Ganzo and China now... *sigh*
 
It seems people are very hateful to China & Ganzo.
No. We hate copies, clones, etc. And we hate poor quality and bad qc. Usually no one hates otherwise. People also want to support factories in there home land. Thanks for assuming otherwise.

An RE patent is not a revised patent-- it is a RE-EXAMINED patent and was challenged in the USPTO based on discovery of prior art. There is no way to create a revised patent, but a new patent can be issued for an idea that is sufficiently novel and distinct from a previous patent. Anyone claiming a revised patent exists is spreading disinformation.

But... i thought spreading disinformation is encouraged as long as the purpose is to make China look worse.
 
Since quality matters to me and benchmade doesn't |*edit| have good quality control from experience I've had with them. And seeing the patent is over... (*see quotes to original post).

I'd get one of these. Nothing like a benchmade design, but appears to be an axis lock knife with high quality. I dunno Russian though.

Very nice! It looks awesome! That is nothing like the Chinese ones. I mean that is clearly inspired by Benchmade, not a blatant theft of patent like Ganzo.
But that seems expensive

I'm no patent lawyer, but having browsed through the original patent as well as at least two of the publication versions of RE41259, I saw some differences (for example, the word 'tool' was changed to 'knife' in several places). I also know that RE41259 is a 'continuation in part' of the original patent.
Go look up a PDF of the latest reissue (RE41259E, 4/27/2010), page 13 calls out several differences (additions and retractions) between RE41259E and the original.
Now, I'm not claiming that a reexamination will automatically extend the term of a patent... It shouldn't. But looking through some patent office statistics, it seems that more than 50% of patents have patent term extensions, usually granted due to review delays.
So basically, I'm saying I don't think you can necessarily count +20 years to the day and say that's when every patent expires. It isn't that simple. If it were that simple they'd print the expiration date on the patent issuance.
