Ok, thanks for those pics. After seeing that clip, I'm going to agree that's not NIB. That looks.... used.
 
Roberto, remove the clip and see if there is some wear on the CF beneath. That's a sure sign of pocket-carry. BTW, that clip is unmistakeably used.

The CF seems "brighter" in that zone:

These are just details, but I only need to see the blade, it's been touched and doesn't have the "toothy" aspect of new ones.

After looking at the photbucket link posted ny Nirvanero I do have to agree that looking at the picture of the clip it does appear to have been carried at some point due to the chipping along the painted edges.

The rest of the knife looks to be in pretty good shape and I don't think that the blade has been sharpened. Looks like a typical spyderco factory edge to me from many I have seen. The tiny rust spots are so minor I will bet that they will wipe off with an oil soaked rag and you will not be able to tell they were ever there.

I do think that Nirvanero is entitled to a partial refund because of the fact you insisted on NIB condition and that knife does not appear to be in NIB condition. If that is what you both think would be fair and the main thing for you both is to agree on the amount to make it fair. If no partial refund is agreed upon then the knife should be returned for a full refund since it apparently was not in the represented condition.

The best for both parties is to agree on an amount you both can live with for the settlement.

The knife he sent me he described as Lnib was clearly carried and sharpened. I already sent it in to Benchmade lifesharp to take care of it though. What's funny is that the military in this looks like it was sharpened with the dmt aligner I traded him that was in "bad condition". I didn't take many pictures of the knife as I figured I shouldn't make a big deal of it after the way the trade went, but after looking at thread I think I should have.

I don't want to speculate, but I know for sure the knives traded to us were not as described.

The knife is CLEARLY sharpened. I can post some pictures of what a factory spyderco edge looks like if anyone needs it.
 
I own around 60 Spyderco's and that is not a new knife. Nice knife, but certainly not NIB.

I have some 60 Spydercos too and this was my sixth Military after getting CPM-M4 G-10/Ti version, but even if I only had Benchmades I could tell the difference between a NIB one.

I'm a little crazy about knifes been in mint condition (when I scratched my Mayhem hurted more than when it bitted me), so you can imagine that this wasn't what I expected.

Factory edges are "toothy", in macro photos you can see microserrations and grinding lines. This "white polishing" look is typical of a touched blade. If you look at the photo you may notice the "edge" is not as even as it should be.

You're correct; here is a picture of a Spyderco sage after being sent into Golden for a sharpening. When you send a Spyderco to be sharpened, they are sharpened at the same factory that sharpens all Golden made Spydercos.

That's it, good photo. I think it's easy to tell the difference.
 
After checking out all of the pics, it looks like it been carried a couple of weeks.I consider this knife used lightly not NIB. IMHO.

Believe me, I feel your pain. When I first started getting into Spyderco knives, I got a good deal on a Manix. The original one with the back lock. Taking it out of the box it fell and hit the ceramic tile floor and rolled the blade something awful. At that moment you couldn't have kicked my dog and made me feel worse. I ended up getting it back in good shape and sold it for 50 bucks to a friend because I couldn't stand looking at the sharpening job that had to be done to fix the blade....or maybe it was a reminder of my own stupidity. :D

Maybe keeping this one is not that bad as it could be a reminder of how stupid is trying to have every sprint run at any price, or how fun is using it instead of staring at it... the same I did with my Chinook III once I scratched its blade... :)

Edited to add:I know those NIB military's come with an absolute needle like point. Could also be just my eye's. I'm over tired.

Goodness, aren't these blades hand-sharpened at the factory? What I see is a factory edge. I find this type of nitpicking rediculous, but that's just me.

That is not a factory edge. I'm not trying to argue, but I know what Spyderco factory edges look like.

These are NIB Spyderco factory edges from Golden,CO(same as the S90v Mil), look at the grind lines. That's my pic and those are my knives

That was the first thing I noticed as well. Maybe just the way the pic. looks but it would be interesting to compare to another Military.
