This is not the 3rd grade! We're having a discussion about current events that span several online services as well as state lines. We have a member MIA who allegedly defrauded another member...worse than that, a BASIC member allegedly defrauded a GOLD member...(there's gotta be a rule in there somplace about that!?)
Anyway, so you decide we can't talk about it any more?? Bullshit! Sure, you have the power to lock the thread, but that doesn't make it right! And the facts are coming out as we discuss this…is that not why we discuss things? Are we going to wait for the kid (who is keeping unusually quiet about his alleged involvement) to surface??

This is one experiment I think is poorly conceived.

1) Auction where Keim offered CB59 to the highest bidder.

2) Braundc won the auction at 10/25/02 4:08PM for $702.00.

3) Kiem marked the item sold in another forum at 10/23/02 10:50AM.

4) Kiem sold the bali to Nybble through the For Sale ad.

5) The bali was shipped on 10/25/02. Insured with Insurance Claim Ticket #VC 085 053 922 US, for the amount of $10.05. Addressed to me.

6) Bali was delivered on 10/28/02.

7) Since he used the USPS to mail the bali to Felix, while the auction was still open makes this a case for Mail Fraud.

Those are facts. No emotions. Just facts.
 
WOW, i just read through the entire thread and i still have no idea what exactly happened, no doubt due to some peoples intention to keep things vague for one reason or another, this is what i gathered

arokiem ordered knife from chris but due to certain problems ended up not getting it, and a poorly choosen set of words to describe the transaction got the first arguement going. HOWEVER, someone else bought the knife that arokiem commissioned so it's all good with chris now...

arokiem bought the dobruski from bladeart (took me forever to figure out if he actually bought it or not) then he had it for sale on both the forums and on bladeauction. this is where im confused, braundc won the blade auction? but he didn't pay for it yet, so therefore nothing loss and nothing gain whats the big deal just forget about it? but who bought it from the sale ad on the forums? beluga? tonyccw? and who had the knife now? i'm getting the idea that only one person paid and that person got the knife so whats the problem? i mean yes it would make me mad if something like this happened but since i didn't pay for the knife yet whats the big deal? and arokiem bought it from blade art, don't they have any left? or maybe on a nother online site?

Problem is trust has been broken. And Kiem credibility is in question.

In a forum such as this, Trust and one's credibility is a major commodity.
 
Think of it this way.. if you made a deal on a house, told your realestate agent you would take it.. they agreed and you guys shook on it, and then when you showed up with the cash they told you they sold it to someone else.

Well, sure you didn't actually pay yet, but you were still screwed out of the house right? Same situation here. Now maybe it will end with hard feelings and that's it.. but the person who didn't recieve the knife kiem sold to them has a legal right to that knife. It seems the only way this will end cleanly is for kiem to produce two knives, one to each of the people he sold it to.
 
This is all too funny. I'm sure everything was just a misunderstanding. But in any case, if Nybble bought the knife, why is it in the possession of tonyccw?

Actually, I've made an ass of myself like this once before. I sold a record on eBay that I didn't even own anymore. So when I got the money in the mail and was about to send the record out, I couldn't find it. I had to explain to the guy that I didn't have it anymore and sent him back his money. No hard feelings. I didn't even get negative feedback.

Another question I pose is, why did kiem post an ad for the one knife in two places? I suppose only kiem can answer. Accidents do happen.

Fact: Nybble was out of town when the bali was to be delivered. I received it as a favor.
 
Kiem is scheduled to be in Canada for a month or two, so don't expect a reply any time soon. Yes, there are internet cafes, so I don't know what his delayed response is about.

Unfortunately, I know first hand, how ignorant and unreliable Kiem can be. I made arrangements to buy a knife from him and I sent my payment, he went to Vietnam without sending the knife; nevertheless, he had the time to cash my money order. He also offered to include two kydex sheaths as a complimentary gift. I told him that he didn't have to do that, but I'd appreciate it nonetheless. A month and a half later, without communication, I surprisingly received the knife and he took the liberty to disclude the sheaths that he promised. Ironically, he cashed my money order the same month that he claimed to be short on finances, resulting in a "sour deal" with Chris at 29 Knives. What I don't understand is why someone who has time to deposit my payment and spend it doesn't have time to fulfill his share of the deal by sending the knife. Overall, I was very disappointed, but felt fortunate enough not to be taken advantage of... or was I?

Doug, I hope it works out for you. To be honest, I don't think it will. It's a good thing you didn't break the bank.

Kiem's behavior reflects his integrity standards and, I for one, don't tolerate it one bit. Unfortunately, for him, his reputation is spoiled due to his negative attitude, disgruntled remarks, and filthy business practice. Fortunately, for us, we have learned from his mistakes and know better for next time. This definitely belongs in the GBU forum.

Kiem, you have lost my respect and trust.

The idea of a "cooling off period" was an experiment. Very often, when adults reach impasses in negotiatons and arbitrations, when emotions seem to be running a bit high and seem to be overshadowing the actual case, the mediator will declare a "cooling off period," just suspend the discussions for a short time. It's not childish at all. So, I thought I'd give it a try here. Apparently, it didn't work.

This discussion has gone outside the scope of The Balisong Forum! and turned into a discussion of a business transaction that happens to involve a balisong. It belongs in The Good, The Bad, and The Ugly forum, so that's where the whole bundle is going.

i understand how you feel chuck, being a mod is not easy, especially on such a large forum, there really is not way to stop people from saying certain things or doing certain things even if you lock or delete posts people can just start another thread like in this case,

However, a night or two before he left I phoned him(I partially removed this sentence)... I talked to him forabout 10-15 minutes or so...

We talked about a many of things.

I'm not going to discuss with what all was said between him and me. No need to further incriminate either partie(s).

I did how ever leave my phone # with him, and he did say that he would phone me after he arrived and had time to do so.

If/when he contacts me I will inform him of recent events.

BTW, Kiem if your reading this thread, could you please make a attempt to call me. Id apreciate it.

Hm... Are you saying there's a conspiracy against Kiem? Not sure if Felix expected to be outbid with his high bid, before leaving on his trip, or why he placed such a high bid in the first place. I'm also not sure what the payment arrangements were. In either case, I'm not the one that left the auction open after taking money for a sale.....
