Bad Beware of Jeremy Swisher aka j-swish16, jamesjones, & JKnight1. Misrepresented condition of knife - painful transaction and ordeal.

Update time........Ok so the knife arrived today and I must say earlier than expected. At least earlier than expected given the date when the tracking numbers were sent and the knife actually shipped. However I was sweating like the previous buyer from J-swish when I hadn't heard anything in days and did take a few days to ship. No harm on this though as I myself have been guilty of being busy or occupied to where I didn't ship that same day or so. Now onto the knife. I was under the impression when it arrived it would be in LNIB condition however when I opened the package it clearly wasn't. Now everyone might have their differences as to what LNIB actually means (and see it is mentioned above a few times) but my personal take is it the blade wouldn't be sharpened and no marks on the knife. Personally I wouldn't list a knife and claim it as such if it wasn't in this very condition and call it LNIB. Then I went over to the seller's actual description and it reads "I HAVE TWO KERSHAW AUTO’s (launch 1 & 2). THE LAUNCH 1 is black with a stonewashed blade. NEVER CARRIED, cut or sharpened".

To give a history of Launches I've handled are quite a few from 1, 5, 8, 9 and so forth and have owned 2 other Launch 1's at some point. Though I wouldn't bet my life on it, I'd bet an expensive bike and a car this knife has been sharpened before. One can note the blade grinds and the width of the blade from edge to spine and to an experienced eye it isn't hard to tell. Then you have the discoloration and fine grime on the edge seen with the naked eye and a few rough marks near the tip. (If I had a higher powered camera I'd take a shot.) The black wash does a good job of hiding scratches but there in the right light a visible scratch exists about 1/3 up the blade from the scales across the whole blade horizontally. In addition there are light snail marks on both sides of scales as one would be if you dragged something very lightly across the finish on a new Sebenza (not deep but visible in right light). Finally, the pocket clip is CLEARLY marked up on both sides and across the top. I know I'm not the sharpest tool in the shed at times but maybe someone can tell me how you can mark up a clip as such and claim it to be "never carried"? Then firing button was kind of gritty which IMO I've never experienced before in a Launch knife used or new otherwise. After taking the knife apart it was clearly overly oiled and some grit in the firing plunge and around the pivot. Again, I've never received a non-smooth Launch new or otherwise used that had to be cleaned.

Thus in light of all this info it is very hard to believe the knife wasn't sharpened, wasn't carried, and definitely cut more than a few things. Here are some photos:

I would agree that it is not as described, and would have said you should return it. Unfortunately, you took it apart, so now it's yours. The best you can do is try to negotiate a price break. Swish is obviously overstating the condition of these knives to help with sales. If he lasts, he will soon learn that this doesn't help him or his buyer-returns and reductions are very costly both in money and reputation. These knives are not falling into any grey area(on condition) and there will be a complaint every time.
If he gives you restitution I wouldn't call him a thief, but he sure isn't a seller I could recommend or care to deal with-too many problems. If he learns from the mistakes, maybe he can move past this, but I am not going to test the water.

Perhaps there is a learning curve that doesn’t come naturally to some. Hopefully he will follow through with both buyers, make the deals right, and just chalk it up as a learning experience.
 
Update: The knife I sent back has been received by J-Swish16 and he processed the refund on Paypal. This matter is now resolved. Thanks again for everyone's input.

I was going to request a mod lock the thread but I see Gilbert G has posted in this thread and is dealing with a similar situation with J-Swish16. I do hope Gilbert G and J-Swish16 are able to reach an agreeable solution.

Not to pile on you, but while there can be a bit of difficulty grading used condition, there isn't much grading new. I believe in this situation the seller wants new condition money, just doesn't own new condition knives :)
but I also hope he learns something from the experience. He didn't seem to be the worst person that has come across the forum, but may be a bit greedy.

I have a few blackwash Kershaws and the "scratch" looks like it could simply be part of the stonewashing; in the right light at the right angle, some marks show out more and appear deeper on a couple of my knives. I guess that's the point - to hide actual scratches - but that does make it harder to know if a knife purchased second hand is used or not. Hard to say looking at the picture, no doubt hard to say with the knife in hand.

The clip though, that's pretty obvious. If it hasn't been carried, it's certainly at least not been kept safely in its box. Kershaw will send you a new clip for free through their website, but that doesn't change the fact that the knife is without a doubt not "LNIB". LNIB means that the item should be absolutely indistinguishable from one that you receive as new, and you are the first one to open the box and remove the item, except that the knife has been handled, opened, perhaps even scraped away some arm hair or opened a letter from your cable company that you thought might be a bill but is only an announcement letting you know about a service that you already have. In other words, looks new but ethics, honor, and in the interest of full disclosure is not represented as truly "new". This knife is not "LNIB". Even if it was never carried (doubtful), it was definitely not stored in a manner that was anything less than negligent in preserving its pristine condition.

Being new doesn’t matter. You don’t need to be here for years to be honest and have morals and use common sense when selling items. Being accurate in your descriptions and being honest about whether a knife has been used or not should be common sense. Lying and misrepresenting your items has nothing to do with being new and everything to do with lack of integrity. It’s good you did the right things in the end but it should’ve never happened to begin with.

I wasn't blackballed when starting out selling here, and it's not a "policy" that I know of.

It's good to read your words and I hope that at blade forums, it works out for you.

Members here can be very critical and outspoken when foul play is suspected, but in reality all they want is for everyone to be treated fairly. It’s great to see that you took the right course of action with the refunds!

Being new here is not an excuse in this case. There is no confusion about lnib, new, etc on a carried and used knife.
not buying it. You did it at least twice recently and got exposed. Simple as that. Yah you did damage control which is one small step.

You flat out lied about the condition of both knives being discussed in this thread. That wasn't a mistake, that WAS malicious. You played the members here for a fool, thinking they wouldn't notice some very obvious wear marks and damage. And of course, you have deleted most of your for sale posting you have created, changing both the title and body to "hh" or "gg" etc. so that buyers do not have much recourse. Of course mods can probably roll that back, but I digress. These aren't rookie mistakes, these aren't oopsies, these aren't "I didn't know better" moments, you deceived and mislead, it's as simple as that. Stop making excuses, own up to it, and do better for the few remaining members that will actually deal with you.
