So did he put 1040 or 1060 into yur account!??!

Also that declared value thing is tricky. No matter how you rationalize it and the ethics part of it, it makes it impossible to then get insurance for the actual value. It also will make it tough to make your case since you started out with a documented uhhh 'inconsistency.' I'm not saying I dont believe you. This is a sucky situation for everyone involved and im genuinely sorry and hope it ends up showing up...

Also having once shipped a watch worth 400 dollars and declaring that value--but insurance supposedly not being allowed--it dissapeared on its way to county comm. I think most of those workers see a value over a 100 without insurance and therefore without a trace and they think christmas came early.

He put $1060. Through paypal. I instantly contacted Andrey regarding the issue and I assumed we were good. In no way was this done maliciously. Im off to work. I'll answer anything else tonight. Thanks all for the help resolving this issue

I have Proof of shipping as well as your agreement to relinquish any responsibility if the knife gets lost or seized by customs which might even be the case. Did you not agree to this?

Esav, Yes he did ask it to be shipped express. I made a mistake and accidentally shipped the package first class. I offered to send Andrey all of the money used for shipping as well as some extra. I even went back to post office once I realized it was shipped First Class. Andrey seemed to be understanding at the time.

My guess is that Savic agreed to absolve you of any loss or responsibility based on you shipping to him with Express Mail International. A far more secure, tracked and prompt service, with which he has had excellent results.
To that end he specifically requested Express Mail International and paid you, in full, for this service. You did not ship using that method and now the parcel has gone missing......... In essence you did not hold up your end of the agreement.

Using the wrong uninsured shipping method is down to you and blaming Savic does not change your incompetence. The responsibility for the loss is yours.

As for Savic being "understanding at the time" really what choice did he have? The parcel was sent incorrectly and it was gone.

Gosh, this ^^ is where you stepped in crap Over your boots. Accident, your fault, my fault, nobody's fault makes no difference. You simply did not do what was asked of you....by your own admission. Good intentions and $1.00 might get you a cup of coffee in today's market. You can easily prove you wrapped the package and according to the USPS date stamp, surrendered it to a Post Office. You cannot prove that it was delivered, so now it is a he said-she said situation, and all the positive feed back in the world (or lack of it) still won't prove he got the package. USPS International Express would have eliminated all this.
It looks like your are holding the dirty end of the stick to me.

Unfortunately, gosh, you entered into a business transaction where you did not keep to the agreement (did not follow specific shipping instructions for which you received additional payment). If the knife does not show up, it falls upon you to either replace or refund the payment. It just isn't paypal, but all international business works this way.

Guys, thank you for understanding this situation! I couldn't explain him, that it's only his fault - and why I should pay for it this money?
If it would be express mail and some problems with packet - it would be only my problem. But he ship it just like in lottery, without service, and can't understand it. Is it adequate guy?

SaviC the knife may still show up. I have had Priority Mail and First Class Mail take up to six weeks to reach me.
If the knife does show up I hope you will remove your Paypal dispute and pay Dosh in full. It would be the right thing to do.

I'd have to agree. No matter how irrelevent it may have seemed, the deal WAS for express mail. Maybe mail clerks in Saviks area tamper with parcels that are not*shipped trackable express, and thats why he insisted upon it. If the knife is lost, and the possibility exists that it was lost due to the package not being shipped by the method previously agreed upon, then a refund of the price of the knife should be on the seller, not just the $40 extra that was paid for shipping. That said, one thousand is a lot for any one to lose; i do hope the package turns up.

Whoops... The gentlemen quoted below are 100% correct. Accidents do happen, and mistakes are made all the time. It is in how we choose to deal with those mistakes that makes us who we are.

Since both parties agree to PayPal's terms and conditions upon the use of their service, and those terms do not allow for the passing of risk of loss, your point (as it relates to PayPal and their obligations, which is all I was referring to) is moot.

Can't find those terms, which is likely a reflection on me. Can you help?

Irrelevant. gosh failed to comply with the terms under which they had that agreement: Express International.

Fair enough guys ...

Andrey Once again I am sorry for the shipping error on my part, but to have the charges reversed prior to finding out any additional information seems like you jumped the gun. I provided you with emails and photos regarding your parcel but you claimed you never received them? Why would you do that? Why would you ask me to claim it a a camping tool and declare it as $100 item? I guess I should also be asking myself why I agreed. Thank you all for your feedback. In the mean time I will do what I can to trace the package.

Gosh, I don't think there's one person following this that is wishing either of you ill-will, we want this transaction to end-up with everyone happy.

I hope the knife shows up!

Good luck to both of you!

gosh:

I can't understand you. You never sent me tracking by words, only photos. I received your photos, and from that photos I understood, that the service was wrong and wrote you about it. It was first day in our bad conversation.
Why you think that I never received your photos?

Glad I only use PreyPal to buy:
Receipt of Payments; Risk of Reversal of Transactions; Collection of Funds you owe PayPal. When you receive a payment through the Service, unless you follow the steps necessary to qualify for our Seller Protection Policy described in Part VII of this User Agreement, you are not protected against a subsequent reversal of the transaction. In the event that the sender's transaction is reversed for any reason and you do not qualify for the Seller Protection Policy for that transaction, you will owe PayPal for the amount of the reversed transaction plus any fees imposed on PayPal as a result of the reversal. Examples of such a reversal include, but are not limited to, a credit card reversal by the sender of the payment, and a reversal of the transaction because the sender of the payment was using a stolen credit card or unauthorized bank account. PayPal will seek to recover the funds from you by debiting your PayPal balance and, if there are not sufficient funds in your PayPal balance, PayPal reserves the right to collect your debt to PayPal by any other legal means. If you open a Premier or Business Account after October 11, 2001, you authorize PayPal to debit your bank account linked to that PayPal account for the amount that you owe PayPal on transactions which were not covered by the Seller Protection Policy and which were not recoverable from your PayPal balance.

