Some time right after the firts of the year things might get serious for this idiot if the Officer(s) my friend contacts decides to make this a criminal case. If that happens, all those owed knives/money will need to step forward.

Of course, if this moron (a moron is one who steals a few knives or money for a few knives and the knives are not one off Loveless, Moran's or scagels) gets hit by lightning and re-grows the smart part of his brain and makes all the victims whole then no criminal complaints will be filed.

But if he does not:

The good news is my call to Bradley's mother today got some action. Bradley actually just called me back (maybe threat of arrest?). He apologized profusely for letting his personal problems get in the way of our transactions. He admitted that he was basically in rehab.

He will be sending (and I really hope he is being straight with me) my Manix 2 via USPS priority tomorrow.

He will send the rest of the knives also but has gotten all of our information mixed up (but I discussed the Emerson and Mule) - probably why I got Chris's Ayoobs (sounds perverted). I told Bradley that I would collect everyone else's information and call him as soon as I receive it. From what I can tell, besides Chris and me, he still owes two people knives:

1) Jaiofspam - Emerson CQC-8
2)Rad.fr - Spyderco Damascus Mule

My email address is If you're willing, email me your name, address, amount paid for the knife, and confirm the type/name/model knife it is. Hopefully this will get Bradley straightened out as to who needs what. I will call him ASAP (I'll let you know when I have) and see that he has the details and confirm that he will ship USPS priority immediately. He said he doesn't have much access to the internet now that's why I think it might be easier for one of us to deal with him.

If you need me to pass on any other information (now be nice), let me know. If you want to do this a different way, that is fine also. Sounds like Bradley has his hands full so I want to make this as simple as possible.

Since talking with Bradley Monday, I have not been able to reach him again (He gave me his cell phone number). His agreement with me was that he was going to send my knife by USPS priority mail the next day and I was going to call him with Jiaofspam's and rad.fr's addresses so he could send them also. I called Bradley Tuesday and Wednesday several times each but was only able to leave a message. I called his mom again Wednesday and was able to speak with her. She said that though she was not responsible for his behavior, she would pass the message on - and that she would see Bradley that night. She also confirmed his cell phone number. I asked if she was willing and able to send the knives out just to put an end to this ordeal. She was not.

It's a bit too early still to take delivery of anything Bradley may have sent Tuesday, so I'll wait a few more days. If there is no further communication from Bradley and we don't receive the knives in the next few days (will probably wait until after Christmas) I'll try contacting the law enforcement officials in the area where Bradley and his mom live.

My last message to him will be that I am going to pursue local (to him) law enforcement actions. I really don't know what options or actions the local law enforcement officers can or would take on my behalf. I will try calling the local police department and at minimum ask if I can file a report but would really like to go for an arrest. I'm out $260 and two other forum members are out about $100 each. What level of crime could Bradley's actions be considered? At one point, a long time ago, I was told that anything over $100 would be considered a felony. I'm thinking he might be moved to action if a local police officer had the time to personally inform him he was looking at an arrest for a felony. But then maybe I'm just jabbering too much. I still have some hope that he will come through. Mike
 
I'd say file the report ASAP. You can always drop the charges when/if the court date presents itself. At least with a report on file, it can be forwarded to the appropriate investigators who can then and only then obtain a warrant for his arrest after careful investigation of the accusations and proof against Bradley Hendricks. Stuff like this takes a little time, so get the ball rolling Monday morning (I suppose in a few hours from now - I"m working overnights so my days are all messed up :eek:).

when it comes to theft in california, anything under 400$ is a misdemeanor and anything over is a felony.
 
The threshold for a felony under these circumstances in Arizona is that the value of the stolen property would need to equal or exceed $1,000.
 
I would say go for it now. The last couple of weeks were time enough for him to get the message. He is still buying time, hoping this will go away. I am banning him permanently right now.
 
Thanks for the information J., Xtonesterx, and Chris. Looks like we're looking at a misdemeanor all around since the three of us looking for our knives or reimbursement don't all live in California. I will contact the local law enforcement office in Scottsdale and ask to file a report. Thanks again. I'll keep you posted. Mike
 
Keep in mind that your losses may "only" be misdemeaners, but if he is going through a troubled period, which could include substance abuse, his legal position may be fragile enough for this to put him away. Restitution would be only escape from that.

Since he is now banned permanently, his recourse to BF is gone, he can only communicate with each of you privately.
 
Thanks Esav. I appreciate the help. If he is going through hard times, I really don't want to make things worse for him but he has made no effort lately to contact me - especially after promising to send our knives within a day or two. A phone call goes a long way. Both he and his mother know how to reach me privately. I will make one last effort and let him know that I will be taking legal action close to his home if we cannot reach some sort of an agreement.
 
Im guessing that he does not even have the knives in question in his possession.
I would think it would be simple enough to send these knives out and all this
trouble for him would go away. Instead hes avoiding all communication like the
plaugue. You guys need to stay on him because hes probably hoping for all this
to die down. Hope everything works out for you guys.
 
Let me know if my contact in Arizona might be of value. He is on vacation util 01-03 but is aware of some of the "facts".

Although this may not rise to Felony level, this idiot may have priors and another misdemeanor could be a third strike or at very least carry a year's jail time for each offense. If the Judge were to issue consectutive jail terms, more than one bar of soap on-a-rope wwill be necessary!!!

People like him count on the sympathy and goodwill of people like you. He will just continue to do it to others unless someone puts a stop to it. You might even be doing him a favor by prosecuting. If he continues down that path he will cross the wrong guy someday and may pay with much more severe consequences.

Tomorrow is Thursday, those of you who never received anything should at least file a police report. The report isn't the be all end all so nobody should feel bad about making one. After the initial report an investigator takes over and that is the time to present emails, credit card transactions, etc... This may be one large case, but each person involved needs to file their own report.

I would also advise leaving the mother out of this headache as her son is legally an adult even though he hasn't acted like one yet. It's safe to say that she has tolerated being the monkey in the middle, but this isn't her problem. Luckily, with her help we all know this guy exists :thumbup:

If the knives do turn up, you can always drop the charges and I'm more than certain that the investigator won't mind closing out an extra case :D

Thanks for the input guys. I've put it off for a few days, but I will be contacting his local law enforcement agency tomorrow.

Yesterday, I received an email from PayPal stating that they have ruled in my favor. They mention that if he has insufficient funds in his account, (which is most likely) they will take action against his account. I'm not sure if that will mean anything for me. If I do receive a refund through PayPal, I won't be pursuing money or a knife from Bradley (I guess that would now be up to PayPal) but I will still determine what his local law enforcement agency may or may not be able to do. There are still two other members here that have not received their knives either so we can still keep the pressure on.

Early on, I did file a report with my local police department. I'll have to check to see if they were able to take any action. The times that I have contacted Bradley's mother, I made it clear I was not calling to pressure her and acknowledged that she is not responsible for his behavior. I just asked that she relay the message. She is in regular contact with him and seemed OK with that. It was after my second call to her that Bradley did call me back and promised to send our knives immediately - a stalling tactic I guess. The last time I spoke with Bradley's mother, I let her know that I would not call her again but please let him know that I would be filing a report with their local police department soon if I did not hear from him.
