Delwin, said it was his design. I wasn't familiar with Michael's work so I didn't recognize it. My friend that does my waterjetting informed me after I had sent him all the parts. You seen the drawing he sent me?

I agree that stealing another knife design is not something that you as maker should want to do, and I also think Delwin shouldn't claim that as his design if he stole it from Burch. But I saw that sketch, and it was extremely crude. A lot could be inferred. Type of grind, materials, level of crafstmanship, folder or fixed? Both share an outline, and that's all I see from those two photos.

Think about it this way; many different knifemakers have made coffin handled bowies well before either of us were born. So if I sent this sketch to a custom maker

and said it was mine would that mean that I stole your knife design? In truth, all I did was adjust gradient and contrast of an image from 888knivesrus.

Bottom line, you're the one operating the business. Design issue aside, Delwin costing you $250 in materials still does not equal the $400 you had from him for the 2 months until this thread.

So this whole incident in a nut shell:


Delwin commissioned Jim Adams to copy someone else's knife without letting Jim know the truth.

Jim bought the materials and somehow found out.

Jim knows that to copy someone else's knife is wrong and Delwin is at fault for not telling him the truth.
So instead of backing out of the deal completely Jim decided to keep his money for a while to punish Delwin.

Delwin made it public and here we are.


Delwin shouldn't commission a knifemaker to copy, and Jim shouldn't keep his money because he's no knife police so it's not up to him to deliver the punishment.


Am I missing anything?

That summary looks fair to me. They're both at fault here.
Hopefully, Delwin will get his money back soon, and that will be the end of it.
In the end, Delwin's cost will just be some hassle.
Jim Adams, on the other hand, will be out the cost of materials.

Perhaps, at the least, Delwin has learned that design theft is wrong in this country.

That doesn't look good at all. Do you want this matter to die down or not?
If so, you should repay the man his money, and let it alone. That's the quickest route to resolution.
Trading insults with folks in this thread is not going to win you any business IMO.
My advice is to take the high ground at this point rather than take the bait.

I can say that because I put a smiley face with it. Is that how it works?
I'm not entirely sure that website clicks are going to translate into business success.
Everyone slows down to look at a car wreck before it gets cleaned up.

400 visit this week. Three orders and My buddy that was here earlier ordered 5 knives. So Dumba--es :)

This thread just keeps getting from bad to worse with every single comment Mr. Adams makes.

Let me tack on a smiley face. :) Smiley faces in threads like these are akin to people saying "I'm sorry for saying this, but you're a dumbass." No one's really sorry for anything they say by prefacing an attack with "I'm sorry." Likewise, that smiley face isn't doing jack.

I hope his business does well after all of this, because he's got a lot of digging to do. Out of the giant hole that is.

Interestingly if you type in Dao blade (or better still "da-dao") into a google image search you get pictures like these:

I think it's pretty clear that Michael Birch was inspired by traditional Chinese blade shapes - that's why he has called his line of knives Dao-flipper, Dao-folder, Dao-song. With that in mind it's clear why Delwin would be attracted to such a knife design and also (whilst no means being conclusive) could create the understanding that he was commissioning a Chinese folding knife. The inclusion of the flipper and the handle shape are pure Michael Birch but these detail may have been be lost on Delwin.

No, he commission me to do Michael Burch's knife exactly, not a chinese knock off. His specifications where exactly the same. When he gave me the length it was the same length as Michael's knife.

Once again I want to remind you all if Delwin had told the truth there would be no GBU thread.