What to do if goods ARE NOT SHIPPED:
i. General. If you pay a seller who does not ship the promised goods, you should first contact the seller and attempt to resolve the dispute. If you are unable to resolve the dispute in this manner, you should then file a Buyer Complaint Form with PayPal as soon as possible. The Buyer Complaint Form may be found by going to the "Resolution Center" link in the header of the Account Overview page.

PayPal will investigate your claim, contact the seller and, if the seller does not present appropriate proof of shipment, a full refund or other evidence of a satisfactory resolution, PayPal will seek to collect the amount you paid from the seller. PayPal may also limit the seller's access to his or her PayPal account. You will be entitled to the return of any and all funds PayPal is able to collect from the seller for funds received by PayPal prior to the seller's account status having been changed to limited access. RECOVERY OF YOUR CLAIM IS NOT GUARANTEED.

Can't find anything about delivery. Help?

For the seller:
i. General. PayPal agrees to indemnify sellers of physical goods from reversal liability resulting from a buyer's unauthorized use of a credit card and/or false claims of [NOTE!!!] non-shipment of goods. This protection applies only to the sale of physical goods, and not to any non-tangible, non-physical goods or services pursuant to section 1 above. It applies to up to $5,000.00 USD per year of payments received by the seller through PayPal if the following conditions are met:

1. The seller has a U.S. Verified Business or a U.S. Verified Premier Account or a Canadian Verified Business or Canadian Verified Premier Account. Note: While non-U.S. sellers outside of Canada may have a status of Non-U.S. Verified, they do not qualify for and are not protected by the Seller Protection Policy and therefore may be responsible for any reversals made due to fraudulent funds
2. The seller ships to the buyer's Confirmed Address.
3. The seller can provide reasonable proof-of-shipment which can be tracked online. This documentation must show that you shipped to the Confirmed Address. (Most U.S. carrier companies offer this service, including the U.S. Postal Service.) For transactions $500.00 USD or more in value that are initiated between November 15, 2001 and April 19, 2002, and for transactions $250.00 USD or more in value that are initiated on or after April 19, 2002, the seller also needs to provide an online proof-of-receipt in the form of a signature from the recipient. Because comparable proof-of-shipment is not currently available for electronically-delivered items, we are currently unable to offer Seller Protection for digital goods and other electronically-delivered items.
4. The seller accepted a single payment from only one PayPal account for the purchase. (Multiple payments from different accounts for a single item are a fraud indicator. Sellers should not accept such payments.)
5. The seller ships to a domestic (U.S.) buyer at a U.S. address.
6. The seller cooperates in resolving disputes by responding in the following time periods: When a complaint occurs, the seller must provide complete information within 7 days of a request from PayPal. However, if PayPal is required by the credit card association to respond immediately to resolve a reversal, sellers must provide the information within 3 days. PayPal will indicate the response time required in the e-mail message sent to the seller.
7. The seller ships within 7 days of receiving payment.

So, subject to instruction by my betters, it's about shipment of the goods. California law applies, which allows risk of loss to pass to the buyer upon shipment.

Good luck with that.

From PayPal:

Important Shipping Information

Depending on the type of claim or chargeback the buyer files, you will need to provide either Proof of Shipment or Proof of Delivery to get coverage.

If you're responding to an "item not received" claim, you'll need to provide Proof of Delivery from a shipping company that meets the following conditions:

It shows the status as delivered.
It confirms the date the order was delivered.
It includes the recipient's address, including a minimum of the city, state, and zip code (or equivalent).
For payments of $250 USD (or local currency equivalent) or more, it includes proof of the recipient's signature to confirm delivery.

If you're responding to an Unauthorized Purchase, you'll need to provide Proof of Shipment from a shipping company that meets the following conditions:

It shows the status as shipped or delivered, or shows a postmark.
It confirms the date you shipped the order.
It includes the complete recipient's address.

Note: Proof of Delivery is an acceptable alternative to Proof of Shipment.

Andrey, I have no problems with you. I sent the photos from my cell phone while at the post office. I've shipped out plenty of items and I always photograph the shipping info with the postal stamp to show that I was actually shipped. Its a lot easier then writing down 16 digits. I do hope you receive the knife and I want to believe that I am not being taken for a ride. I did make a mistake by shipping it first class as i told ya through our email conversations. Yes I agree at the time there was nothing either one of us could've done once the item was shipped, and I do agree that pat is my fault as i admitted earlier. Have you tried contacting Customs or your postal service? When you had any questions I always responded. I have never dodged anything and provided you with all that was asked. If you receive/d the knife I just ask that you be a honest person and realize that I did send it out and contact paypal. If you do not receive it I guess neither one of us will see that knife again. I know $1000 is a huge purchase, and feels your concerns, but remember I have something to lose as well. In the end if the knife doesn't turn up, I'll be the one to suffer.

SaviC, since it was first class it might take awhile. I had one just make it to Russia that I sent out November 9th, 2011. It took about 4 weeks.
