One pissed off newbie. Medford Knife and Tool.

If I was in his shoes, I'd want to talk to the one person who can tell him when the knife will be ready.
At this point, what other choices are available?? I would want his ass on the phone to man up and stand by the BS that I was told......originally 30 weeks, what I signed up for, that turned into over twice that. If he can stand by that with good conscience.......he deserves to lose a lot of business.
I would then be looking into ways to recoup my money.
Maybe I'm off track, been known to happen, but I'd want to hear it from him.
Joe
Can't hurt.

What else besides beg for Medford to fulfill it's legal duty when it has already indicated that it never had any intention of fulfilling that duty?

How about raising the price of its misconduct?

Assign your chose in action to an Arizona resident in the same court jurisdiction in the Phoenix area and have him sue Medford for breach of contract.

Then we have 18 U.S.C. § 1343

"Whoever, having devised or intending to devise any scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses, representations, or promises, transmits or causes to be transmitted by means of wire, radio, or television communication in interstate or foreign commerce, any writings, signs, signals, pictures, or sounds for the purpose of executing such scheme or artifice, shall be fined under this title or imprisoned not more than 20 years, or both. If the violation affects a financial institution, such person shall be fined not more than $1,000,000 or imprisoned not more than 30 years, or both."

Using the Internet to obtain money by false or fraudulent pretenses is federal wire fraud. The statutory language has been interpreted very broadly to reach "conduct which fails to match the 'reflection of moral uprightness, of fundamental honesty, fair play and right dealing in the general and business life of members of society'." Blachly v. United States, 380 F.2d 665 (5th Cir. 1967)

I find it incredibly disappointing that they see absolutely no issue in the delay and did not proactively communicate a change in the timeline to the customer. It's almost as if they are crossing their fingers and hoping that maybe, just maybe, if they pretend like nothing is wrong, the customer won't notice either.

I got the same feeling Sutherland. The way the OP explained the call to A Medford it was like a goof........oh the time to completion on the site is just a guess, it's usually much longer.....have a nice day.
Really???

Just checked the order I placed on 31/3/2016 and was told 36-40 week lead time. Might follow up with them at the end of November and see how they are tracking. I haven't heard anything from them updating the timeframe.
Hopefully they don't go out of business before the OP and myself get our knives!!
Matt

Greg Medford provides his cell number on the plastic business cards that come with every knife. He and his wife answer their phones after hours and on weekends in most cases. As someone mentioned before, he is probably the easiest knife maker to get on the phone. Having said that, he is quite candid but I wouldn't let that stop you from calling him. There are a few examples of Greg solving customer's plights in their favor.

-Remaking a knife for a customer: https://www.youtube.com/watch?v=2HcICmxrDzM

*Customer refund for extended delivery wait-time similar to your situation: https://youtu.be/R9JiEhzRE8I

-If you don't want to watch the whole video* then the refund situation is at 9:00 minutes: https://youtu.be/R9JiEhzRE8I?t=9m2s

Does anyone actually believe a word this clown says? I tried watching one of the videos referred to above, gave up after he contradicted himself for the 5th or 6th time in less than 10 minutes. What a tool.

JohnWe, I provided the links above for the OP's leverage during personal negotiations with Medford. S/he could use it as precedence like we do with common law cases. Greg's resolution on these former matters may be an opportunity to confront him with hypocrisy whereby convincing him to bend and allow for a refund. Whether you believe it or not is besides the point. The important concept to grasp here is that Medford stated it for the record and therefore caused precedence in the eyes of his patrons.

On the issue of credibility, each knife in question was offered to the public for resale in the videos (tangible evidence). Whether a refund was actually charged back to the customer in the second video is unsubstantiated yet as stated above inconsequential during a parley between the OP and Greg. Greg would never admit that he stiffed the customer and sold his knife if that were the case which I doubt.

This is allegedly a matter of a promise made via interstate "wire" communications with no intent to keep it in order to induce a payment of money that did induce a payment of money. If true, that's a bit beyond hypocrisy. It's a federal felony.

I don't think this matter has been truly defined by the OP. Does the OP wish to press charges, file a suit in civil court for damages, or simply receive a refund?

If a refund is preferred then why not ask for it? If Greg doesn't capitulate then raise the issue that he's granted refunds before; hence the hypocrisy angle...

I agree Usagee. At this point, can it hurt anything if the OP speaks with Medford??
Does he want a refund?? Does he want the knife???

Medfords own phone number is on the card shipped with each knife, if the OP ever gets his knife that is

I wonder the cost of one legal 'thump' and if the 'thump' would be wise, monetarily, for the OP?

Victims of federal felonies pay no legal fees for prosecution of the criminal. The criminal defendant, on the other paw . . . .

I don't know..I've seen a few of their videos from various show interviews and I wasn't impressed.
Seems like a huge, overpriced knife if you ask me.

This company.....Is?

IMO a bad experience, and has many reasons I will not do business with again. Not the first time I've heard of this............... Forget about his videos, if he really wants to sell his product he will need to get on board with the 21st century in which he has not. Seems to me he thinks he has a higher standard than all.... NOT, IMO

Hope things work Man, I feel your pain. TD
