I have Proof of shipping as well as your agreement to relinquish any responsibility if the knife gets lost or seized by customs which might even be the case. Did you not agree to this?
Esav, Yes he did ask it to be shipped express. I made a mistake and accidentally shipped the package first class. I offered to send Andrey all of the money used for shipping as well as some extra. I even went back to post office once I realized it was shipped First Class. Andrey seemed to be understanding at the time.

Guys, thank you for understanding this situation! I couldn't explain him, that it's only his fault - and why I should pay for it this money?
If it would be express mail and some problems with packet - it would be only my problem. But he ship it just like in lottery, without service, and can't understand it. Is it adequate guy?
My guess is that Savic agreed to absolve you of any loss or responsibility based on you shipping to him with Express Mail International. A far more secure, tracked and prompt service, with which he has had excellent results.
To that end he specifically requested Express Mail International and paid you, in full, for this service. You did not ship using that method and now the parcel has gone missing......... In essence you did not hold up your end of the agreement.
Using the wrong uninsured shipping method is down to you and blaming Savic does not change your incompetence. The responsibility for the loss is yours.

Gosh, this ^^ is where you stepped in crap Over your boots. Accident, your fault, my fault, nobody's fault makes no difference. You simply did not do what was asked of you....by your own admission. Good intentions and $1.00 might get you a cup of coffee in today's market. You can easily prove you wrapped the package and according to the USPS date stamp, surrendered it to a Post Office. You cannot prove that it was delivered, so now it is a he said-she said situation, and all the positive feed back in the world (or lack of it) still won't prove he got the package. USPS International Express would have eliminated all this.
It looks like your are holding the dirty end of the stick to me.

Since both parties agree to PayPal's terms and conditions upon the use of their service, and those terms do not allow for the passing of risk of loss, your point (as it relates to PayPal and their obligations, which is all I was referring to) is moot.

Choice of Law. This Agreement is governed by and interpreted under the laws of the state of California, USA as such laws are applied to agreements entered into and to be performed entirely within California by California residents.
Receipt of Payments; Risk of Reversal of Transactions; Collection of Funds you owe PayPal. When you receive a payment through the Service, unless you follow the steps necessary to qualify for our Seller Protection Policy described in Part VII of this User Agreement, you are not protected against a subsequent reversal of the transaction. In the event that the sender's transaction is reversed for any reason and you do not qualify for the Seller Protection Policy for that transaction, you will owe PayPal for the amount of the reversed transaction plus any fees imposed on PayPal as a result of the reversal. Examples of such a reversal include, but are not limited to, a credit card reversal by the sender of the payment, and a reversal of the transaction because the sender of the payment was using a stolen credit card or unauthorized bank account. PayPal will seek to recover the funds from you by debiting your PayPal balance and, if there are not sufficient funds in your PayPal balance, PayPal reserves the right to collect your debt to PayPal by any other legal means. If you open a Premier or Business Account after October 11, 2001, you authorize PayPal to debit your bank account linked to that PayPal account for the amount that you owe PayPal on transactions which were not covered by the Seller Protection Policy and which were not recoverable from your PayPal balance.
i. General. If you pay a seller who does not ship the promised goods, you should first contact the seller and attempt to resolve the dispute. If you are unable to resolve the dispute in this manner, you should then file a Buyer Complaint Form with PayPal as soon as possible. The Buyer Complaint Form may be found by going to the "Resolution Center" link in the header of the Account Overview page.
PayPal will investigate your claim, contact the seller and, if the seller does not present appropriate proof of shipment, a full refund or other evidence of a satisfactory resolution, PayPal will seek to collect the amount you paid from the seller. 3. The seller can provide reasonable proof-of-shipment which can be tracked online. This documentation must show that you shipped to the Confirmed Address. (Most U.S. carrier companies offer this service, including the U.S. Postal Service.) For transactions $500.00 USD or more in value that are initiated between November 15, 2001 and April 19, 2002, and for transactions $250.00 USD or more in value that are initiated on or after April 19, 2002, the seller also needs to provide an online proof-of-receipt in the form of a signature from the recipient. Because comparable proof-of-shipment is not currently available for electronically-delivered items, we are currently unable to offer Seller Protection for digital goods and other electronically-delivered items.
4. The seller accepted a single payment from only one PayPal account for the purchase. (Multiple payments from different accounts for a single item are a fraud indicator. Sellers should not accept such payments.)
5. The seller ships to a domestic (U.S.) buyer at a U.S. address.
6. The seller cooperates in resolving disputes by responding in the following time periods: When a complaint occurs, the seller must provide complete information within 7 days of a request from PayPal. However, if PayPal is required by the credit card association to respond immediately to resolve a reversal, sellers must provide the information within 3 days. PayPal will indicate the response time required in the e-mail message sent to the seller.
7. The seller ships within 7 days of receiving payment.
So, subject to instruction by my betters, it's about shipment of the goods. California law applies, which allows risk of loss to pass to the buyer upon shipment.
